One hundred and fifty years of sustained archaeological investigation has yielded a more complete picture of the ancient Near East. The volume brings together the strongest results of modern research into the biblical text and narrative with archaeological and historical analysis to create an understanding of ancient Israel as a political and religious entity based on the broadest foundation of evidence. Recent years have witnessed a vibrant debate concerning the constitutional basis of judicial review,which reflects a broader discourse about the role of the courts, and their relationship with the other institutions of government, within the constitutional order. This book comprehensively analyses the foundations of judicial review. It subjects the traditional justification, based on the doctrine of ultra vires, to criticial scrutiny and fundamental reformulation, and it addresses the theoretical challenges posed by the impact of the Human Rights Act 1998 on administrative law and by the extension of judicial review to prerogative and non-statutory powers. It also explores the relationship between the theoretical basis of administrative law and its practical capacity to safeguard individuals against maladministration. The book seeks to develop a constitutional rationale for judicial review which founds its legitimacy in core principles such as the rule of law, the separation of powers and the sovereignty of Parliament. It presents a detailed analysis of the interface between constitutional and administrative law, and will be of interest to all public lawyers.
Inspired by the work of Professor Michael Taggart, this collection of essays from across the common law world is concerned with two separate but related themes. First, to what extent and by what means should review on substantive grounds such as unreasonableness be expanded and intensified? Jowell, Elliott and Varuhas all agree with Taggart that proportionality should not 'sweep the rainbow', but propose different schemes for organising and conceptualising substantive review. Groves and Weeks, and Hoexter evaluate the state of substantive review in Australia and South Africa respectively. The second theme concerns the broader (Canadian) sense of substantive review including the illegality grounds, and whether deference should extend to these grounds. Cane and Aronson consider the relevance and impact of different constitutional and doctrinal settings. Wilberg and Daly address questions concerning when and how deference is to operate once it is accepted as appropriate in principle. Rights-based review is discussed in a separate third part because it raises both of the above questions. Geiringer, Sales and Walters examine the choices to be made in settling the approach in this area, each focusing on a different dichotomy. Taggart's work is notable for treating these various aspects of substantive review as parts of a broader whole, and for his search for an appropriate balance between judicial scrutiny and administrative autonomy across this entire area. By bringing together essays on all these topics, this volume seeks to build on that approach.

The judgment of the UK Supreme Court in R (Miller) v Secretary of State for Exiting the European Union is of fundamental legal, constitutional and political significance. The Supreme Court's judgment discussed the relative powers of Parliament and the Government, the relationship between Westminster and the devolved legislatures, and the extent to which the UK's membership of the EU had changed the UK constitution, both prior to and even after departure. It also provided further evidence of the emerging role of the UK's Supreme Court as a constitutional court, despite the lack of a codified constitution in the UK. This edited collection critically evaluates the decision in Miller, providing a detailed analysis of the reasoning in the judgment and its longer-term consequences for the UK constitution through the period of Brexit and beyond. The case is used as a lens through which to evaluate the modern UK constitution and its potential future evolution. Whatever form Brexit may eventually take, the impact that EU membership and the triggering of Brexit has already had on the UK's constitutional settlement is profound. Albion W. Tourgee (1838-1905) was a major force for social, legal, and literary transformation in the second half of the nineteenth century. Best known for his Reconstruction novels A Fool's Errand (1879) and Bricks without Straw (1880), and for his key role in the civil rights case Plessy v. Ferguson (1896), challenging Louisiana's law segregating railroad cars, Tourgee published more than a dozen novels and a volume of short stories, as well as nonfiction works of history, law, and politics. This volume is the first collection focused on Tourgee's literary work and intends to establish his reputation as one of the great writers of fiction about the Reconstruction era arguably the greatest for the wide historical and geographical sweep of his novels and his ability to work with multiple points of view. As a white novelist interested in the rights of African Americans, Tourgee was committed to developing not a single Black perspective but multiple Black perspectives, sometimes even in conflict. The challenge was to do justice to those perspectives in the larger context of the story he wanted to tell about a multiracial America. The seventeen essays in this volume are grouped around three large topics: race, citizenship, and nation. The volume also includes a Preface, Introduction, Afterword, Bibliography, and Chronology providing an overview of his career. This collection changes the way that we view Tourgee by highlighting his contributions as a writer and editor and as a supporter of African American writers. This major collection contains selected papers from the second Public Law Conference, an international conference hosted by the University of Cambridge in September 2016. The collection includes contributions by leading academics and judges from across the common law world, including senior judges from Australia, Canada, New Zealand and the UK. The contributions engage with the theme of unity (and disunity) from a number of perspectives, offering a rich panoply of insights into public law which significantly carry forward public law thinking across common law jurisdictions, setting the agenda for future research and legal development. This volume examines the historical connections between the United States' Reconstruction and the country's emergence as a geopolitical power a few decades later. It shows how the processes at work during the postbellum decade variously foreshadowed, inhibited, and conditioned the development of the United States as an overseas empire and regional hegemon. In doing so, it links the diverse topics of abolition, diplomacy, Jim Crow, humanitarianism, and imperialism. In 1935, the great African American intellectual W. E. B. Du Bois argued in his Black Reconstruction in America that these two historical moments were intimately related. In particular, Du Bois averred that the nation's betrayal of the South's fledgling interracial democracy in the 1870s put reactionaries in charge of a country on the verge of global power, with world-historical implications. Working with the same chronological and geographical parameters, the contributors here take up targeted case studies, tracing the biographical, ideological, and thematic linkages that stretch across the postbellum and imperial moments. With an Introduction, eleven chapters, and an Afterword, this volume offers multiple perspectives based on original primary source research. The resulting composite picture points to a host of countervailing continuities and changes. The contributors examine topics as diverse as diplomatic relations with Spain, the changing views of radical abolitionists, African American missionaries in the Caribbean, and the ambiguities of turn-of-the century political cartoons.
