Property is a constitutionally protected right around the world. Expropriations are lawful only if they can be legitimately justified. In the past few decades, there has been an increasing number of expropriations in favour of private business projects. Governments hope that these projects will create jobs and economic growth, but the justification of such third-party transfers for economic development is controversial. The public benefits of such expropriations are disputed, since they directly benefit private parties, and frequently do not have the desired outcome. The Legitimate Justification of Expropriation: A Comparative Law and Governance Analysis investigates the institutional, procedural, and substantive conditions under which different jurisdictions permit third-party transfers for economic development. The jurisdictions examined are the Netherlands, Germany, New York State and South Africa. The Legitimate Justification of Expropriation: A Comparative Law and Governance Analysis shows that employment or economic growth created by private business projects is a legitimate end in all the jurisdictions under examination. However, some striking differences between the jurisdictions are evident, with respect to several questions, including: Which state body decides on whether economic development is a legitimate end? Can a judge prevent unnecessary or excessive expropriations? Is the project developer obliged to implement the project? Against the backdrop of international good governance standards, The Legitimate Justification of Expropriation: A Comparative Law and Governance Analysis assesses whether the laws in these jurisdictions are adequate. The book demonstrates that the examined jurisdictions in various respects fail to meet international standards and recommends legal reforms to ensure compliance.

Based on empirical studies and criminological essays, this paper shall find out if this is actually true. It shall be examined if there is a direct connection between unemployment and delinquency, focusing on the individuals and the question if unemployment causes them to commit a crime. To become acquainted with the origins of delinquency and the situation of unemployed individuals, the work of Hirschi and the report of Kruger and Amelang, which contain essential information, have been of great importance. To gather empirical evidence for a connection, criminal statistics and other empirical studies shall be examined at first. Afterwards, the consequences of unemployment and the causes of delinquency shall be described. Eventually it shall be determined if consequences and causes correspond to each other or induce one another. Referring to the results the conclusion will answer the question if there is a link.
Studienarbeit aus dem Jahr 2009 im Fachbereich Jura - Rechtsphilosophie, Rechtssoziologie, Rechtsgeschichte, Note: 1,0, Universitat Bremen (Hanse Law School), Veranstaltung: Europaische Rechtsgeschichte, Sprache: Deutsch, Abstract: Diese Arbeit beschaftigt sich unter Berucksichtigung sozialgeschichtlicher und aussenpolitischer Vorgange mit der Entwicklung des Verhaltnisses von Rat und Gemeinde in Bremen im 15.Jahrhundert. Inwieweit Grundsatze hansisch-niederdeutschen Rechts eingehalten wurden, und wie Reformen der Ratsverfassungen Machtverhaltnisse veranderten oder ihnen Ausdruck verliehen, soll hier untersucht werden. Wahrend meiner Nachforschungen stiess ich auf die Reformen im 14. und 15. Jahrhundert in Bremen, die mich auf Grund ihrer Vielzahl gegensatzlicher Veranderungen fortan fesselten. Schwierigkeiten bei der Bearbeitung der Thematik ergaben sich beim Ubersetzen mittelalterlicher Dokumente aus dem Mittelniederdeutschen. Hilfreich bei der Erstellung dieser Arbeit waren die Chroniken Schwarzwalders und Elmshausers, die tiefgrundig die Ereignisse darstellten. Pitzens Ausfuhrungen zur Entstehung des Stadtrechts von 1433 trugen zu vielen Facetten im Kapitel uber 1433 bei. Stadtrechtskodifikationen und weitere Dokumente befahigten mich, Darstellungen zu hinterfragen und ggf. zu konkretisieren. Diese Arbeit beginnt mit einer Darlegung der Grundsatze des hansischen Stadtrechts. Wichtige sozialgeschichtliche und verfassungspolitische Ereignisse, die das Verhaltnis zwischen Rat und Gemeinde beeinflussten, werden daraufhin umrissen. Nahere Betrachtungen des Verfassungsrechts von 1428 und 1433, sowie von dessen Entstehung munden in einer Beschreibung der Machtverhaltnisse sowie in einer Erorterung uber die Einhaltung der Verfassungsnor
