This is the first book dedicated to clarifying the concept of "foundlings" and how to best prevent their statelessness in light of the object and purpose of Article 2 of the 1961 UN Convention on the Reduction of Statelessness and equivalent nationality law provisions. Among other features, the book defines the terms "foundling," including the maximum age limit of the child to be considered a "foundling"; "unknown parents"; being "found" in a territory; and "proof to the contrary"; as well as the procedural issues such as the appropriate burden and standard of proof. In doing so, the book draws upon a comparative analysis of national legislation on "foundlings" covering 193 states, case law, and precedents in some states as well as international human rights law norms including the best interests of the child. As its conclusion, the book proposes an inclusive model "foundling provision" and a commentary to inform legislative efforts and interpretation of the existing provisions. Its findings are useful not only to state parties to the 1961 Convention but also to non-state parties, particularly in countries lacking systematic civil documentation or experiencing the effects of armed conflicts, migration, trafficking, and displacement.
This thesis describes improvements to and control of the electrical conductance in single-molecule junctions (SMJs), which have potential applications in molecular electronics, with a focus on the bonding between the metal and molecule. In order to improve the electrical conductance, the orbital of the molecule is directly bonded to the metal orbital, because anchoring groups, which were typically used in other studies to bind molecule with metal electrodes, became resistive spacers. Using this direct -binding, the author has successfully demonstrated highly conductive SMJs involving benzene, endohedral metallofullerene Ce@C82, and nitrogen. Subsequently, the author investigated control of the electrical conductance of SMJs using pyrazine. The nitrogen atom in the -conjugated system of pyrazine was expected to function as an anchoring point, and two bonding states were expected. One originates primarily from the orbital, while the other originates primarily from an n state of the nitrogen. Measurements of conductance and dI/dV spectra coupled with theoretical calculations revealed that the pyrazine SMJ has bistable conductance states, in which the pyrazine axis is either tilted or parallel with respect to the junction axis. The bistable states were switched by changing the gap size between the metal electrodes using an external force. Notably, it is difficult to change the electrical properties of bulk-state materials using mechanical force. The findings reveal that the electron transport properties of a SMJ can be controlled by designing a proper metal-molecule interface, which has considerable potential for molecular electronics. Moreover, this thesis will serve as a guideline for every step of SMJ research: design, fabrication, evaluation, and control.
This book reviews the periodic changes in the legal policies of the late-developing ASEAN countries, often known as the CLMV countries (Cambodia, Laos, Myanmar, and Vietnam), in their continuous path toward globalization after the collapse of the socialist bloc. The book also identifies the characteristics of the legal reforms in their present stage guided by the common framework under the ASEAN Economic Community (AEC) moving toward 2025. The first stage is illustrated by the ASEAN-style utilization of foreign investments as reflected in all investment laws and policies of CLMV countries in the 1990s, which featured entry control (as “sticks”) and investment incentives (as “carrots”). Those controls and incentives were the means to induce investors to assume various performance requirements to contribute to industrial policies. The second stage witnessed a shift toward enhanced liberalization as an endeavor toward the WTO accession during the 2000s, as seen in the integrated investment laws that appealed for the national treatment of foreign investors. At the same time, those investment laws emphasized the substantive provisions (e.g., fair and equitable treatment and indirect expropriation) and procedural protections (e.g., provision of Investor–State Dispute Resolution mechanisms) as an appeal for stabilization of the investment climate. The third stage of legal policy, as evidenced by the recent amendments to the investment laws, is newly focused on environmental and social considerations, which seems to be an indispensable response to the increasing social protests against the negative impacts of investment promotion. Simultaneously, the means of administrative controls over investors, established in the first stage, are uniquely utilized for the realization of new goals.
This book investigates radiocesium movement in all major components of forest ecosystems, e.g. the plants, animals, insects, microorganisms, and soils, during the initial stage of contamination after the incident at Fukushima Daiichi Nuclear Power Plant. Most of the work was conducted at a common research site. More specifically, the book examines the contribution of surface uptake by trees in the dynamics of radiocesium during the initial contamination stage; the movement of radiocesium in the form of small organic fragments that are essential to the radiocesium dynamics in forest ecosystems; and the upward movement of radiocesium due to microorganism activity, which promotes the effective decontamination of the forest floor. Lastly, it explains why spiders could be a valuable indicator of the contamination level in forest ecosystems.
