European Sports Law - Collected Papers (Hardcover, Edition.): Stephen Weatherill European Sports Law - Collected Papers (Hardcover, Edition.)
Stephen Weatherill
R1,623 Discovery Miles 16 230 Ships in 10 - 15 working days

An examination of the special character of sport through European law??'s microscope reveals the scope of European trade law??'s adaptability to the particular context in which it is applied. The story of European sports law told through the case law illuminates the way in which European law is exploited by actors as a lever to prise open sometimes long-established organisational patterns. Sport has in recent years become more commercialised and more juridified too. The challenges to its self-regulatory preferences have strengthened and European law plays a significant part in this narrative. It is testimony to the pragmatic and creative approach of the European Commission and the European Court of Justice to the regulation of sport within the Single Market of the European Union, even though there is no specific provision in the EC Treaty giving the EU competence in the field of sport.

Dorota Leczykiewicz, Stephen Weatherill
R2,093 Discovery Miles 20 930 Ships in 9 - 15 working days

This book consists of contributions exploring from different perspectives the 'images' of the consumer in EU law. The images of the consumer form the foundation for various EU policies, more or less directly oriented towards the goal of consumer protection. The purpose of the volume is to establish what visions of the consumer there are in different contexts of EU law, whether they are consistent, and whether EU law's engagement with consumer-related considerations is sincere or merely instrumental to the achievement of other goals. The chapters discuss how consumers should be protected in EU contract, competition, free movement and trade mark law. They reflect on the limits of the consumer empowerment rationale as the basis for EU consumer policy. The chapters look also at the variety of concerns consumers might have, including the cost of goods and services, access to credit, ethical questions of consumption, the challenges of excessive choice and the possibility to influence the content of regulatory measures, and explore the significance of these issues for the EU's legislative and judicial process.

R5,860 Discovery Miles 58 600 Ships in 10 - 15 working days

Better Regulation in EU Contract Law - The Fitness Check and the New Deal for Consumers (Paperback): Esther Van Schagen,... Better Regulation in EU Contract Law - The Fitness Check and the New Deal for Consumers (Paperback)
Esther Van Schagen, Stephen Weatherill
R1,629 Discovery Miles 16 290 Ships in 10 - 15 working days

This book is the first to provide a critical investigation of EU better regulation from the perspective of EU contract law. The Commission's 'New Deal for EU Consumers' is one of the first EU contract law initiatives to implement both the newly revised Better Regulation Guidelines and the newly introduced combined evaluation of multiple Directives in the form of a 'fitness check'. This offers an opportunity to explore difficulties and best practices at a national level, as demonstrated by experience with the EU's Unfair Terms Directive. Both the fitness check and the impact assessment accompanying the New Deal should facilitate critical reflection on the design of EU contract law. This book addresses key questions. Do impact assessments favour business interests at the expense of a high level of consumer protection? Is the evaluation of EU contract law and the analysis in impact assessments in line with scientific standards? Has the fitness check revealed difficulties and success stories with EU measures at national level, and thereby facilitated an in-depth scrutiny of the design of EU contract law? Ultimately, is the potential of better regulation being realised?

General Principles of Law - European and Comparative Perspectives (Paperback): Stefan Vogenauer, Stephen Weatherill General Principles of Law - European and Comparative Perspectives (Paperback)
Stefan Vogenauer, Stephen Weatherill
R1,913 Discovery Miles 19 130 Ships in 10 - 15 working days

Examining general principles of law provides one of the most instructive examples of the intersection between EU law and comparative law. This collection draws on the expertise of high-profile and distinguished scholars to provide a critical examination of this interaction. It shows how general principles of EU law need to be responsive to national laws. In addition, it is clear that the laws of the Member States have no choice but to be responsive to the general principles which are developed through EU law. Viewed through the perspective of proportionality, legal certainty, and fundamental rights, the dynamic relationship between the ingenuity of the Court of Justice, the legislative process and the process of Treaty revision is comprehensively illustrated.

Sybe de Vries, Ulf Bernitz, Stephen Weatherill
R1,880 Discovery Miles 18 800 Ships in 10 - 15 working days

The entry into force of the Treaty of Lisbon in 2009 caused the EU's Charter of Fundamental Rights to be granted binding effect. This raised a host of intriguing questions. Would this transform the EU's commitment to fundamental rights? Should it transform that commitment? How, if at all, can we balance competing rights and principles? (The interaction of the social and the economic spheres offers a particular challenge). How deeply does the EU conception of fundamental rights reach into and bind national law and practice? How deeply does it affect private parties? How much flexibility has been left to the Court in making these interpretative choices? What is the likely effect of another of the reforms achieved by the Lisbon Treaty, the commitment of the EU to accede to the ECHR? This book addresses all of these questions in the light of five years of practice under the Charter as a binding instrument.

