The Nature of the Judicial Process (Hardcover): Benjamin N Cardozo The Nature of the Judicial Process (Hardcover)
Benjamin N Cardozo; Foreword by Andrew L. Kaufman
R742 Discovery Miles 7 420 Ships in 10 - 15 working days

Judges don't just discover the law, they create it. A renowned and much-used analysis of the process of judicial decision-making, now in a library-quality cloth edition with modern formatting and presentation. Includes embedded page numbers from the original 1921 edition for continuity of citations and syllabi. Features a new, explanatory Foreword by Justice Cardozo's premier biographer, Andrew L. Kaufman, senior professor at Harvard Law School and author of "Cardozo" (Harvard Univ. Press, 1998).Justice Benjamin Nathan Cardozo (1870-1938) offered the world a candid and self-conscious study of how judges decide cases and the law - they are lawmakers and not just law-appliers, he knew - all drawn from his insights and experience on the bench in a way that no judge had done before. Asked the basic questions, "What is it that I do when I decide a case? To what sources of information do I appeal for guidance?," Cardozo answered them in his methodical, rich, and timeless prose, explaining the proper use of such decisional tools as logic and analogy to precedent; analysis of history and tradition; application of public policy, community mores, and sociology; and even the subconscious forces that drive judges' decisions. This book has impacted the introspective examination of the lawmaking process of the courts in a way no other book has had. It continues to be read today by lawyers and judges, law students and scholars, historians and political scientists, and philosophers - among others interested in how judges really think and the tools they employ.Judges are people, and lawmakers, too. "The great tides and currents which engulf the rest of men, do not turn aside in their course, and pass the judges by. We like to figure to ourselves the processes of justice as coldly objective and impersonal. The law, conceived of as a real existence, dwelling apart and alone, speaks, through the voices of priests and ministers, the words which they have no choice except to utter. ...It has a lofty sound; it is well and finely said; but it can never be more than partly true." Beyond precedential cases and tradition, judges make choices, using methods of analysis and biases that ought to be examined.Famous at the time for his trenchant and fluid opinions as a Justice on New York's highest court - he is still studied on questions of torts, contracts, and business law - and later a Justice of the U.S. Supreme Court, Cardozo filled the lecture hall at Yale when he finally answered the frank query into what judges do and how do they do it. The lectures became a landmark book and a source for all other studies of the ways of a judge. Brought to a new generation by Professor Kaufman, and presented as part of the properly formatted Legal Legends Series of Quid Pro Books, this edition is the understandable and usable rendition of a classic work of law and politics.

Chemometrics, Volume 2 - A Textbook (Hardcover): S.N. Deming, Y. Michotte, D.L. Massart, L. Kaufman, B.G.M. Vandeginste Chemometrics, Volume 2 - A Textbook (Hardcover)
S.N. Deming, Y. Michotte, D.L. Massart, L. Kaufman, B.G.M. Vandeginste
R4,320 Discovery Miles 43 200 Ships in 12 - 17 working days

Most chemists, whether they are biochemists, organic, analytical, pharmaceutical or clinical chemists and many pharmacists and biologists need to perform chemical analysis. Consequently, they are not only confronted with carrying out the actual analysis, but also with problems such as method selection, experimental design, optimization, calibration, data acquisition and handling, and statistics in order to obtain maximum relevant chemical information. In other words: they are confronted with chemometrics. This book on chemometrics, written by some of the leaders in the field, aims to provide a thorough, up-to-date introduction to this subject. The reader is given the opportunity to acquaint himself with the tools used in this discipline and the way in which they are applied. Some practical examples are given and the reader is shown how to select the appropriate tools in a given situation.

As such the book provides the means to approach and solve analytical problems strategically and systematically, without the need for the reader to become a fully-fledged chemometrician. The authors' aim was to write a tutorial book which would be useful to readers at every level in this field.

Forensic Mental Health Professionals have entered the fray of child custody litigation in ways that could not have been predicted even a decade ago. Traditionally engaged as neutral court appointed evaluators or mediators, or as treatment providers for children, parents or families, FMHPs are assuming a range of consulting functions. Services span a wide range, including providing expert testimony on specific content areas; reviewing and critiquing colleague 's work product; providing behind the scenes consultation to attorneys, and even help attorneys manage difficult cases and clients. These more recent services raise questions about sound professional practice. This volume tackles these thorny issues head on, and discusses questions how consultants can work creatively and ethically to make a positive contribution in the challenging world of family law.

