Routledge Handbook of Freedom of Religion or Belief (Hardcover): Silvio Ferrari, Mark Hill Qc, Arif A. Jamal, Rossella Bottoni Routledge Handbook of Freedom of Religion or Belief (Hardcover)
Silvio Ferrari, Mark Hill Qc, Arif A. Jamal, Rossella Bottoni
R6,337 Discovery Miles 63 370 Ships in 10 - 15 working days

Freedom of religion is an issue of universal interest and scope. However, in the last two centuries at least, the philosophical, religious and legal terms of the question have been largely defined in the West. In an increasingly global world, widening our knowledge of this right's roots in different cultural and legal systems becomes a priority. This Handbook seeks to attain this goal through a better understanding of the historical roots and expressions of the right to freedom of religion on the one hand and, on the other, of its theological background in different religious traditions. History and theology provide the setting for the analysis of the politics of freedom of religion, that is, how this right is used in the context of the dialogue/confrontation between countries placed in different cultural regions of the world, and of the legal strategies and tools that have been developed and are employed to protect and foster the right to freedom of religion. Behind these legal and political strategies, there is an ongoing debate about the nature of this right, whose main features are explored in the final section. Global, historical and interdisciplinary in approach, this book studies the new relevance of freedom of religion worldwide and develops suitable categories to analyze and understand the role that freedom of religion can play in managing religious and cultural diversity in our societies. Authored by experts, through the contributions collected in these chapters, scholars and students will be able to broaden and deepen their knowledge of the right to freedom of religion and to develop the ability to go beyond the borders of the different cultural environments in which this right took shape and developed.

Leading Works in Law and Social Justice (Hardcover): Faith Gordon, Daniel Newman Leading Works in Law and Social Justice (Hardcover)
Faith Gordon, Daniel Newman
R4,222 Discovery Miles 42 220 Ships in 10 - 15 working days

This book assesses the role of social justice in legal scholarship and its potential future development by focusing upon the 'leading works' of the discipline. The rise of socio-legal studies over recent decades has led to a more interdisciplinary approach to the study of law, which prioritises placing law into its wider social context. Recognising the role that culture, economics and politics play in the development of law is important in order to fully understand the position and impact of law in society. Innovative and written in an engaging way, this collection includes leading and emerging scholars from across the world. Each contributor has been invited to select and analyse a 'leading work', a publication which has for them shed light on the way that law and social justice are interlinked and has influenced their own understanding, scholarship, advocacy, and, in some instances, activism. The book also includes a specially written foreword and afterword, which critically reflect upon the contributions of the 'leading works' to consider the role that social justice has played in law and legal education and the likely future path for social justice in legal scholarship. This book will be an essential resource for all those working in the areas of social justice, socio-legal studies and legal philosophy. It will be of wider interest to the social sciences more generally.

Peace, Discontent and Constitutional Law - Challenges to Constitutional Order and Democracy (Hardcover): Martin Belov Peace, Discontent and Constitutional Law - Challenges to Constitutional Order and Democracy (Hardcover)
Martin Belov
R4,221 Discovery Miles 42 210 Ships in 10 - 15 working days

This book offers a multi-discursive analysis of the constitutional foundations for peaceful coexistence, the constitutional background for discontent and the impact of discontent, and the consequences of conflict and revolution on the constitutional order of a democratic society which may lead to its implosion. It explores the capacity of the constitutional order to serve as a reliable framework for peaceful co-existence while allowing for reasonable and legitimate discontent. It outlines the main factors contributing to rising pressure on constitutional order which may produce an implosion of constitutionalism and constitutional democracy as we have come to know it. The collection presents a wide range of views on the ongoing implosion of the liberal-democratic constitutional consensus which predetermined the constitutional axiology, the institutional design, the constitutional mythology and the functioning of the constitutional orders since the last decades of the 20th century. The constitutional perspective is supplemented with perspectives from financial, EU, labour and social security law, administrative law, migration and religious law. Liberal viewpoints encounter radical democratic and critical legal viewpoints. The work thus allows for a plurality of viewpoints, theoretical preferences and thematic discourses offering a pluralist scientific account of the key challenges to peaceful coexistence within the current constitutional framework. The book provides a valuable resource for academics, researchers and policymakers working in the areas of constitutional law and politics.

