Die Arbeitnehmerbeteiligung in einer Europaischen Gesellschaft (SE) ist nicht einheitlich geregelt. Die Richtlinie 2001/86/EG enthalt zahlreiche Gestaltungsspielraume. In Deutschland wurde die Richtlinie 2001/86/EG durch das SEBG umgesetzt. Dieses sieht fur eine SE mit Sitz in Deutschland partielle Ruckverweisungen in die Rechtsordnungen anderer EU-Mitgliedstaaten vor. Fur die Akteure in einer SE bedeutet dies ein Nebeneinander verschiedener Rechtssysteme. Der Umfang und die Folgen der Ruckverweisungen sind Gegenstand der Bearbeitung. Im Mittelpunkt steht ein Vergleich derjenigen nationalen Regelungen, die von den Ruckverweisungen des SEBG erfasst sind. Untersucht werden die massgeblichen Regelungen in den Umsetzungsgesetzen von 27 EU-Mitgliedstaaten.
