Law and Justice in the Courts of Classical Athens (Hardcover): Adriaan Lanni Law and Justice in the Courts of Classical Athens (Hardcover)
Adriaan Lanni
R2,570 R2,352 Discovery Miles 23 520 Save R218 (8%) Ships in 12 - 17 working days

In The Law Courts of Classical Athens, Adriaan Lanni draws on contemporary legal thinking to present a new model of the legal system of classical Athens. She analyzes the Athenians' preference in most cases for ad hoc, discretionary decision-making, as opposed to what moderns would call the rule of law. Lanni argues that the Athenians consciously employed different approaches to legal decision-making in different types of courts. The varied approaches to legal process stems from a deep tension in Athenian practice and thinking, between the demand for flexibility of legal interpretation consistent with the exercise of democratic power by ordinary Athenian jurors; and the demand for consistency and predictability in legal interpretation expected by litigants and necessary to permit citizens to conform their conduct to the law. Lanni presents classical Athens as a case study of a successful legal system that, by modern standards, had an extraordinarily individualized and discretionary approach to justice.

The Law and the Courts in Ancient Greece (Hardcover): Edward Harris, Lene Rubinstein The Law and the Courts in Ancient Greece (Hardcover)
Edward Harris, Lene Rubinstein; Christopher Carey, Angelos Chaniotis, Michael Gagarin, …
R5,145 Discovery Miles 51 450 Ships in 12 - 17 working days

How successful were the Athenians and other Greeks in bringing about the rule of law? What did the Greeks recognize as 'law' both in the polis and internationally? How did the courts attempt to implement this ideal, and how successful were they? This collection of essays sets out to answer these questions, concentrating on the following themes: law, religion and the sources of legitimacy; substance and procedure; legal arguments in court; documents and witnesses; and law in an international context. There is much here to interest not only specialists in Greek law, but also those concerned more generally with both Greek history and the history of law.Contributors include: Christopher Carey, Angelos Chaniotis, Michael Gagarin, Edward Harris, Adriaan Lanni, Frederick Naiden, Robert Parker, Peter Rhodes, Lene Rubinstein, James Sickinger.

Law and Order in Ancient Athens (Paperback): Adriaan Lanni Law and Order in Ancient Athens (Paperback)
Adriaan Lanni
R744 Discovery Miles 7 440 Ships in 12 - 17 working days

The classical Athenian 'state' had almost no formal coercive apparatus to ensure order or compliance with law: there was no professional police force or public prosecutor, and nearly every step in the legal process depended on private initiative. And yet Athens was a remarkably peaceful and well-ordered society by both ancient and contemporary standards. Why? Law and Order in Ancient Athens draws on contemporary legal scholarship to explore how order was maintained in Athens. Lanni argues that law and formal legal institutions played a greater role in maintaining order than is generally acknowledged. The legal system did encourage compliance with law, but not through the familiar deterrence mechanism of imposing sanctions for violating statutes. Lanni shows how formal institutions facilitated the operation of informal social control in a society that was too large and diverse to be characterized as a 'face-to-face community' or 'close-knit group'.
