This book addresses a growing area of concern for scholars and development practitioners: discriminatory gender norms in legally plural settings. Focusing specifically on indigenous women, this book analyses how they, often in alliance with supporters and allies, have sought to improve their access to justice. Development practitioners working in the field of access to justice have tended to conceive indigenous legal systems as either inherently incompatible with women's rights or, alternatively, they have emphasised customary law's advantageous features, such as its greater accessibility, familiarity and effectiveness. Against this background - and based on a comparison of six thus far underexplored initiatives of legal and institutional change in Ecuador, Peru, and Bolivia - Anna Barrera Vivero provides a more nuanced, ethnographic, understanding of how women navigate through context-specific constellations of interlegality in their search for justice. In so doing, moreover, her account of ongoing political debates and local struggles for gender justice grounds the elaboration of a comprehensive conceptual framework for understanding the legally plural dynamics involved in the contestation of discriminatory gender norms.

The UN human rights agenda has reached the mature age of 70 years and many UN mechanisms created to implement this agenda are themselves in their middle-age, yet human rights violations are still a daily occurrence around the globe. The scorecard of the UN human rights mechanisms appears impressive in terms of the promotion, spreading of education and engaging States in a dialogue to promote human rights, but when it comes to holding governments to account for violations of these rights, the picture is much more dismal. This book examines the effectiveness of UN mechanisms and suggests measures to reform them in order to create a system that is robust and fit to serve the 21st century. The International Labour Organization's (ILO) efforts since the early 1990s to address the forced labour situation in Myanmar represent a rare example of success in influencing the behaviour of that regime, and this book gives a first-hand account of these efforts. As the ILO's representative in the country, the author was able to operate a complaint system for victims of forced labour, resulting in prosecutions of government officials and an end to many abuses. In addition to giving a fascinating insider's account of how this was achieved, and the many challenges encountered, the book examines in detail why one of the most repressive military regimes allowed the ILO to operate a complaints mechanism in the first place, and why it felt the need to take action in response to some of those complaints. This book will make a significant contribution to thinking on how to influence authoritarian regimes, as well as understanding the dynamic of relations with Myanmar. As such it is an essential read for scholars of international relations and global governance, human rights, international law and Southeast Asian studies.

The connection between environment and health has been well studied and documented, particularly by the World Health Organization. It is now being included in some legal instruments, although for the most part caselaw does not explicitly make that connection. Neither the right to life nor the rights to health or to normal development are actually cited in the resolution of cases and in judges' decisions. This volume makes the connection explicit in a broad review of human rights and legal issues associated with public health and the environment. It will be particularly useful as many legal instruments emphasize the right to 'development' without fully discussing the necessary safety and public health aspects, and the respect for the ecology of any area where such 'development' (often unwanted by local or indigenous communities) is to be located. Climate change is another pressing variable that is considered, and several chapters address the interface between human health and ecological conditions. Overall the book integrates perspectives from a wide range of disciplines, including ethics, ecology, public health and epidemiology, and human rights and law.

James Hickey proceeds from the premise that throughout history, humans have demonstrated a proclivity for using violence against one another as a means to achieve an end, means enabled, in many respects, by the technologies available at the time. Advancing technology has often been a prime enabler of ever-increasing levels of violence and attendant human suffering. At a few junctures in history, however, certain technologies have seemingly provided the armed forces that possess them the ability to fight wars with decreasing levels of violence and suffering. Today, precision-guided munitions (PGMs) with their high degree of discrimination and accuracy again hold such promise. This book seeks to answer the question: Do PGMs mitigate suffering in war, and have these weapons changed the way decisions regarding war and peace have been made? Answering this question helps us understand possible shifts in emphasis in modern warfare, both in terms of methods employed and of the greater concern placed on limiting human suffering during conflict. This book will help students of ethics, just war and military history and senior military and civilian leaders to understand the possible outcomes and wider implications of their strategic choices to use such technology.

In both Europe and North America it can be argued that the associational and institutional dimensions of the right to freedom of religion or belief are increasingly coming under pressure. This book demonstrates why a more classical understanding of the idea of a liberal democracy can allow for greater respect for the right to freedom of religion or belief. The book examines the major direction in which liberal democracy has developed over the last fifty years and contends that this is not the most legitimate type of liberal democracy for religiously divided societies. Drawing on theoretical developments in the field of transnational constitutionalism, Hans-Martien ten Napel argues that redirecting the concept and practice of liberal democracy toward the more classical notion of limited, constitutional government, with a considerable degree of autonomy for civil society organizations would allow greater religious pluralism. The book shows how, in a postsecular and multicultural context, modern sources of constitutionalism and democracy, supplemented by premodern, transcendental legitimation, continue to provide the best means of legitimating Western constitutional and political orders.