Pregnant with the Stars - Watching and Wanting the Celebrity Baby Bump (Paperback): Renee Ann Cramer Pregnant with the Stars - Watching and Wanting the Celebrity Baby Bump (Paperback)
Renee Ann Cramer
R674 Discovery Miles 6 740 Ships in 18 - 22 working days

"Check out that baby bump!" Online and print magazines, television shows, and personal blogs are awash with gossip and speculation about pregnant celebrities. What drives our cultural obsession with celebrity baby bumps? Pregnant with the Stars examines the American fascination with, and judgment of, celebrity pregnancy, and exposes how our seemingly innocent interest in "baby bumps" actually reinforces troubling standards about femininity, race, and class, while increasing the surveillance and regulation of all women in our society. This book charts how the American understanding of pregnancy has evolved by examining pop culture coverage of the pregnant celebrity body. Investigating and comparing the media coverage of pregnant celebrities, including Jennifer Garner, Angelina Jolie, Beyonce Knowles, Kristen Bell, M.I.A., Jodie Foster, and Mila Kunis, Renee Cramer shows us how women are categorized and defined by their pregnancies. Their stories provide a paparazzi-sized lens through which we can interpret a complex set of social and legal regulations of pregnant women. Cramer exposes how cultural ideas like the "rockin' post-baby body" are not only unattainable; they are a means of social control. Combining cultural and legal analysis, Pregnant with the Stars uncovers a world where pregnant celebrities are governed and controlled alongside the recent, and troubling, proliferation of restrictive laws aimed at women in the realm of reproductive justice and freedom. Cramer asks each reader and cultural consumer to recognize that the seeing, judging, and discussion of the "baby bump" isn't merely frivolous celebrity gossip-it is an act of surveillance, commodification, and control.

Copyright, Creativity, Big Media and Cultural Value - Incorporating the Author (Hardcover): Kathy Bowrey Copyright, Creativity, Big Media and Cultural Value - Incorporating the Author (Hardcover)
Kathy Bowrey
R4,206 Discovery Miles 42 060 Ships in 10 - 15 working days

As the publishing, film and music industries are dominated by Big Media conglomerates, there is often recourse to simplistic ideological and conspiratorial readings of industry dynamics. Copyright, Creativity, Big Media and Cultural Value: Incorporating the Author explains why copyright is much more than a creator's private property right or a mechanism through which corporations control cultural production and influence mass consumption choices. The volume is grounded in extensive, painstakingly detailed and colourful original archival research into business histories of major successful artists including Conan Doyle, Hall Caine, Margaret Atwood, Dame Nellie Melba, Radiohead and Banksy, and the industries and genres that grew up around their activities. Chapters address big questions about how copyright generates income and how distributions of profits are allocated in the publishing, film and music industries. It includes discussion of the creation of new formats, the interplay between old media and new technologies, international copyright reform and cross-industry relations. Copyright, Creativity, Big Media and Cultural Value is a wide-ranging and important resource for students and practitioners of law and policy, media studies, cultural studies and literary history.

Health Data Privacy under the GDPR - Big Data Challenges and Regulatory Responses (Hardcover): Maria Tzanou Health Data Privacy under the GDPR - Big Data Challenges and Regulatory Responses (Hardcover)
Maria Tzanou
R4,209 Discovery Miles 42 090 Ships in 10 - 15 working days

The growth of data-collecting goods and services, such as ehealth and mhealth apps, smart watches, mobile fitness and dieting apps, electronic skin and ingestible tech, combined with recent technological developments such as increased capacity of data storage, artificial intelligence and smart algorithms, has spawned a big data revolution that has reshaped how we understand and approach health data. Recently the COVID-19 pandemic has foregrounded a variety of data privacy issues. The collection, storage, sharing and analysis of health- related data raises major legal and ethical questions relating to privacy, data protection, profiling, discrimination, surveillance, personal autonomy and dignity. This book examines health privacy questions in light of the General Data Protection Regulation (GDPR) and the general data privacy legal framework of the European Union (EU). The GDPR is a complex and evolving body of law that aims to deal with several technological and societal health data privacy problems, while safeguarding public health interests and addressing its internal gaps and uncertainties. The book answers a diverse range of questions including: What role can the GDPR play in regulating health surveillance and big (health) data analytics? Can it catch up with internet-age developments? Are the solutions to the challenges posed by big health data to be found in the law? Does the GDPR provide adequate tools and mechanisms to ensure public health objectives and the effective protection of privacy? How does the GDPR deal with data that concern children's health and academic research? By analysing a number of diverse questions concerning big health data under the GDPR from various perspectives, this book will appeal to those interested in privacy, data protection, big data, health sciences, information technology, the GDPR, EU and human rights law.

