The Law of Delict in South Africa, third edition, offers an introduction to the general principles of delictual law. Comprehensive in scope, while clear and concise, the text provides a rich contextual framework which supports understanding and application of the principles.

Features:

  • The text offers a progressive discussion of the law of delict, analysing the extent to which the common law of delict reflects the diverse, multicultural values of South African society, and proposing a framework for continuing, inclusive development of the common law. In addition, the third edition offers a deeper critical discussion of the relationship between common law principles and the Constitution of the Republic of South Africa.
  • The third edition draws critical connections between established principles of delictual law and the rapidly-developing technological context. Discussions, which relate and apply principles to the context of modern technologies, are integrated throughout the text.
Rich Pickings Out Of The Past (Paperback): Bernard Makgabo Ngoepe Rich Pickings Out Of The Past (Paperback)
Bernard Makgabo Ngoepe 1
R373 Discovery Miles 3 730 Ships in 4 - 8 working days

The book selects some past events and experiences, national and international, and wonders what lessons were missed, learnt, or are yet to be learnt from them.

Tragedies happen again and again because we fail to learn from the past. The past is rich with valuable lessons – rich pickings. The reader is taken back into the past in search of some of those lessons, many of which, regrettably, we failed – and continue failing – to learn. As we dig into the past for those rich pickings, there will be moments to laugh, cry or even weep; but that is exactly how lessons are learnt in life.

Other similar incidents learnt from, both abroad and at home, relate to the author’s own experiences in South Africa, including as a Judge who heard amnesty applications as a member of the Amnesty Committee of the Truth and Reconciliation Commission. The book hopes to show that capacity for evil is not peculiar to any nation or race; it also discusses the dangers of tribalism.

The chapter ‘Beyond the Frontiers’ takes the reader into the rest of Africa. A lot is revealed, including divisions the author witnessed – while serving as an AU judge based in Tanzania – within the AU along the languages of, ironically, colonial masters; also referenced is the sorry state of human rights in Africa. Have we seized the opportunity to learn all the valuable lessons which that great teacher, ‘The Past’, offered?

The author leaves it to readers to make their own final judgement after reading the book as to whether, at the individual and collective levels, we have learnt those lessons and taken them to heart for the good of our individual and collective destiny.

Israel Alone (Paperback): Bernard-Henri Levy Israel Alone (Paperback)
Bernard-Henri Levy

Weaving in fifty years of experience with Israel, Bernard-Henri Lévy analyzes global responses to October 7, the new virulent waves of the oldest hatred in the world: anti-Semitism, why Israel is waging this existential war against barbarism alone, and what’s at stake for Israel and the world. Bernard-Henri Lévy’s Israel Alone is a passionate and outraged cri-de-coeur, about the loneliness of Israel and the tragedy of October 7, starting with Lévy’s eyewitness account the day after the pogroms.

On October 8, 2023, Bernard-Henri Lévy flew to Israel to bear witness to the unprecedented invasion and massacre committed by Hamas. Israel Alone begins here and weaves in Lévy’s fifty years on the ground in Israel, from his first trip in 1967, his experiences writing on all the conflicts since, and his participation in various peace plans and contacts with all the Israeli leaders from Menachem Begin to Shimon Peres and from Ariel Sharon to Yitzak Shamir and Yitzak Rabin.

From his unique philosophical and humanist perspective, Lévy analyzes the ultimate evil unleashed on Israel on October 7 and delves into how the Islamic Republic of Iran, Russia, radical Islamist groups, Turkey, and China have played roles and profited from this tragedy. The book addresses how October 7, though historic in scope, became, within weeks, a “detail” in the global consciousness amid a worldwide eruption of anti-Semitism, cloaked in anti-Zionism. Lévy deconstructs the arguments of those calling for a “cease-fire now” without the release of all hostages and of those who demand that October 7 be seen within a greater “context.” Lévy’s meditation on the soul of Zionism and Israel shows why this war is existential, not only for Israel but for the global West.

And yet, despite the urgency and critical nature of this war, Israel takes it on alone.

Lévy analyzes, today, why this is so and why Israel’s solitude is greater than ever.

This book examines the variation found in modern spoken French, based on the research programme 'Phonology of Contemporary French' (Phonologie du Francais Contemporain, PFC). Extensive data are drawn from all over the French-speaking world, including Algeria, Canada, Louisiana, Mauritius, and Switzerland. Although the principal focus is on differences in pronunciation, the authors also analyse the spoken language at all levels from sound to meaning. The book is accompanied by a website hosting audio-visual material for teaching purposes, data, and a variety of tools for working with corpora. The first part of the book outlines some key concepts and approaches to the description of spoken French. Chapters in Part II are devoted to the study of individual samples of spoken French from all over the world, covering phonological and grammatical features as well as lexical and cultural aspects. A class-friendly ready-to-use multimedia version of these 17 chapters as well as a full transcription of each extract is provided, with the sound files also available on the book's companion website. Part III looks at inter and intra-speaker variation: it begins with chapters that provide the methodological background to the study of phonological variation using databases, while in the second section, authors present case studies of a number of PFC survey points, including Paris, the Central African Republic, and Quebec. Varieties of Spoken French will be an invaluable resource for researchers, teachers, and students of all aspects of French language and linguistics.

The Philosophy of Customary Law (Hardcover): James Bernard Murphy The Philosophy of Customary Law (Hardcover)
James Bernard Murphy
R3,080 Discovery Miles 30 800 Ships in 12 - 19 working days

Although many modern philosophers of law describe custom as merely a minor source of law, formal law is actually only one source of the legal customs that govern us. Many laws grow out of custom, and one measure of a law's success is by its creation of an enduring legal custom. Yet custom and customary law have long been neglected topics in unsettled jurisprudential debate. Smaller concerns, such as whether customs can be legitimized by practice or by stipulation, stipulated by an authority or by general consent, or dictated by law or vice versa, lead to broader questions of law and custom as alternative or mutually exclusive modes of social regulation, and whether rational reflection in general ought to replace sub-rational prejudice. Can legal rules function without customary usage, and does custom even matter in society? The Philosophy of Customary Law brings greater theoretical clarity to the often murky topic of custom by showing that custom must be analyzed into two more logically basic concepts: convention and habit. James Bernard Murphy explores the nature and significance of custom and customary law, and how conventions relate to habits in the four classic theories of Aristotle, Francisco Suarez, Jeremy Bentham, and James C. Carter. He establishes that customs are conventional habits and habitual conventions, and allows us to better grasp the many roles that custom plays in a legal system by offering a new foundation of understanding for these concepts.

"Road Traffic Reports" is a series of full length law reports of all reportable decisions in higher courts on road traffic law. Every report in RTR is prepared by a barrister, and can be relied upon for citation as precedent in all courts. Many of the decisons reported are too specialized to appear in a general series. An average of some 100 full length reports is published in each volume, more than 50% of which have not appeared elsewhere.

A coming-of-age story by a master of storytelling on the need to love and cherish life and grab it by the drosky's reins. This is Kops at his most irrepressible and irreverent, vibrant and lyrical and connected - to the present and the past. Seventeen-year-old Sam Glass is depressed. Since his father died suddenly, he sees no point in life especially not among the cosy middle class environs where his love of quoting from classical literature falls on deaf ears. Then a strange figure appears who claims to be a rabbi from the Middle Ages, who takes Sam back in time to the Russia of 1881. He meets a panoply of characters including his own forebears and some familiar figures from Jewish history. Then he discovers the secret purpose for which he has been chosen -- to assassinate Tsar Alexander II ..
