Wartime rape has been virulent in wars of sovereignty, territory, conquest, religion, ideology and liberation, yet attention to this crime has been sporadic throughout history. Rape remains 'unspeakable', particularly within law. Moreover, rape has not featured prominently in post-conflict collective memory. And even when rape is 'remembered', it is often the subject of political controversy and heated debate. In this book, Henry asks some critical questions about the relationship between mass rape, politics and law. In what ways does law contribute to the collective memory of wartime rape? How do 'counter-memories' of victims compete with the denialism of wartime rape? The text specifically analyses the historical silencing of rape throughout international legal history and the potential of law to restore these silenced histories, it also examines the violence of law and the obstacles to individual and collective redemption. This book explores contemporary civil-military relations in the United States. Much of the canonical literature on civil-military relations was either written during or references the Cold War, while other major research focuses on the post-Cold War era, or the first decade of the twenty-first century. This book examines the evolution of the relationship between climate change and conflict, and attempts to visualize future trends. Owing to the accumulation of greenhouse gases in the atmosphere, current trends in climate change will not appreciably alter over the next half century even if drastic action is taken now. Changes in climate will produce unique types and modes of conflict, redefine the value of important resources, and create new challenges to maintaining social order and stability. This book examines the consequences of climate change and argues that it has and will produce two types of different types of conflict: 'cold wars' and 'hot wars'. Cold wars will occur in northern and southern latitudes as warming draws countries into possible conflict due to expanding interests in exploiting new resources and territories (inter-state conflict). Hot wars will break out around the equator as warming expands and intensifies dry areas, increasing competition for scarce resources (intra-state conflict). Conflict is not inevitable, but it will also be a consequence of how states, international institutions and people react to changes in climate. Climate change and conflict have always shaped human experiences. Over the last 20 years the world's most advanced militaries have invited a small number of military legal professionals into the heart of their targeting operations, spaces which had previously been exclusively for generals and commanders. These professionals, trained and hired to give legal advice on an array of military operations, have become known as war lawyers. The War Lawyers examines the laws of war interpreted and applied by military lawyers to aerial targeting operations carried out by the US military in Iraq and Afghanistan, and the Israel military in Gaza. Drawing on interviews with military lawyers and others, this book explains why some lawyers became integrated in the chain of command whereby military targets are identified and attacked, whether by manned aircraft, drones and/or ground forces, and with what results. This book shows just how important law and war lawyers have become in the conduct of contemporary warfare, and how it is understood. This book outlines challenges to the effective operation of regional economic communities (RECs) with regards to peacebuilding in Africa. In this book, Vincenzo Ruggiero offers a typology of different forms of political violence. This book analyzes the Responsibility to Protect (R2P) in the context of the conflict in Darfur, using detailed empirical evidence. The volume traces Darfur's evolution from forgotten conflict to a major global cause and back to obscurity. The emergence of a far-reaching international response to the war in Darfur began in 2004 and included the most influential international advocacy movement since the anti-apartheid campaign and one of the world's largest peacekeeping missions. The book analyzes how Darfur slid back into international obscurity after 2011, despite ongoing violence against civilians and the continued risk of conflict escalation following Omar al-Bashir's ousting in April 2019. Based on an analysis of more than 100 interviews and over 1,000 media reports, the book examines one of the most pressing questions related to the R2P: why do some situations of mass atrocities cause an international outcry, while others are met with complacency and silence? Disarmament is integral to the safeguarding and promotion of security, development, and human rights. Hundreds of millions of dollars are spent each year on disarmament operations, yet no comprehensive guide exists to explain clearly the international rules governing disarmament. This book seeks to fill that gap. It describes the international legal rules that govern disarmament and the operational, political, and technical considerations that govern their implementation. This book aims to support compliance, implementation, and further development of international disarmament law. Traditionally, disarmament focused on weapons of mass destruction. This remains a critically important area of work. In recent decades, the scope of disarmament has broadened to encompass also conventional weapons, including through the adoption of rules and regulations to govern arms transfers and measures to eliminate specific munitions from stockpiles and to destroy explosive remnants of war. There have also been four "generations" of programmes to address small arms and light weapons at national or sub-national level through disarmament, demobilisation, and reintegration (DDR) programmes during and following the end of armed conflict. While an internationally accepted definition of disarmament does not yet exist, it is widely agreed that disarmament encompasses or interrelates with prohibitions and restrictions on the development, production, stockpiling, testing, and transfer of weapons and on their destruction. In addition to clarifying these elements, chapters of this guide will also consider the relationship between disarmament and the law of armed conflict, and with the United Nations Security Council, human security, public health, and non-state actors.

