The Genocide Convention - An International Law Analysis (Paperback): John Quigley The Genocide Convention - An International Law Analysis (Paperback)
John Quigley
R1,603 Discovery Miles 16 030 Ships in 12 - 17 working days

The Genocide Convention explores the question of whether the law and genocide law in particular can prevent mass atrocities. The volume explains how genocide came to be accepted as a legal norm and analyzes the intent required for this categorization. The work also discusses individual suits against states for genocide and, finally, explores the utility of genocide as a legal concept.

The Law of Consular Access - A Documentary Guide (Paperback): John Quigley, William J. Aceves, Adele Shank The Law of Consular Access - A Documentary Guide (Paperback)
John Quigley, William J. Aceves, Adele Shank
R1,425 Discovery Miles 14 250 Ships in 12 - 17 working days

Over the past decade, there has been an explosion of litigation at the international and domestic levels concerning consular access for foreign nationals charged with a criminal offence. The issue has complicated relations between countries, with the majority of litigation involving the United States, which has adopted a restrictive view of the consular access obligation.

This book brings together for the first time relevant documentary sources on the law of consular access. The book includes significant excerpts alongside commentary on the documents, allowing readers to draw their own conclusions. While presenting information on the Vienna Convention on Consular Relations, the book presents other sources, including bilateral consular agreements, multilateral treaties, and key court cases from various jurisdictions. Many of these sources are not readily accessible.

The Law of Consular Access will be of interest to scholars of international law, human rights, and international relations. It will also be of interest to private and government lawyers, as well as diplomats and consuls.

Elicitation - The Science and Art of Structuring Judgement (Hardcover, 1st ed. 2018): Luis C. Dias, Alec Morton, John Quigley Elicitation - The Science and Art of Structuring Judgement (Hardcover, 1st ed. 2018)
Luis C. Dias, Alec Morton, John Quigley
R7,752 Discovery Miles 77 520 Ships in 12 - 17 working days

This book is about elicitation: the facilitation of the quantitative expression of subjective judgement about matters of fact, interacting with subject experts, or about matters of value, interacting with decision makers or stakeholders. It offers an integrated presentation of procedures and processes that allow analysts and experts to think clearly about numbers, particularly the inputs for decision support systems and models. This presentation encompasses research originating in the communities of structured probability elicitation/calibration and multi-criteria decision analysis, often unaware of each other's developments. Chapters 2 through 9 focus on processes to elicit uncertainty from experts, including the Classical Method for aggregating judgements from multiple experts concerning probability distributions; the issue of validation in the Classical Method; the Sheffield elicitation framework; the IDEA protocol; approaches following the Bayesian perspective; the main elements of structured expert processes for dependence elicitation; and how mathematical methods can incorporate correlations between experts. Chapters 10 through 14 focus on processes to elicit preferences from stakeholders or decision makers, including two chapters on problems under uncertainty (utility functions), and three chapters that address elicitation of preferences independently of, or in absence of, any uncertainty elicitation (value functions and ELECTRE). Two chapters then focus on cross-cutting issues for elicitation of uncertainties and elicitation of preferences: biases and selection of experts. Finally, the last group of chapters illustrates how some of the presented approaches are applied in practice, including a food security case in the UK; expert elicitation in health care decision making; an expert judgement based method to elicit nuclear threat risks in US ports; risk assessment in a pulp and paper manufacturer in the Nordic countries; and elicitation of preferences for crop planning in a Greek region.

Howard J. de Nike, John Quigley, Kenneth J. Robinson
R2,785 Discovery Miles 27 850 Ships in 10 - 15 working days

The Khmer Rouge held power in Cambodia from 1975 to 1979 and aggressively pursued a policy of radical social reform that resulted in the deaths of hundreds of thousands of Cambodians through mass executions and physical privation. In January 1979, the government was overthrown by former Khmer Rouge functionaries, with substantial backing from the army of Vietnam. In August of that year a special court, the People's Revolutionary Tribunal, was constituted to try two of the Khmer Rouge government's most powerful leaders, Pol Pot and Ieng Sary. The charge against them was genocide as it was defined in the United Nation's genocide convention of 1948. At the time, both men were in the Cambodian jungle leading the Khmer Rouge in a struggle to regain power; they were, therefore, tried in absentia. "Genocide in Cambodia" assembles documents from this historic trial and contains extensive reports from the People's Revolutionary Tribunal. The book opens with essays that discuss the nature of the primary documents, and places the trial in its historical, legal, and political context. The documents are divided into three parts: those relating to the establishment of the tribunal; those used as evidence, including statements of witnesses, investigative reports of mass grave sites, expert opinions on the social and cultural impact of the actions of Pol Pot and Ieng Sary, and accounts from the foreign press; and finally the record of the trial, beginning with the prosecutor's indictment and ending with the concluding speeches by the attorneys for the defense and prosecution. The trial of Pol Pot and Ieng Sary was the world's first genocide trial based on United Nations's policy as well as the first trial of a head of government on a human rights-related charge. This documentary record is significant for the history of Cambodia, and it will be of the highest importance as well to the international legal and human rights communities. Howard J. De Nike teaches in the Department of Anthropology, San Francisco State University, and was the Director of the Cambodia Law Project at the University of San Francisco School of Law. John Quigley is Professor in the Ohio State University College of Law and Adjunct Professor in the Department of Political Science. Kenneth J. Robinson is an associate at the law firm of Bloomfield and Kempf. Pennsylvania Studies in Human Rights World Rights Law, Political Science