Luhmann and Socio-Legal Research - An Empirical Agenda for Social Systems Theory (Hardcover): Celso Fernandes Campilongo, Lucas... Luhmann and Socio-Legal Research - An Empirical Agenda for Social Systems Theory (Hardcover)
Celso Fernandes Campilongo, Lucas Fucci Amato, Marco Antonio Loschiavo Leme de Barros
R4,634 Discovery Miles 46 340 Ships in 10 - 15 working days

This book discusses the designs and applications of the social systems theory (built by Niklas Luhmann, 1927-1998) in relation to empirical socio-legal studies. This is a sociological and legal theory known for its highly complex and abstract conceptual apparatus. But how to change its scale in order to study more localised phenomena, and to deal with empirical data, such as case law, statutes, constitutions and regulation? This is the concern of a wide variety of scholars from many regions engaged in this volume. It focuses on methodological discussions and empirical examples concerning the innovations and potentials that functional and systemic approaches can bring to the study of legal phenomena (institutions building, argumentation and dispute-settlement), in the interface with economy and regulation, and with politics and public policies. It also discusses connections and contrasts with other jurisprudential approaches - for instance, with critical theory, law and economics, and traditional empirical research in law. Two decades after Luhmann's death, the 21st century has brought countless transformations in technologies and institutions. These changes, resulting in a hyper-connected, ultra-interactive world society bring operational and reflective challenges to the functional systems of law, politics and economy, to social movements and protests, and to major organisational systems, such as courts and enterprises, parliaments and public administration. Pursuing an empirical approach, this book details the variable forms by which systems construct their own structures and semantics and 'irritate' each other. Engaging Luhmann's theoretical apparatus with empirical research in law, this book will be of interest to students and researchers in the field of socio-legal studies, the sociology of law, legal history and jurisprudence.

The New Civil Rights Research - A Constitutive Approach (Paperback): Laura Beth Nielsen The New Civil Rights Research - A Constitutive Approach (Paperback)
Laura Beth Nielsen
R512 Discovery Miles 5 120 Ships in 10 - 15 working days

First published in 2006, this book brings together some of the most innovative and important research on civil rights law and legality, this book draws on narratives of individuals from a variety of contexts to provide a rich and contextualized understanding of what happens when law interacts with other competing systems or forms of social organization. By privileging the real world experiences of those most influenced by rights, the collection moves beyond the traditional polarizing debates and presents a constitutive approach to rights that is not reducible to a simple 'for or against' rights formula. While this complex consciousness approach often contributes to the reproduction of dominant-subordinate social relations, it also allows for spaces of resisting existing hierarchical structures embedded in various law-related sites.

Beyond Clinical Dehumanisation towards the Other in Community Mental Health Care - Levinas, Wonder and Autoethnography... Beyond Clinical Dehumanisation towards the Other in Community Mental Health Care - Levinas, Wonder and Autoethnography (Hardcover)
Catherine A. Racine
R4,345 Discovery Miles 43 450 Ships in 10 - 15 working days

Beyond Clinical Dehumanisation Toward the Other in Community Mental Health Care offers a rare and intimate portrayal of the moral process of a mental health clinician that interrogates the intractable problem of systemic dehumanisation in community mental health care and looks to the notion of "wonder" and the visionary relational ethics of Emmanuel Levinas for a possible cure. An interdisciplinary study with transdisciplinary aspirations, this book contributes an original and compelling voice to the emerging therapeutic conversation attempting to re-imagine and transcend the objectifying constraints of the dominant discourse and the reductive world view that drives it. Chapters bring into dialogue the fields of community mental health care, psychology, psychology and the Other, the philosophy of wonder, Levinasian ethics, clinical ethics, the moral research of autoethnography and the medical humanities, to consider the defilement of the vulnerable help seeker, the moral injury of the clinician and look for answers beyond. This book is an ethical primer for mental health professionals, researchers, educators, advocates and service users working to re-imagine and heal a broken system by challenging the underpinnings of entrenched dehumanisation and standing with those they "serve".