Food and Feast in Modern Outlaw Tales (Hardcover): Alexander L Kaufman, Penny Vlagopoulos Food and Feast in Modern Outlaw Tales (Hardcover)
Alexander L Kaufman, Penny Vlagopoulos
R3,873 Discovery Miles 38 730 Ships in 12 - 17 working days

This collection of scholarly essays presents new work from an emerging line of inquiry: modern outlaw narratives and the textual and cultural relevance of food and feasting. Food, its preparation and its consumption, is presented in outlaw narratives as central points of human interaction, community, conflict, and fellowship. Feast scenes perform a wide variety of functions, serving as cultural repositories of manners and behaviors, catalysts for adventure, or moments of regrouping and redirecting narratives. The book argues that modern outlaw narratives illuminate a potent cross-cultural need for freedom, solidarity, and justice, and it examines ways in which food and feasting are often used to legitimate difference, create discord, and manipulate power dynamics.

The Historical Literature of the Jack Cade Rebellion (Hardcover, New Ed): Alexander L Kaufman The Historical Literature of the Jack Cade Rebellion (Hardcover, New Ed)
Alexander L Kaufman
R4,169 Discovery Miles 41 690 Ships in 12 - 17 working days

Accounts of Jack Cade's 1450 Rebellion-an uprising of some 30,000 middle-class citizens, protesting Henry VI's policies, and resulting in hundreds of deaths as well as the leaders' execution-form the dominant entry in a group of quasi-historical documents referred to as the London chronicles of the Fifteenth Century. However, each chronicle is inherently different and highly subjective. In the first study of the primary documents related to the Cade Rebellion, Alexander L. Kaufman shows that the chroniclers produced multiple representations of the event rather than a single, unified narrative. Aided by contemporary theories of historiography and historical representation, Kaufman scrutinizes the differing representations and distinguishes the writers' objectiveness, their underrated literary skills, and their ideological positions on the rebellion and fifteenth-century politics. He demonstrates how the use of figurative language is related to writing about trauma, and how descriptions of Cade's procession through London are a violent parody of midsummer festivals. In an exploration of authenticity in the descriptions of Cade, Kaufman also examines the characterization and plot devices that push Cade towards the realm of myth, showing that representations of Cade are influenced by popular fifteenth-century stories of Robin Hood.

R2,187 Discovery Miles 21 870 Ships in 12 - 17 working days

Essays on the medieval chronicle tradition, shedding light on history writing, manuscript studies and the history of the book, and the post-medieval reception of such texts. The histories of chronicles composed in England during the fourteenth and fifteenth centuries and onwards, with a focus on texts belonging to or engaging with the Prose Brut tradition, are the focus of this volume. The contributors examine the composition, dissemination and reception of historical texts written in Anglo-Norman, Latin and English, including the Prose Brut chronicle (c. 1300 and later), Castleford's Chronicle (c. 1327),and Nicholas Trevet's Les Cronicles (c. 1334), looking at questions of the processes of writing, rewriting, printing and editing history. They cross traditional boundaries of subject and period, taking multi-disciplinary approaches to their studies in order to underscore the (shifting) historical, social and political contexts in which medieval English chronicles were used and read from the fourteenth century through to the present day. As such, the volume honours the pioneering work of the late Professor Lister M. Matheson, whose research in this area demonstrated that a full understanding of medieval historical literature demands attention to both the content of theworks in question and to the material circumstances of producing those works. Essays on the post-modern reception and interpretation of the Middle Ages, This volume continues the theme of its predecessor, addressing how the Middle Ages have been invoked to score political points, particularly with reference to the rise of populism fueled by recent recessions and a pandemic. The nine essays in the first portion of the volume directly address political medievalism in Tariq Ali's 2005 novel on Mideast instability, A Sultan in Palermo; attempts by twentieth-century Czech politicians to anchor their causes in the fifteenth-century Czech hero Petr Chelcicky; far-right deployment of Robin Hood memes to slander Hillary Rodham Clinton and Barack Obama; the ways Rory Mullarkey's 2017 play Saint George and the Dragon comments onEnglish national identity relative to Brexit; how national stereotypes have come into play amid cross-channel reporting on Brexit; nationalism in the medievalizing German monument to their fallen at the 1942 Battle of El Alamein;the English-speaking world's reception of Anthony Munday's 1589 book on conduct, Palmendos; nationalism in the self-characterization of two contemporary British Pagan movements; and how various communities in the television series Game of Thrones comment on medieval and/or contemporary nations. Nor are politics entirely absent from the final four articles in the volume, as they examine attempts to promote such particular agendas as toxic masculinity in Game of Thrones; misogyno-feminism there and in the George R.R. Martin book series on which the television program is based, A Song of Ice and Fire; the potential for audience self-realization amid the tension between the individual and the collective in The Mere Wife, Maria Dahvana Headley's 2018 adaptation of Beowulf; and ideal individual and collective behavior as modeled in the Ringling Brothers' 1912-13 spectacles about Joan of Arc.

