Volume XXIX/1 of History of Universities contains the customary mix of learned articles and book reviews which makes this publication such an indispensable tool for the historian of higher education. The volume is, as always, a lively combination of original research and invaluable reference material.
This volume explores Rome's northern provinces through the portable artefacts people used and left behind. Objects are crucial to our understanding of the past, and can be used to explore interlinking aspects of identity. For example, can we identify incomers? How are exotic materials (such as amber and ivory) and objects depicting 'the exotic' (e.g. Africans) consumed? Do regional styles exist below the homogenizing influence of Roman trade? How do all these aspects of identity interact with others, such as status, gender, and age? In this innovative study, the author combines theoretical awareness and a willingness to engage with questions of social and cultural identity with a thorough investigation into the well-published but underused material culture of Rome's northern provinces. Pottery and coins, the dominant categories of many other studies, have here been largely excluded in favour of small portable objects such as items of personal adornment, amulets, and writing equipment. The case studies included were chosen because they relate to specific, often interlinking aspects of identity such as provincial, elite, regional, or religious identity. Their meaning is explored in their own right and in depth, and in careful examination of their contexts. It is hoped that these case studies will be of use to archaeologists working in other periods, and indeed to students of material culture generally by making a small contribution to a growing corpus of academic and popular books that develop interpretative, historical narratives from selected objects.
Tense Future falls into two parts. The first develops a critical account of total war discourse and addresses the resistant potential of acts, including acts of writing, before a future that looks barred or predetermined by war. Part two shifts the focus to long interwar narratives that pit both their scale and their formal turbulence against total war's portrait of the social totality, producing both ripostes and alternatives to that portrait in the practice of literary encyclopedism. The book's introduction grounds both parts in the claim that industrialized warfare, particularly the aerial bombing of cities, intensifies an under-examined form of collective traumatization: a pretraumatic syndrome in which the anticipation of future-conditional violence induces psychic wounds. Situating this claim in relation to other scholarship on "critical futurities," Saint-Amour discusses its ramifications for trauma studies, historical narratives generally, and the historiography of the interwar period in particular. The introduction ends with an account of the weak theory of modernism now structuring the field of modernist studies, and of weak theory's special suitability for opposing total war, that strongest of strong theories.

Medieval Rome analyses the history of the city of Rome between 900 and 1150, a period of major change in the city. This volume doesn't merely seek to tell the story of the city from the traditional Church standpoint; instead, it engages in studies of the city's processions, material culture, legal transformations, and sense of the past, seeking to unravel the complexities of Roman cultural identity, including its urban economy, social history as seen across the different strata of society, and the articulation between the city's regions. Gifts are always with us: we use them positively to display affection and show gratitude for favours; we suspect that others give and accept them as douceurs and bribes. The gift also performed these roles in early modern English culture: and assumed a more significant role because networks of informal support and patronage were central to social and political behaviour. Favours, and their proper acknowledgement, were preoccupations of the age of Erasmus, Shakespeare, and Hobbes. As in modern society, giving and receiving was complex and full of the potential for social damage. 'Almost nothing', men of the Renaissance learned from that great classical guide to morality, Lucius Annaeus Seneca, 'is more disgraceful than the fact that we do not know how either to give or receive benefits'. The Power of Gifts is about those gifts and benefits - what they were, and how they were offered and received in the sixteenth and seventeenth centuries. It shows that the mode of giving, as well as what was given, was crucial to social bonding and political success. The volume moves from a general consideration of the nature of the gift to an exploration of the politics of giving. In the latter chapters some of the well-known rituals of English court life - the New Year ceremony, royal progresses, diplomatic missions - are viewed through the prism of gift-exchange. Gifts to monarchs or their ministers could focus attention on the donor, those from the crown could offer some assurance of favour. These fundamentals remained the same throughout the century and a half before the Civil War, but the attitude of individual monarchs altered specific behaviour. Elizabeth expected to be wooed with gifts and dispensed benefits largely for service rendered, James I modelled giving as the largesse of the Renaissance prince, Charles I's gift-exchanges focused on the art collecting of his coterie. And always in both politics and the law courts there was the danger that gifts would be corroded, morphing from acceptable behaviour into bribes and corruption. The Power of Gifts explores prescriptive literature, pamphlets, correspondence, legal cases and financial records, to illuminate social attitudes and behaviour through a rich series of examples and case-studies.