Capacity Assessment and the Law - Problems and Solutions (Hardcover, 1st ed. 2017): Kelly Purser Capacity Assessment and the Law - Problems and Solutions (Hardcover, 1st ed. 2017)
Kelly Purser
R3,337 Discovery Miles 33 370 Ships in 18 - 22 working days

This book discusses theoretical issues, standards, and professional considerations arising when legal and health practitioners undertake legal capacity assessments in the context of wills, enduring powers of attorney and advance health directives. The potential loss of cognition can erode autonomy as individuals lose the ability to make their own legally recognised decisions. This is an inescapable problem with significant legal, social, health and policy repercussions. This work synthesises and critically analyses the existing literature, including some of the best assessment models and guiding principles internationally, to generate a new methodology and understanding of what capacity assessment best practice means. This includes the impact of assessments on individual autonomy - the ideal method building upon respect for both autonomy as well as fundamental human rights. The triggers to assess capacity, who to involve in the assessment process, as well as how to conduct that assessment process are discussed. The crucial relationship between the legal and health professionals involved in assessments, including growing concerns around practitioner liability, is also explored. This analysis is undertaken through the innovative use of a therapeutic jurisprudence lens, the effect of which is to contribute new knowledge to this complex field.

Injury Illustrated - How Medical Images Win Legal Cases (Hardcover): R. Gough Injury Illustrated - How Medical Images Win Legal Cases (Hardcover)
R. Gough
R4,225 Discovery Miles 42 250 Ships in 10 - 15 working days

The best storytellers and presenters know that a picture is worth a thousand words. Pictures simplify stories. They make stories memorable. They clarify complex concepts and they educate the audience in the easiest way. That is why attorneys work with artists-medical illustrators, to be exact. Injury Illustrated is the first book of its kind. It is the essential guide on medical illustrations used in the legal context. This book examines the creation of visual graphics known as demonstrative exhibits. These exhibits provide an understanding of traumatic injuries, surgeries, and radiology studies for the jury, judges, adjustors, mediators, and the attorneys. These chapters describe how to tell a clear story about gross anatomy, medical malpractice, and/or death investigation in court by using medical images. While medical illustration and injury law are very different professions, illustrators are the ideal partners for lawyers when solving problems and preparing for litigation. Divided into five sections, this book details who medical illustrators are, how they are educated in medicine, the skills and services they can provide to trial lawyers, and the countless benefits resulting from record review and case preparation. Find techniques to best use medical images during all stages of litigation Learn how graphic exhibits engage a jury and empower justice Understand why attorneys win more cases by collaborating with medical illustrators All readers will learn about this unique career and the attorney-illustrator relationship. More specifically, attorneys, artists, animators, law students, medical students, forensic scientists, and medical experts will understand how demonstrative exhibits assist legal proceedings in forensic matters and civil lawsuits. Warning; these images will be graphic and the cases at times will be catastrophic.

Exploring Sport and Leisure Disasters - A Socio-Legal Perspective (Paperback): Hazel J Hartley Exploring Sport and Leisure Disasters - A Socio-Legal Perspective (Paperback)
Hazel J Hartley
R1,128 Discovery Miles 11 280 Ships in 10 - 15 working days

First published in 2001. This book provides a socio-legal analysis of disasters by setting out two sport and leisure disasters (the 1989 Hillsborough and Marchioness disasters) and considering them in their broader legal/political/economic and policy contexts. It bases the analysis on in-depth examinations of the legal responses to these disasters. The foundations for the case studies are laid by reviewing critiques of relevant contemporary legal problems. These include the concepts and contexts of disasters; the law in a liberal democracy; negligence, mass actions and policy in PTSD cases; statutory regulation of and safety; the laws of corporate reckless manslaughter and the contemporary legal problems of inquests and public inquiries into disasters. The theoretical and policy chapters are followed by the presentation of the two case study disasters, drawing on documentary sources and interviews with academics, policy makers, key legal practitioners and campaigners for legal reform, involved in these post-disaster legal processes. The analysis returns to the critical themes of the earlier chapters and ends with conclusions and recommendations for further research and legal reform arising out of this area of 'disaster law'. Students in sport and leisure courses will be required to tackle legal and ethical issues. Law modules and courses in sport and law are developing an increasingly socio-legal, if not multi-disciplinary approach. This book takes account of this, taking a critical, multi-disciplinary approach to sport, leisure and the law. However, it will be useful to a broader group of readers who study, practice or work in the law or legal reform and apply their work to disasters.