Transitional justice processes are now considered to be crucial steps in facilitating the move from conflict or repression to a secure democratic future. This book contributes to a deeper understanding of transitional justice by examining the complexities of transition in postcolonial societies. It focuses particularly on Zimbabwe but draws on relevant comparative material from other postcolonial polities. Examples include but are not limited to African countries such as South Africa, Rwanda and Mozambique. This book explains how security is organized from the local to the national level in post-war Sierra Leone, and how external actors attempted to shape the field through security sector reform. Security sector reform became an important and deeply political instrument to establish peace in Sierra Leone as war drew to an end in the late 1990s and early 2000s. Through historical and ethnographic perspectives, the book explores how practices of security sector reform have both shaped and been shaped by practices and discourses of security provision from the national to the local level in post-war Sierra Leone. It critiques how the notion of hybridity has been applied in peace and security studies and cultural studies, and thereby provides an innovative perspective on IR, and the study of interventions. After 1989, the function of transitional governance changed. It became a process whereby transitional authorities introduce a constitutional transformation on the basis of interim laws. In spite of its domestic nature, it also became an international project and one with formidable ambitions: ending war, conflict or crisis by reconfiguring the state order. This model attracted international attention, from the UN Security Council and several regional organisations, and became a playing field of choice in international politics and diplomacy. Also without recourse to armed force, international actors could impact a state apparatus - through state renaissance. This book zooms in on the non-forcible aspects of conflict-related transitional governance while focusing on the transition itself. This study shows that neither transitional actors nor external actors must respect specific rules when realising or contributing to state renaissance. The legal limits to indirectly provoking regime change are also being unveiled.

Since Pakistan was founded in 1947, its army has dominated the state. The military establishment has locked the country in an enduring rivalry with India, with the primary aim of wresting Kashmir from it. To that end, Pakistan initiated three wars over Kashmir-in 1947, 1965, and 1999-and failed to win any of them. Today, the army continues to prosecute this dangerous policy by employing non-state actors under the security of its ever-expanding nuclear umbrella. It has sustained a proxy war in Kashmir since 1989 using Islamist militants, as well as supporting non-Islamist insurgencies throughout India and a country-wide Islamist terror campaign that have brought the two countries to the brink of war on several occasions. In addition to these territorial revisionist goals, the Pakistani army has committed itself to resisting India's slow but inevitable rise on the global stage. Despite Pakistan's efforts to coerce India, it has achieved only modest successes at best. Even though India vivisected Pakistan in 1971, Pakistan continues to see itself as India's equal and demands the world do the same. The dangerous methods that the army uses to enforce this self-perception have brought international opprobrium upon Pakistan and its army. And in recent years, their erstwhile proxies have turned their guns on the Pakistani state itself. Why does the army persist in pursuing these revisionist policies that have come to imperil the very viability of the state itself, from which the army feeds? In Fighting to the End, C. Christine Fair argues that the answer lies, at least partially, in the strategic culture of the army. Through an unprecedented analysis of decades' worth of the army's own defense publications, she concludes that from the army's distorted view of history, it is victorious as long as it can resist India's purported drive for regional hegemony as well as the territorial status quo. Simply put, acquiescence means defeat.