Lynn Margaret Quigley; Foreword by John Quigley

"Spirits Fly High" is the last part and concluding book in a trilogy. As with the other books written by Lynn Quigley, it is a heartfelt recollection of her Spiritual Journey. "Spirits Fly High" is the culmination of the part of her journey at a particular time in her life in which Lynn honours the request made many years earlier by her Spirit guides to share the experience of finding and establishing a loving and timeless awareness and connection with those in Spirit In her first book of the series "More Friends Than You Know," Lynn wrote about the development of her natural communication skills with the world of Spirit. The result was a down to earth, inspirational, moving and frequently humorous story. In reading it, you learned of the method, which Spirit used in training her to work the way she does, getting the amazing communication she gets without any fuss, ritual or drama. In her second book, Lynn continued to share the journey with you, by re-visiting experiences - happy, sad, painful and joyful - from many years of personal memories, bringing to you more of the techniques and communication given by Spirit, in another brilliant and extremely well received book "Spirits In The Sky." And now - for those of you who have read the first two parts of this trilogy - she brings you the conclusion. Part three "Spirits Fly High" is another seamless continuation of the much awaited story which took Lynn to America - her first experience (in the physical world) of flying, visiting another country and the "Highs and Lows" of that trip along with the ensuing emotions and feelings associated with the arrival and departure of her Spirit Guides. For those of you who have not read the previous two books, "Spirits Fly High" can be read as a "stand alone" volume bringing laughter, joy and wonderment tinged with some sadness but always with the love and wisdom that direct communication with Spirit brings. Lynn's books are said by many to be "Life Changing."

Spirits In The Sky (Paperback): Lynn Quigley Spirits In The Sky (Paperback)
Lynn Quigley; Edited by John Quigley
R847 Discovery Miles 8 470 Ships in 10 - 15 working days

Spirits in the Sky is a book absolutely full of communication from Spirit. It's one of a number of books written by Lynn Quigley, who over the years has become well known as, the "Mediums, Medium" - her link with Spirit being so clear and precise that other mediums and healing channels worldwide, seek her out for the clarity and guidance, of her channelled advice. In writing it, Lynn honours a contract she has with Spirit to deliver their message in as direct a way as possible, to those who are ready to hear it, and their message goes far beyond proof of continuance of life after death. Picking up quite literally the day after the previous book ended, the range, spectrum and depth of communication within "Spirits In The Sky" is at times simply, mind blowing. From the four-year-old child telling us, one minute about growing up in the Spirit world, and then asking us the most profound questions about children dying here in the physical world - to the deepest philosophical communication about the nature of our very being and place within the universe - punctuated at times by a visiting Inca Spirit with a grudge against God for "betraying" his people. The range of communication is truly remarkable - the messages, many and varied. In her first book of the series, "More Friends Than You Know," Lynn wrote about the development of her natural communication skills with the world of Spirit. The result was a down to earth, inspirational, moving and frequently humorous story of Lynn the developing medium. The story of a young girl growing up into adulthood with all the joy, happiness, heartache and pain that physical life brought - interspersed within the book was a story of early Spiritualawareness and a totally honest account of the method Spirit used in training Lynn to work the way she does, with her channelling, spirit release/rescue, healing and "day to day" mediumship. "More Friends." was so well received by readers in many countries, the comments and feedback so positive that there is a waiting list for "Spirits In The Sky"

The Legality of a Jewish State - A Century of Debate over Rights in Palestine (Hardcover): John Quigley The Legality of a Jewish State - A Century of Debate over Rights in Palestine (Hardcover)
John Quigley
R3,328 Discovery Miles 33 280 Ships in 10 - 15 working days

In The Legality of a Jewish State, the author traces the diplomatic history that led to the partition of Palestine in 1948 and the creation of Israel as a state. He argues that the fate of Palestine was not determined on the basis of principle, but by the failure of legality. In focusing on the lawyer-diplomats who pressed for and against a Jewish state at the United Nations, he offers an explanation of the effort in 1947-48 by Arab states at the UN to gain a legal opinion from the International Court of Justice about partition and the declaration of a Jewish state. Their arguments at that time may surprise a twenty-first-century reader, touching on issues that are still at the heart of the contemporary conflict in the Middle East.