The Protection of Fundamental Rights in the EU After Lisbon (Hardcover, New): Sybe de Vries, Ulf Bernitz, Stephen Weatherill The Protection of Fundamental Rights in the EU After Lisbon (Hardcover, New)
Sybe de Vries, Ulf Bernitz, Stephen Weatherill
R3,422 Discovery Miles 34 220 Ships in 10 - 15 working days

The changes made by the Lisbon Treaty suggest that its entry into force in December 2009 marks a new stage in the shaping of the EU's commitment to the protection of fundamental rights. This book's concern is to provide an examination of the several (and interlocking) challenges which the Lisbon reforms present. The book will not only address the fresh and intriguing challenges for the EU as an entity committed to the protection and promotion of fundamental rights presented by developments 'post-Lisbon', but also a number of conundrums about the scope and method of protection of fundamental rights in the EU which existed 'pre-Lisbon' and which endure. The book consists of three parts. The first part is concerned with the safeguarding of fundamental rights in Europe's internal market. The second part of the book is entitled 'The Scope of Fundamental Rights in EU Law' and the chapters discuss the reach of fundamental rights and their horizontal dimension. The last part of this book deals with 'The Constitutional Dimension of Fundamental Rights' analysing the special relationship between the ECJ and the ECtHR and the issue of rights competition between the EU Charter on Fundamental Rights, the European Convention on Human Rights and national rights catalogues.

Oliver on Free Movement of Goods in the European Union - Fifth Edition (Hardcover, Fifth Edition): Peter J. Oliver Oliver on Free Movement of Goods in the European Union - Fifth Edition (Hardcover, Fifth Edition)
Peter J. Oliver; Contributions by Stefan Enchelmaier, Malcolm Jarvis, Angus C Johnston, Sven Norberg, …
R6,816 Discovery Miles 68 160 Ships in 10 - 15 working days

This is a new edition of Peter Oliver's classic work "Free Movement of Goods in the European Community" (now, in the light of the Lisbon Treaty revisions "European Union") which has established itself as one of the leading works of reference on European law for practitioners and academics alike. Indeed, whether advising clients or preparing for teaching there is no European lawyer who can afford not to have a copy of this book close to hand. Concise, precise, and lucid, the book has become the first port of call for anyone seeking answers to questions about the foundations of free movement of goods in the EU. With specialist chapters written by leading academic and practising lawyers, including Peter Oliver himself, this edition has been extensively rewritten to take into account recent judgments from the ECJ, including important cases such as C-110/05 Commission v Italy ('trailers') and C- 142/05 Mickelsson ('jet skis'), both of which relate to restrictions on the use of goods. It also takes account of all the recent European legislation and the impact of the Lisbon Treaty.

The Internal Market as a Legal Concept (Hardcover): Stephen Weatherill The Internal Market as a Legal Concept (Hardcover)
Stephen Weatherill
R3,407 Discovery Miles 34 070 Ships in 10 - 15 working days

What does the 'internal market' mean? The EU is committed to the construction of an internal market, and in this analysis Stephen Weatherill explains that the EU's internal market is an ambiguous legal concept. One may readily suppose that the United Kingdom possesses an internal market. So does Germany, so does France, so does Australia, and Canada, and the United States of America. The European Union aspires to an internal market, but the detailed patterns governing these several internal markets are not uniform; in fact they vary according to the extent to which the constituent units are permitted to pursue different regulatory policies. They vary according to the scope of law-making competence and powers allocated to the central authority. They vary according to the governing institutional (judicial and political) arrangements. The quality and intensity of the regulated environment varies according to the choices made. There is a broad band of possible internal markets, ranging from one that is radically decentralized as a result of a choice in favour of unrestricted inter-jurisdictional competition to, at the other extreme, one that is radically centralized in the sense that law-making competence has been completely stripped away from the constituent units in favour of the central authority. Within that spectrum there is a huge range of options. In this inquiry into the limits and ambiguities of the internal market as a legal concept, Weatherill examines and explains the choices made by the EU and demonstrates what they entail for the shape of the EU's internal market. This book is not about 'Brexit', but it shows that one of the claims commonly made by Brexiteers - that the internal market can be confined merely to a deregulatory exercise in free market economics - has no support whatsoever in either EU constitutional law or in EU legislative and judicial practice.