Terrorist Profiling and Law Enforcement - Detection, Prevention, Deterrence (Hardcover): Noel McGuirk Terrorist Profiling and Law Enforcement - Detection, Prevention, Deterrence (Hardcover)
Noel McGuirk
R4,634 Discovery Miles 46 340 Ships in 10 - 15 working days

This book analyses the usefulness of terrorist profiling utilised by law enforcement officers as a pre-emptive means to assist them in the detection, prevention and deterrence of terrorism and/or its preparatory activities. It explores two main themes arising from the phenomenon of terrorist profiling: the lawfulness of terrorist profiling and the utility of profiling. These two themes are explored in three separate parts. Firstly, the book begins by drawing upon human rights concerns arising from the use of terrorist profiling by law enforcement officers. Secondly, an analytical framework capable of making determinations on the usefulness of terrorist profiling. This framework develops a profiling spectrum that ranges from formal and informal manifestations of terrorist profiling that forms the basis for evaluating its usefulness. Finally, the book presents an examination of various manifestations of terrorist profiling by separating the analysis of the 'construction' of profiles on the one hand, from their 'application,' on the other, so as to be able to identify and examine profiling's usefulness as a technique to assist law enforcement officers make predictions about likely offender characteristics. This book ultimately concludes that terrorist profiling should only be conducted by undertaking a systematic assessment of the construction of profiles separate from the application of profiles whilst simultaneously taking into account fundamental human rights concerns with the practice of terrorist profiling. The work will be an essential resource for academics, law enforcement officers and lawyers in the disciplines of law, criminology, human rights, criminal justice and policing. As the book engages with terrorist profiling, it will also be of interest to those engaged in the psychology of terrorism.

Revitalizing Victimization Theory - Revisions, Applications, and New DirectionsAdvances in Criminological Theory Volume 27... Revitalizing Victimization Theory - Revisions, Applications, and New DirectionsAdvances in Criminological Theory Volume 27 (Hardcover)
Travis C Pratt, Jillian J Turanovic
R4,216 Discovery Miles 42 160 Ships in 10 - 15 working days

Revitalizing Victimization Theory: Revisions, Applications, and New Directions revises some of the major perspectives in victimization theory, applies theoretical perspectives to the victimization of vulnerable populations, and carves out new theoretical territory that is clearly needed but has yet to be developed. With the exception of a handful of isolated works in the mid-twentieth century, theory and research on victimization did not come into its own until the late 1970s with the articulation of lifestyle and routine activity theories. Research conducted within this tradition continues to be an important part of the overall criminological enterprise, and a large body of empirical knowledge has been generated. Nevertheless, theoretical advances in the study of victimization have largely stalled within the field of criminology. Indeed, little in the way of new theoretical headway has been made in well over a decade. This is an ideal time to revitalize victimization theory, and this volume does just that. It is an ambitious project that will hopefully reignite the kinds of theoretical discussions that once held the attention of the field. The work included here will shape the future of victimization theory and research in years to come. This volume should be of interest to a wide range of criminologists and have the potential to be used in graduate seminars and upper-level undergraduate courses.

Transitional Justice, Corporate Accountability and Socio-Economic Rights - Lessons from Argentina (Paperback): Laura Garcia... Transitional Justice, Corporate Accountability and Socio-Economic Rights - Lessons from Argentina (Paperback)
Laura Garcia Martin
R1,347 Discovery Miles 13 470 Ships in 10 - 15 working days

This book explores the intersection of two emergent and vibrant fields of study in international human rights law: transitional justice and corporate accountability for human rights abuses. While both have received significant academic and political attention, the potential links between them remain largely unexplored. This book addresses the normative question of how international human rights law should deal with corporate accountability and violations of economic, social and cultural rights in transitional justice processes. Drawing on the Argentinian transitional justice process, the book outlines the theoretical and practical challenges of including corporate accountability in transitional justice processes through existing mechanisms. Offering specific insights about how to deal with those challenges, it argues that consideration of the role of all actors, and the whole spectrum of human rights violated, is crucial to properly address the root causes of violence and conflict as well as to contribute to a sustainable and positive peace. This interdisciplinary book will be of interest to students and scholars of transitional justice, human rights law, corporate law and international law.

