Von der Ausschoepfung der von der Insolvenzordnung bereitgestellten Sanierungsoptionen sieht die Vielzahl der Schuldner aus Angst vor dem absoluten Kontrollverlust ab. Dabei stellt die InsO mit dem Planinitiativrecht aus 218 Abs. 1 S. 2 InsO die Moeglichkeit bereit, schon vor dem formellen Insolvenzverfahren einen vollstandigen Insolvenzplan auszuarbeiten und mit den Glaubigern abzustimmen. In der Praxis hat sich hierfur der Begriff des prepackaged plan etabliert. Die Arbeit setzt sich mit dessen Grundlagen, Anforderungen, Chancen und Risiken auseinander. Es erfolgt eine eingehende Analyse seiner Gestaltungspotentiale im Hinblick auf das Insolvenzverfahren, orientiert an der fur den sanierungswilligen Schuldner erstrebenswerten Perspektive der Steuerung und Planbarkeit.