Vincent de Paul, the Lazarist Mission, and French Catholic Reform offers a major re-assessment of the thought and activities of the most famous figure of the seventeenth-century French Catholic Reformation, Vincent de Paul. Confronting traditional explanations for de Paul's prominence in the devot reform movement that emerged in the wake of the Wars of Religion, the volume explores how he turned a personal vocational desire to evangelize the rural poor of France into a congregation of secular missionaries, known as the Congregation of the Mission or the Lazarists, with three inter-related strands of pastoral responsibility: the delivery of missions, the formation and training of clergy, and the promotion of confraternal welfare. Alison Forrestal further demonstrates that the structure, ethos, and works that de Paul devised for the Congregation placed it at the heart of a significant enterprise of reform that involved a broad set of associates in efforts to transform the character of devotional belief and practice within the church. The central questions of the volume therefore concern de Paul's efforts to create, characterize, and articulate a distinctive and influential vision for missionary life and work, both for himself and for the Lazarist Congregation, and Forrestal argues that his prominence and achievements depended on his remarkable ability to exploit the potential for association and collaboration within the devot environment of seventeenth-century France in enterprising and systematic ways. This is the first study to assess de Paul's activities against the wider backdrop of religious reform and Bourbon rule, and to reconstruct the combination of ideas, practices, resources, and relationships that determined his ability to pursue his ambitions. What role did visual artists play in the emergence and spread of nationalism and a sense of national identity? Focusing on late-eighteenth and early-nineteenth century Britain and France, this original study in the historical sociology of nations and nationalism analyses the contributions of artists in these and other West European countries to the creation of memorable images of the abstract concept of the nation. By employing different modes of depiction for conveying moral lessons, evoking the atmosphere of the homeland, and commemorating the fallen in battle, David, Ingres, Turner, Constable, and Friedrich, as well as a host of lesser artists, were able to make the national idea appear palpable and accessible, and the abstract concept of the nation seem 'authentic' and 'real'. After a brief description of the main themes of the visual record of Dutch nation-building in the seventeenth century, Anthony D. Smith presents an original comparative analysis of the rise of 'national art' in eighteenth-century Britain and France. Subsequent chapters address the emblems and oath-swearing ceremonies of the citizen nation, the evocation of native poetic landscapes, the exempla virtutis of national heroes, ancient and modern, and the funerary memorials of martyrs and soldiers who sacrificed themselves for the nation in Britain and France. The conclusion highlights the common elements and the main differences in the French and British trajectories of artistic and national development. Illustrated with striking images, The Nation Made Real offers a new interpretation of the role of visual culture in the formation of nations and national identity among the educated classes in Western Europe.
Prussian discipline is legendary. Central to debates about modern German history is the view that an oppressive Prussian state cast a shadow on the development of civil society. In particular, historians have seen the absence of a revolution in the eighteenth century as a symptom of a delayed and incomplete emancipation of the Prussian bourgeoisie. Prussia's urban dwellers have often been portrayed as poor relations of the self-reliant and assertive bourgeois of Western Europe and the Atlantic world. Economically backward and politically oppressed, they were allegedly in no position to challenge the iron grip of the state and question the authority of the Hohenzollern dynasty. Drawing from extensive and original research, Florian Schui challenges the accepted view and argues that Prussians in the eighteenth century were much more willing to challenge the state than has been recognised. Schui explores several instances where urban Prussians successfully resisted government policies and forced Frederick the Great and his successors to give in to their demands. Rebellious Prussians thus sheds light on a little-known historical reality in which weak Hohenzollern monarchs - and a still weaker Prussian bureaucracy - were confronted with prosperous, fearless, argumentative, and occasionally violent Prussian burghers. Such conflicts between state and citizens were by no means unique to Prussia. Rather the events in Prussia were, on many levels, connected to similar contemporary developments in other parts of Europe and North America. Florian Schui systematically explores these links and thus develops a new European and Atlantic perspective on Prussian history in the eighteenth century.
According to the Oral History Association, the term oral history refers to "a method of recording and preserving oral testimony" which results in a verbal document that is "made available in different forms to other users, researchers, and the public." Ordinarily such an academic process would seem to be far removed from legal challenges. Unfortunately this is not the case. While the field has not become a legal minefield, given its tremendous growth and increasing focus on contemporary topics, more legal troubles could well lie ahead if sound procedures are not put in place and periodically revisited. A Guide to Oral History and the Law is the definitive resource for all oral history practitioners. In clear, accessible language it thoroughly explains all of the major legal issues including legal release agreements, the protection of restricted interviews, the privacy torts (including defamation), copyright, the impact of the Internet, and the role of Institutional Review Boards (IRBs). The author accomplishes this by examining the most relevant court cases and citing examples of policies and procedures that oral history programs have used to avoid legal difficulties. Neuenschwander's central focus throughout the book is on prevention rather than litigation. He underscores this approach by strongly emphasizing how close adherence to the Oral History Association's Principles and Best Practices provides the best foundation for developing sound legal policies. The book also provides more than a dozen sample legal release agreements that are applicable to a wide variety of situations. This volume is an essential one for all oral historians regardless of their interviewing focus.
Alexander Murray has long had an intellectual interest in the history of religion - struggling between his inbuilt anti-clericism and his pronounced monastic leanings. The five essays in Conscience and Authority in the Medieval Church take on this dialectic, addressing the difficult relationship between private conscience and public authority in the twelfth and thirteenth centuries. In any organization, political, military, commercial, or religious, the relationship of conscience and authority is always potentially fraught, and can create dilemmas both for those in authority and those without. This volume records how our European predecessors approached and dealt with the same dilemmas as we face in the modern world.