Taxing Democracy - Understanding Tax Avoidance and Evasion (Paperback): Valerie Braithwaite Taxing Democracy - Understanding Tax Avoidance and Evasion (Paperback)
Valerie Braithwaite
R1,672 Discovery Miles 16 720 Ships in 9 - 17 working days

The integrity of tax systems as we know them are being challenged throughout the world. Tax avoidance schemes of various kinds are proving increasingly attractive and lucrative to wealthy individuals and large corporations. As governments fear the erosion of their tax base among those who are most able to contribute, the public is looking on, as one of its most public institutions attempts to re-invent itself through changing laws and administrative procedures. In this book, a number of experts develop the idea of responsive regulation in relation to taxation. They demonstrate how law in this area is undermining social norms and social norms are undermining law. A key factor in their analysis is the perception of justice. Explanations as to why the integrity of tax systems is under siege, and possible solutions, are examined.

Free Speech and Hate Speech in the United States - The Limits of Toleration (Hardcover): Chris Demaske Free Speech and Hate Speech in the United States - The Limits of Toleration (Hardcover)
Chris Demaske
R4,206 Discovery Miles 42 060 Ships in 10 - 15 working days

Free Speech and Hate Speech in the United States explores the concept and treatment of hate speech in light of escalating social tensions in the global twenty-first century, proposing a shift in emphasis from the negative protection of individual rights toward a more positive support of social equality. Drawing on Axel Honneth's theory of recognition, the author develops a two-tiered framework for free speech analysis that will promote a strategy for combating hate speech. To illustrate how this framework might impact speech rights in the U.S., she looks specifically at hate speech in the context of symbolic speech, disparaging speech, internet speech and speech on college campuses. Entering into an ongoing debate about the role of speech in society, this book will be of key importance to First Amendment scholars, and to scholars and students of communication studies, media studies, media law, political science, feminist studies, American studies, and history.

Law, Judges and Visual Culture (Hardcover): Leslie J Moran Law, Judges and Visual Culture (Hardcover)
Leslie J Moran
R4,206 Discovery Miles 42 060 Ships in 10 - 15 working days

Law, Judges and Visual Culture analyses how pictures have been used to make, manage and circulate ideas about the judiciary through a variety of media from the sixteenth century to the present. This book offers a new approach to thinking about and making sense of the important social institution that is the judiciary. In an age in which visual images and celebrity play key roles in the way we produce, communicate and consume ideas about society and its key institutions, this book provides the first in-depth study of visual images of judges in these contexts. It not only examines what appears within the frame of these images; it also explores the impact technologies and the media industries that produce them have upon the way we engage with them, and the experiences and meanings they generate. Drawing upon a wide range of scholarship - including art history, film and television studies, and social and cultural studies, as well as law - and interviews with a variety of practitioners, painters, photographers, television script writers and producers, as well as court communication staff and judges, the book generates new and unique insights into making, managing and viewing pictures of judges. Original and insightful, Law, Judges and Visual Culture will appeal to scholars, postgraduates and undergraduates from a variety of disciplines that hold an interest in the role of visual culture in the production of social justice and its institutions.

Law and Time (Paperback): Emily Grabham, Sian Beynon-Jones Law and Time (Paperback)
Emily Grabham, Sian Beynon-Jones
R1,304 Discovery Miles 13 040 Ships in 10 - 15 working days

Research on law's relationship with time has flourished over the past decade. This edited collection aims to put law and time scholarship into wider context, advancing conversations on time and temporalities between socio-legal scholars, anthropologists, sociologists, geographers and historians. Through a diverse range of contributions, the collection explores how legal modalities of time emerge and have effects within wider clusters of social and political action. Themes include: law's diverse roles in maintaining linear historicist models of time; law's participation in the materialisation of times; and the unsteady effects of temporal pluralism and polytemporalities in law. De-naturalising the 'time' in law and time scholarship, this collection positions time as something that can be enacted and materialised as well as experienced, with distinct implications for questions of social justice.
