This book contributes conceptually, theoretically and morally to a deeper understanding of the distinctive Asian perceptions of punishment, justice and human rights. Researched and prepared by scholars who have not only been conducting studies on the death penalty in the region but have also been advocating for legal reforms, this edited book touches upon the different justifications for the use of capital punishment in the ASEAN region, exposing the secrecy, sensitivities and dilemmas that mask violations of international human rights laws. The chapters bring in numerous new perspectives which have been overlooked in the traditional discourse surrounding the use of the death penalty, such as that around crimes that do not meet the threshold of “most seriousâ€; the dignity of death row inmates and their families; contradictions within religion and capital punishment; and the way in which growing authoritarianism and the media are adversely influencing the public’s perception and support for capital punishment in the region. In examining how public opinion shapes state policies towards the death penalty and how it varies according to different offences and different states, the authors critically analyse how the international human rights mechanisms have specifically called for ASEAN member states to refrain from extending the application of the death penalty and to limit it to the “most serious crimes.†Relevant to socio-legal scholars focused on crime and punishment in Southeast Asia, and in the Global South more broadly, this is a landmark collection in criminology and human rights scholarship. Chapter "ASEAN and the Death Penalty: Theoretical and Legal Views and a Pathway to Abolition" is available open access under a Creative Commons Attribution 4.0 International License via link.springer.com.
ASEAN has declared its intention to create a security community in Southeast Asia that is people-orientated. This book evaluates ASEAN's progress, and in doing so examines three matters of concern. The book firstly looks at the importance of constitutive norms to the workings of security communities, by identifying ASEAN's constitutive norms and the extent to which they act as a help of hindrance in establishing a security community. It then moves on to how ASEAN has interpreted people-orientated as empowering civil society organisations to be community stakeholders. The book discusses the uncertainty between how ASEAN envisages their role, and the role they themselves expect to have. Civil society actors are seeking to influence what sort of community evolves and their ability to interact with the state elite is evaluated to determine what interpretation of people-oriented is likely to emerge. Thirdly, in order to make progress ASEAN has sought to achieve cooperation among its member states in functional areas. The book examines this interest in functional cooperation through case studies on human rights, HIV/AIDS and disaster management. By discussing the notion of ASEAN being people-orientated, and how it engages with 'the people', the book provides important insights into what type of community ASEAN in building, as well as furthering our understanding on security communities more broadly.
Supranational regionalism and regional integration have for a long time been top-down processes, led by the few and imposed on the many. The role of citizens, especially those active in civil society, has been neglected by scholars, students, and commentators of regionalism. In reaction to the prevalence of these top-down models, a "new regionalism" approach has proliferated in the past few years. This book aims to further develop such a research agenda by providing an up-to-date overview of the contribution of civil society to world regionalism, from Europe to Africa, Asia, and the Americas. This is not only relevant as a research topic; it is also of critical importance from a political standpoint. As regions across the world experience prolonged governance crises, it becomes paramount to understand the extent to which these new regional formations actually reflect the interests and needs of their people. While old regionalism was accepted as a de facto elite-driven byproduct of both the Cold War and neoliberal globalization, the twenty-first-century regionalism-if it is to survive-will need to refocus its objectives through new forms of participation and inclusion. Regions without citizens are unlikely to stand the test of time, especially in times of crises.