Since the end of the eighteenth century, the insurance industry has
cast a safety net around the world, first in the British Isles and
then further afield, irrespective of cultural, political and
ideological divides. Unlike previous publications on insurance
history, which tend to discuss the development of national markets
or individual companies, this book focuses on the creation of
networks across borders from the end of the eighteenth century to
the present day.
Mainstream historians in recent decades have often treated formal categories and rules as something to be 'used' by individuals, as one might use a stick or stone, and the gains of an earlier legal history are often needlessly set aside. Anthropologists, meanwhile, have treated rules as analytic errors and categories as an imposition by outside powers or by analysts, leaving a very thin notion of 'practice' as the stuff of social life. Philosophy of an older vintage, as well as the work of scholars such as Charles Taylor, provides fresh approaches when applied imaginatively to cases beyond the traditional ground of modern Europe and North America. Not only are different kinds of rules and categories open to examination, but the very notion of a rule can be explored more deeply. This volume approaches rules and categories as constitutive of action and hence of social life, but also as providing means of criticism and imagination. A general theoretical framework is derived from analytical philosophy, from Wittgenstein to his critics and beyond, and from recent legal thinkers such as Schauer and Waldron. Case-studies are presented from a broad range of periods and regions, from Amazonia via northern Chad, Tibet, and medieval Russia to the scholarly worlds of Roman law, Islam, and Classical India. As the third volume in the Legalism series, this collection draws on common themes that run throughout the first two volumes: Legalism: Anthropology and History and Legalism: Community and Justice, consolidating them in a framework that suggests a new approach to rule-bound systems.

Why put Abraham Lincoln, the sometime corporate lawyer and American President, in dialogue with Karl Marx, the intellectual revolutionary? On the surface, they would appear to share few interests. Yet, though Lincoln and Marx never met one another, both had an abiding interest in the most important issue of the nineteenth-century Atlantic world-the condition of labor in a capitalist world, one that linked slave labor in the American south to England's (and continental Europe's) dark satanic mills. Each sought solutions-Lincoln through a polity that supported free men, free soil, and free labor; Marx by organizing the working class to resist capitalist exploitation. While both men espoused emancipation for American slaves, here their agreements ended. Lincoln thought that the free labor society of the American North provided great opportunities for free men missing from the American South, a kind of "farm ladder" that gave every man the ability to become a landowner. Marx thought such "free land" a chimera and (with information from German-American correspondents), was certain that the American future lay in the proletarianized cities. Abraham Lincoln and Karl Marx in Dialogue intersperses short selections from the two writers from their voluminous works, opening with an introduction that puts the ideas of the two men in the broad context of nineteenth-century thought and politics. The volume excerpts Lincoln's and Marx's views on slavery (they both opposed it for different reasons), the Civil War (Marx claimed the war concerned slavery and should have as its goal abolition; Lincoln insisted that his goal was just the defeat of the Confederacy), and the opportunities American free men had to gain land and economic independence. Through this volume, readers will gain a firmer understanding of nineteenth-century labor relations throughout the Atlantic world: slavery and free labor; the interconnections between slave-made cotton and the exploitation of English proletarians; and the global impact of the American Civil War.
Writing the Rebellion presents a cultural history of loyalist writing in early America. There has been a spate of related works recently, but Philip Gould's narrative offers a completely different view of the loyalist/patriot contentions than appears in any of these accounts. By focusing on the literary projections of the loyalist cause, Gould dissolves the old legend that loyalists were more British than American, and patriots the embodiment of a new sensibility drawn from their American situation and upbringing. He shows that both sides claimed to be heritors of British civil discourse, Old World learning, and the genius of English culture. The first half of Writing Rebellion deals with the ways "political disputation spilled into arguments about style, form, and aesthetics, as though these subjects could secure (or ruin) the very status of political authorship." Chapters in this section illustrate how loyalists attack patriot rhetoric by invoking British satires of an inflated Whig style by Alexander Pope and Jonathan Swift. Another chapter turns to Loyalist critiques of Congressional language and especially the Continental Association, which was responsible for radical and increasingly violent measures against the Loyalists. The second half of Gould's book looks at satiric adaptations of the ancient ballad tradition to see what happens when patriots and loyalists interpret and adapt the same text (or texts) for distinctive yet related purposes. The last two chapters look at the Loyalist response to Thomas Paine's Common Sense and the ways the concept of the author became defined in early America. Throughout the manuscript, Gould acknowledges the purchase English literary culture continued to have in revolutionary America, even among revolutionaries.
The present edition of The Book of Fallacies is the first that follows Bentham's own structure for the work, and includes a great deal of material, both in terms of the fallacies themselves and the illustrative matter, that previous versions of the work have omitted. The fallacies that concerned Bentham were not logical errors of the sort identified by Aristotle, or commonplace misunderstandings of matters of fact, but arguments deployed in political debate, in particular in the British Parliament, in order to prevent reform. Bentham not only identified, described, and criticized the fallacious arguments in question, which were all characterized by their irrelevancy, but explained the sinister interests that led politicians to employ them and their supporters to accept them. By exposing these political fallacies, Bentham hoped to prevent their employment in future, and thereby to place political debate on its only proper ground, namely considerations drawn from the principle of utility.
