Students' early morning decisions about what to wear to school have led many school districts into legal issues and policy challenges. The innocuous decision of what to wear may not be a trivial decision in all situations. Issues of constitutional proportion hang in the clothes closets and lay folded in the dressers of many of our youth. Confederate belt buckles, exposed bellies, sagging pants, political statements, and social commentary have all been banned from schools, and these bans have often resulted in litigation by students who claim their constitutional right to free speech has been violated. Student Dress Codes and the First Amendment: Legal Challenges and Policy Issues explores the legal issues that arise when a school prohibits various types of student attire. Students carry with them into the schoolyard the constitutional right to free speech, which public schools must respect. At the same time, school authorities must maintain an environment that is conducive to learning. Those twin responsibilities come into conflict at times, and what to wear to school is one of the areas of conflict. This book analyzes the major Supreme and federal court decisions that have addressed the constitutional issues surrounding what students wear to school.