Law and Values in the European Union (Paperback): Stephen Weatherill Law and Values in the European Union (Paperback)
Stephen Weatherill
R1,802 Discovery Miles 18 020 Ships in 10 - 15 working days

How has European Union developed since its origins in the reconstruction of Europe in the wake of the Second World War, and why has it developed in this fashion? The principal theme of this book maintains that the EU is a site for the management of the interdependence of the States that are its members. A whole host of challenges - from climate change to security to migration to economic reform - can be tackled more effectively through multilateral action than by unilateral State action and the EU has become the principal location for that action in common. In essence, the States of the EU are stronger together than apart. In order to achieve multilateral action and participation, the EU requires its own legal order, comprising a range of legislative competences, political and judicial institutions, and a carefully shaped relationship with national law. In one sense, this legal order represents control over State autonomy yet in another it serves as means to ensure States, acting collectively, can meet the aspirations of their citizens in an interdependent world. The EU, as its power has increased, also needs to address questions of democracy, accountability, respect for fundamental rights and for national and local diversity. It should not be measured against the same benchmarks of legitimacy as a State as it will always fail, but it does need to achieve legitimacy. It needs, in short, values. And its Treaties aspire to grant it values. Does its system of governance, heavily implicated in the conferral of rights on individuals enforceable against the EU and Member States, today in areas far beyond the economy, live up to those aspirations? And can it? That is the terrain mapped by this book.

The Involvement of EU Law in Private Law Relationships (Hardcover, New): Dorota Leczykiewicz, Stephen Weatherill The Involvement of EU Law in Private Law Relationships (Hardcover, New)
Dorota Leczykiewicz, Stephen Weatherill
R5,191 Discovery Miles 51 910 Ships in 10 - 15 working days

The involvement of the EU in regulating private conduct and relationships between individuals is increasing. As a result, EU law affects the scope of private autonomy in ever wider contexts, sparking tensions with fundamental concepts of national private law systems. This volume offers a descriptive and normative account of the involvement of EU law in private law relationships. The recurring theme in the collected papers is the scope of policy objectives which are apt to legitimise the European Union's as yet unsystematic tendency to serve as a source of restrictions of private autonomy. The nature and purpose of the involvement of European Union law in private law relationships is investigated by the authors from both the substantive and the constitutional perspective. The papers look at such sectors regulating private law relationships as consumer law, labour law, competition law, equal treatment law and the law of remedies. While focusing on private law relationships the authors investigate more general concepts of EU law, such as the Internal Market freedoms and general principles of law, and the different modes of ensuring the effective application of EU secondary law.

The Foundations of European Private Law (Hardcover): Roger Brownsword, Hans W. Micklitz, Leone Niglia, Stephen Weatherill The Foundations of European Private Law (Hardcover)
Roger Brownsword, Hans W. Micklitz, Leone Niglia, Stephen Weatherill
R6,796 Discovery Miles 67 960 Ships in 10 - 15 working days

There remains an urgent need for a deeper discussion of the theoretical, political, and federal dimensions of the European codification project. While much valuable work has already been undertaken, the essays in this collection take as their starting point the proposition that further reflection and critical thought will enhance the quality and efficacy of the on-going work of the various codification bodies. The book's papers are written by: prestigious scholars on the foundations of European private law; representatives of the Common Frame of Reference, the Study Group, and the Acquis Group; and those who have not been involved in particular projects, but who have previously commented more distantly on their work - for instance, those belonging to the Trento Group and the Social Justice Group. With these groups' contributions, The Foundations of European Private Law represents the most comprehensive attempt so far to survey the state of the codification project; its theoretical, political, and federal foundations; and the future prospects for enforcement and compliance.

The Regulation of Unfair Commercial Practices under EC Directive 2005/29 - New Rules and New Techniques (Hardcover, New):... The Regulation of Unfair Commercial Practices under EC Directive 2005/29 - New Rules and New Techniques (Hardcover, New)
Stephen Weatherill, Ulf Bernitz
R3,869 Discovery Miles 38 690 Ships in 10 - 15 working days

This book represents the fruit of a conference held in Oxford on March 3, 2006 under the auspices of the Institute of European and Comparative Law in the Oxford University Law Faculty. Directive 2005/29 is an important new measure in the construction of a legal framework apt to promote an integrated economic space in the European Union. It establishes a harmonised regime governing the control of unfair commercial practices. As such it represents an important exercise in the use of new rules and new techniques, and therefore poses new challenges to EU lawyers. The purpose of this book is to inform and to explore the issues raised by the Directive, issues which are of academic and practical interest, in helping to understand the evolution of European consumer law within the broader programme of European market regulation. The intense practical significance of this Directive, which heralds a new regime, is likely to provoke commercial operators to seek to exploit opportunities to pursue practices previously suppressed.