The NHS came into existence in an atmosphere of conflict centred on the strong ideological commitment of the Post-war Labour Government and the opposition of the Conservative Party of that time to the idea of a universally available and centrally planned medical care service. There was also opposition from some sections of the medical establishment who feared the loss of professional autonomy. Setting health policy in both an historical and modern context (post 1997) Carrier and Kendall weigh up the successes and failures of the National Health Service and examine the conflicts which have continued for over sixty years, in spite of efforts to solve financial problems in the NHS through increases in funding as well as structural and organisational change. After looking at recent responses to supposed failures of the NHS, they conclude that the NHS has successfully faced the challenges before it and is likely to continue to meet the changing health needs of the population. Financial stresses, concerns about the quality of care and demographic change, with consequent issues for the elderly and the chronically ill, continue to be urgent and politically contentious issues. Public debates about the terms of membership and inclusion have intensified as developed economies increasingly rely on temporary migrant labour. While most agree that temporary migrant workers are entitled to the general protection of employment laws, temporary migrants have, by definition, restricted rights to residence, full social protections and often to occupational and geographic mobility. The rule of law, peace, disarmament, human rights: these are no longer words, but legal concepts steadily gaining force among nations. If the slow but sure codification of international law that began with the first Geneva Convention of 1864 has put down roots, against all odds, it is because of the passionate determination of a few visionary but practical actors on the world's stage. Pre-eminent among these "workers in the dawn" was the Russian jurist, diplomat and arbitrator F.F. Martens (1845-1909). Although Marten's reputation suffered during the Soviet era and on both sides of the Cold War, the lasting effect of his ideas and initiatives can be traced all the way from his early years as a Law Professor at Petersburg University (when his writing attracted the attention of the Czar), through his direct participation in the great Peace Conferences at Brussels and The Hague, to the legal underpinnings of the human rights regime embodied in today's international conventions and tribunals. His sense of community and the individual in a global context - a difficult notion for lawyers to grasp in a world of competing nation-states - has now become a widely-accepted norm with increasingly effective enforcement mechanisms. And even his contributions to procedural theory, in areas such as extradition of political criminals and transnational enforcement of administrative law, persist in coming to the forefront of today's international legal practice. This English translation of Martens' biography is the most complete text, as the Russian author, at the translator's request, took the opportunity to revise his original work and supplied two chapters missing from the original Russian edition of 1993 and subsequent editions and translations. Pustogarov was among the first scholars to gain access to the Archive of the Foreign Policy of Russia, and his biography of Martens contains hitherto unavailable information on the more-or-less secret political manoeuvres of the "Great Powers" in Martens' time.

A massive uprising against the Mexican state of Oaxaca began with the emergence of the Popular Assembly of the Peoples of Oaxaca (APPO) in June 2006. A coalition of more than 300 organizations, APPO disrupted the functions of Oaxaca's government for six months. It began to develop an inclusive and participatory political vision for the state. Testimonials were broadcast on radio and television stations appropriated by APPO, shared at public demonstrations, debated in homes and in the streets, and disseminated around the world via the Internet.

The movement was met with violent repression. Participants were imprisoned, tortured, and even killed. Lynn Stephen emphasizes the crucial role of testimony in human rights work, indigenous cultural history, community and indigenous radio, and women's articulation of their rights to speak and be heard. She also explores transborder support for APPO, particularly among Oaxacan immigrants in Los Angeles. Discussions of punishment typically assume that punishment is criminal punishment carried out by the State. Punishment is, however, a richer phenomenon and it occurs in many contexts. This book contains a general account of punishment which overcomes the difficulties of competing accounts. Recognizing punishment's manifoldness is valuable not merely in contributing to conceptual clarity, but in that this recognition sheds light on the complicated problem of punishment's justification. Insofar as they narrowly presuppose that punishment is criminal punishment, most apparent solutions to the tension between consequentialism and retributivism are rather unenlightening if we attempt to apply them in other contexts. Moreover, this presupposition has given rise to an unwieldy variety of accounts of retributivism which are less helpful in contexts other than criminal punishment. Treating punishment comprehensibly helps us to better understand how it differs from similar phenomena, and to carry on the discussion of its justification fruitfully.

While some feminists seek to use ideas of the 'universal human subject' to include women, others argue that such ideas are intrinsically masculine and exclude the feminine. This book analyzes and critiques 'second wave' feminists who discuss how philosophers such as Plato and Aristotle, Descartes, Hobbes and Kant regard human beings and their capacities. The author suggests adopting an inclusive universal concept of the human being, drawn from ideas of positive liberty from the liberal tradition, Hegelian ideas of the formation of the free human being in society, and care ethics. In recent decades, asylum has emerged as a highly politicized European issue. The term 'asylum seeker' has suffered a negative perception and has been associated with notions of illegality and criminality in mainstream media. These misconceptions have been supported by politicians as a distraction from economic and political uncertainties with the result that asylum seekers have been deprived of significant rights. This book examines the effect of recent attempts of harmonization on the identification and protection of refugees. It considers the extent of obligations on the state to admit and protect refugees and examines the 1951 Refugee Convention. Examining the on-going dilemma of the management of diversity in Turkey from a historical and legal perspective, this book argues that the state's failure to accommodate ethno-religious diversity is attributable to the founding philosophy of Turkish nationalism and its heavy penetration into the socio-political and legal fibre of the country. It examines the articulation and influence of the founding principle in law and in the higher courts' jurisprudence in relation to the concepts of nation, citizenship, and minorities. In so doing, it adopts a sceptical approach to the claim that Turkey has a civic nationalist state, not least on the grounds that the legal system is generously littered by references to the Turkish ethnie and to Sunni Islam. Also arguing that the nationalist stance of the Turkish state and legal system has created a legal discourse which is at odds with the justification of minority protection given in international law, this book demonstrates that a reconstruction of the founding philosophy of the state and the legal system is necessary, without which any solution to the dilemmas of managing diversity would be inadequate.