Karl Fugelso; As told to Vincent Ferre, Alicia C. Montoya; Contributions by Alexander L Kaufman, Alicia C. Montoya, …
R2,184 Discovery Miles 21 840 Ships in 12 - 17 working days

Essays on the post-modern reception and interpretation of the middle ages. This volume not only defines medievalism's margins, as well as its role in marginalizing other fields, ideas, people, places, and events, but also provides tools and models for exploring those issues and indicates new subjects towhich they might apply. The eight opening essays address the physical marginalizing of medievalism in annotated texts on medieval studies; the marginalism of oneself via medievalism; medievalism's dearth of ecotheory and religious studies; academia's paucity of pop medievalism; and the marginalization of races, ethnicities, genders, sexual orientations, and literary characters in contemporary medievalism. The seven subsequent articles build on this foundation while discussing: the distancing of oneself (and others) during imaginary visits to the Middle Ages; lessons from the margins of Brazilian medievalism; mutual marginalization among factions of Spanish medieval studies; and medievalism in the marginalization of lower socio-economic classes in late-eighteenth- and early nineteenth-century Spain, of modern gamers, of contemporary laborers, and of Alfred Austin, a late-nineteenth- and early twentieth-century poet also known as Alfred the Little. In thus investigating the margins of and marginalization via medievalism, the volume affirms their centrality to the field. The Art of Grace - On Moving Well Through Life (Hardcover): Sarah L Kaufman The Art of Grace - On Moving Well Through Life (Hardcover)
Sarah L Kaufman
R615 Discovery Miles 6 150 Ships in 12 - 17 working days

We are drawn to smooth, harmonious movement. Both social and physical graces have been taught since the dawn of civilization. Yet grace seems forgotten in our pushy, hectic modern world. Sarah L. Kaufman argues that we should bring it back. She celebrates grace in the way bodies move; exploring how to stand, walk and dress well. She deplores the rarity of grace among public figures and glories in it where found. She singles out grace in sports and in the arts-from tennis and football to sculpture, music and dance-and in the everyday ways people interact, from the grace of a good host to the kindness of strangers. Cary Grant is this book's muse. His ease flowed from training as an acrobat but also from his wit, humility and genuine concern for others. So, Kaufman suggests, we might unearth the potential for grace in ourselves.

"This book is remarkable in its accessible treatment of interaction effects. Although this concept can be challenging for students (even those with some background in statistics), this book presents the material in a very accessible manner, with plenty of examples to help the reader understand how to interpret their results." -Nicole Kalaf-Hughes, Bowling Green State University Offering a clear set of workable examples with data and explanations, Interaction Effects in Linear and Generalized Linear Models is a comprehensive and accessible text that provides a unified approach to interpreting interaction effects. The book develops the statistical basis for the general principles of interpretive tools and applies them to a variety of examples, introduces the ICALC Toolkit for Stata, and offers a series of start-to-finish application examples to show students how to interpret interaction effects for a variety of different techniques of analysis, beginning with OLS regression. The author's website provides a downloadable toolkit of Stata (R) routines to produce the calculations, tables, and graphics for each interpretive tool discussed. Also available are the Stata (R) dataset files to run the examples in the book.