The Harmonisation of European Contract Law - Implications for European Private Laws, Business and Legal Practice (Hardcover,... The Harmonisation of European Contract Law - Implications for European Private Laws, Business and Legal Practice (Hardcover, New)
Stefan Vogenauer, Stephen Weatherill
R4,005 Discovery Miles 40 050 Ships in 10 - 15 working days

After an extended period in which the European Community has merely nibbled at the edges of national contract law, the bite of a 'European contract law' has lately become more pronounced. Many areas of law, from competition and consumer law to gender equality law, are now the subject of determined efforts at harmonisation, though they are perhaps often seen as peripheral to mainstream commercial contract law. Despite continuing doubts about the constitutional competence of the Commission to embark on further harmonisation in this area, European contract law is now taking shape with the Commission prompting a debate about what it might attempt. A central aspect of this book is the report of a remarkable survey carried out by the Oxford Institute of European and Comparative Law in collaboration with Clifford Chance, which sought the views of European businesses about the advantages and disadvantages of further harmonisation. The final report of this survey brings much needed empirical data to a debate that has thus far lacked clear evidence of this sort. The survey is embedded in a range of original and up-to-date essays by leading European contract scholars reviewing recent developments, questioning progress so far and suggesting areas where further analysis and research will be required

The Role of Regions and Sub-National Actors in Europe (Hardcover, New): Stephen Weatherill, Ulf Bernitz The Role of Regions and Sub-National Actors in Europe (Hardcover, New)
Stephen Weatherill, Ulf Bernitz
R3,830 Discovery Miles 38 300 Ships in 10 - 15 working days

The essays gathered in this collection examine the involvement of self-governing sub-national and regional actors in the law and policy-making of the European Union. State power is today exercised in the context of the complex institutional environment of the EU. But what of regions and sub-national actors? Are their interests adequately represented; can they advance them or can they,at least, protect them from unwitting or calculated damage? This book surveys the broad questions of law and political science and investigates the contribution of the EU's Committee of the Regions and also 'bottom-up' initiatives launched by the regions themselves. Given that much regional autonomy has been hard won, one would suppose that the centralising influence flowing from the EU's intrusion into the domestic settlement would be treated with extreme caution by the regions. Moreover, among the Member States there is great diversity in the patterns of political organisation adopted to cope with the tension between the centralisation of power and respect for local autonomy. Case studies including Spain, Germany and Finland reveal that there is no single consistent historical narrative. States change, as the UK's recent experience illustrates. The book offers findings that are interesting at a general level in investigating patterns of multi-level governance, but is also rich in case-specific information.

E-Commerce Law - National and Transnational Topics and Perspectives (Hardcover): Henk J. Snijders, Stephen Weatherill E-Commerce Law - National and Transnational Topics and Perspectives (Hardcover)
Henk J. Snijders, Stephen Weatherill
R4,163 Discovery Miles 41 630 Ships in 10 - 15 working days

To the contention that the advent of electronic commerce demands a near-complete jettisoning of existing laws affecting business transactions, the authors of the essays in this book answer: not so. Rather, the resolution to the challenge lies in the combination of existing legal elements from heretofore disparate disciplines, and the creation from these elements of a new field of legal principle and practice, a field that will nonetheless overlap with classical commercial law. Perhaps the most significant feature of this emerging body of law is that it is necessarily transnational, as e-commerce cannot be contained within national borders. Although there is a general consensus that "what holds off line, holds on line", there are circumstances that give rise to legal issues peculiar to the information technology environment. These essays deal with some of these issues and other relevant matters, including the following: the country-of-origin principle in EU law; variations in national implementations of the European Directive on electronic signatures; civil liability of Internet service providers; negligence, damage, defective products, culpable wrongdoing and other tort issues in an on-line context; defining the moment of effectiveness of an e-mail notice; "good faith and fair dealing" on-line; the Internet as a zone of "socially responsible spontaneity"; protection of databases - how much is too much?; international private law issues in business-to-consumer disputes; and redefining the separate realms of litigation, legal advice and rule-making as e-commerce grows in the years to come. This book elaborates and updates a staff exchange that took place in 2001 among legal scholars from the Universities of Oxford and Leiden. Its insights represent some of the best-informed thinking on the legal aspects of this all-pervasive feature of contemporary society.