Foreigners on America's Death Rows (Paperback): John Quigley Foreigners on America's Death Rows (Paperback)
John Quigley
R1,168 Discovery Miles 11 680 Ships in 10 - 15 working days

Capital cases involving foreigners as defendants are a serious source of contention between the United States and foreign governments. By treaty, foreigner defendants must be informed upon arrest that they may contact a consul of their home country for assistance, yet police and judges in the United States are lax in complying. Foreigners on America's Death Row investigates the arbitrary way United States police departments, courts, and the Department of State implement well-established rights of foreigners arrested in the US. Foreign governments have taken the United States into international courts, which have ruled that the US must enforce the treaty. The United States has ignored these rulings. As a result, foreigners continue to be executed after a legal process that their home governments justifiably find to be flawed. When one country ignores the treaty rights of another as well as the decisions of international courts, the established order of international relations is threatened.

The International Diplomacy of Israel's Founders - Deception at the United Nations in the Quest for Palestine (Hardcover):... The International Diplomacy of Israel's Founders - Deception at the United Nations in the Quest for Palestine (Hardcover)
John Quigley
R3,185 Discovery Miles 31 850 Ships in 10 - 15 working days

During the early to mid-twentieth century, the Zionist Organization secured a series of political victories on the international stage, leading to the foundation of a Jewish state and to its ability to expand its territorial control within Palestine. The International Diplomacy of Israel's Founders provides a revisionist account of the founding of Israel by exposing the misrepresentations and false assurances of Zionist diplomats during this formative period of Israeli history. By comparing diplomatic statements at the United Nations and elsewhere against the historical record, it sheds new light on the legacies of such leaders as Chaim Weizmann, David Ben Gurion, Abba Eban, and Shabtai Rosenne. Including coverage of little-discussed moments in early Israeli history, this book offers an important new perspective for anyone interested in the history of the Israeli-Palestinian conflict.

The Six-Day War and Israeli Self-Defense - Questioning the Legal Basis for Preventive War (Hardcover, New): John Quigley The Six-Day War and Israeli Self-Defense - Questioning the Legal Basis for Preventive War (Hardcover, New)
John Quigley
R2,114 Discovery Miles 21 140 Ships in 10 - 15 working days

The war of June 1967 between Israel and Arab states was widely perceived as being forced on Israel to prevent the annihilation of its people by Arab armies hovering on its borders. Documents now declassified by key governments question this view. The UK, USSR, France and the USA all knew that the Arab states were not in attack mode and tried to dissuade Israel from attacking. In later years, this war was held up as a precedent allowing an attack on a state that is expected to attack. It has even been used to justify a pre-emptive assault on a state expected to attack well in the future. Given the lack of evidence that it was waged by Israel in anticipation of an attack by Arab states, the 1967 war can no longer serve as such a precedent. This book seeks to provide a corrective on the June 1967 war.

Soviet Legal Innovation and the Law of the Western World (Paperback): John Quigley Soviet Legal Innovation and the Law of the Western World (Paperback)
John Quigley
R1,277 Discovery Miles 12 770 Ships in 10 - 15 working days

The government of Soviet Russia wrote new laws for Russia that were as revolutionary as its political philosophy. These new laws challenged social relations as they had developed in Europe over centuries. These laws generated intense interest in the West. To some, they were the harbinger of what should be done in the West, hence a source for emulation. To others, they represented a threat to the existing order. Western governments, like that of the Tsar, might be at risk if they held to the old ways. Throughout the twentieth century Western governments remade their legal systems, incorporating an astonishing number of laws that mirrored the new Soviet laws. Western law became radically transformed over the course of the twentieth century, largely in the direction of change that had been charted by the government of Soviet Russia.

John Quigley
R1,001 Discovery Miles 10 010 Ships in 10 - 15 working days

Palestine as a territorial entity has experienced a curious history. Until World War I, Palestine was part of the sprawling Ottoman Empire. After the war, Palestine came under the administration of Great Britain by an arrangement with the League of Nations. In 1948 Israel established itself in part of Palestine's territory, and Egypt and Jordan assumed administration of the remainder. By 1967 Israel took control of the sectors administered by Egypt and Jordan and by 1988 Palestine reasserted itself as a state. Recent years saw the international community acknowledging Palestinian statehood as it promotes the goal of two independent states, Israel and Palestine, co-existing peacefully. This book draws on evidence from the 1924 League of Nations mandate to suggest that Palestine was constituted as a state at that time. Palestine remained a state after 1948, even as its territory underwent permutation, and this book provides a detailed account of how Palestine has been recognized until the present day.
