The Executive in the Constitution - Structure, Autonomy, and Internal Control (Hardcover): Terence Daintith, Alan Page The Executive in the Constitution - Structure, Autonomy, and Internal Control (Hardcover)

The Executive in the Constitution: Structure, Autonomy, and Internal Control is the first constitutional and legal analysis of the inner workings of the executive for many years. It aims to provoke a reappraisal, by constitutional lawyers, of the place of the executive within the constitution, by exploring an area hitherto largely neglected in constitutional law: the legal foundations of the powers and structure of the executive, and the mechanisms through which the centre of the executive seeks to control the actions of departments. The authors, both pre-eminent in the field off constitutional law, show that the machinery of executive co-ordination and control is no less crucial a dimension of the constitutional order than the external machinery of democratic and legal control. These external parliamentary and judicial controls depend for their effectiveness on the executive's ability to control itself. The plural structure of the executive, however, makes the co-ordination and control of its component parts a highly problematical pursuit. Against the background of an analysis of the executive's legal structure, the book examines in detail the controls governing departmental access to staffing, financial, and legal resources, analysing the relationship between these internal controls and the external machinery of democratic and legal control, and showing how the machinery of internal control has been shaped by the structure of the executive branch. The organization of the executive and the way it controls the actions of its departments has changed significantly in recent year. This book explores the impact of the machinery if executive co-ordination and control of the ambitious public service reform project which has been pursued by successive governments over the last twenty years, as well as of changes in the wider constitutional framework, including those stemming from the United Kingdom's membership of the European Union and the growth of judicial review. It shows how public service reforms, judicial review, and European law are changing not just the inner life of the executive government but its place in the constitution as well.

Virtuous Violence - Hurting and Killing to Create, Sustain, End, and Honor Social Relationships (Hardcover): Alan Page Fiske,... Virtuous Violence - Hurting and Killing to Create, Sustain, End, and Honor Social Relationships (Hardcover)
Alan Page Fiske, Tage Shakti Rai; Foreword by Steven Pinker

What motivates violence? How can good and compassionate people hurt and kill others or themselves? Why are people much more likely to kill or assault people they know well, rather than strangers? This provocative and radical book shows that people mostly commit violence because they genuinely feel that it is the morally right thing to do. In perpetrators' minds, violence may be the morally necessary and proper way to regulate social relationships according to cultural precepts, precedents, and prototypes. These moral motivations apply equally to the violence of the heroes of the Iliad, to parents smacking their child, and to many modern murders and everyday acts of violence. Virtuous Violence presents a wide-ranging exploration of violence across different cultures and historical eras, demonstrating how people feel obligated to violently create, sustain, end, and honor social relationships in order to make them right, according to morally motivated cultural ideals.

Kama Muta - Discovering the Connecting Emotion (Paperback): Alan Page Fiske Kama Muta - Discovering the Connecting Emotion (Paperback)
Alan Page Fiske
R1,210 Discovery Miles 12 100 Ships in 12 - 17 working days

This book describes a ubiquitous and potent emotion that has only rarely and recently been studied in any systematic manner. The words that come closest to denoting it in English are being moved or touched, having a heart-warming feeling, feeling nostalgic, feeling patriotic, or pride in family or team. In religious contexts when the emotion is intense, it may be labeled ecstasy, mystical rapture, burning in the bosom, or being touched by the Spirit. All of these are instances of what scientists now call 'kama muta' (Sanskrit, 'moved by love'). Alan Page Fiske shows that what evokes this emotion is the sudden creation, intensification, renewal, repair, or recall of a communal sharing relationship - when love ignites, or people feel newly connected. He explains the social, psychological, cultural, and likely evolutionary processes involved - and how they interlock. Kama muta is described as it manifests in diverse settings at many points in history across scores of cultures, in everyday experiences as well as the peak moments of life. The chapters illuminate the occurrence of kama muta in a range of contexts, including religion, oratory, literature, sport, social media, and nature. The book will be of interest to students and scholars from a number of disciplines who are interested in emotion or social relationships. Never Ask "Why" - Football Players' Fight for Freedom in the NFL (Hardcover): Ed Garvey Never Ask "Why" - Football Players' Fight for Freedom in the NFL (Hardcover)
Ed Garvey; Edited by Chuck Cascio; Foreword by Judge Alan Page; Introduction by Dr. Sarah K. Fields

When pro football players formed a union to stand up against the NFL for their own interests, they chose lawyer Ed Garvey as their Executive Director. The NFL Players Association (NFLPA), would take on the NFL over player contracts, collective bargaining agreements, and antitrust suits. It lobbied for players' free agency, contract rights, and impartial arbitration of disciplinary disputes. Garvey navigated strikes, lockouts, scabs, stooges, lies, as well as the sports media complex-to maintain players' dignity. According to the league, the players were to take what they were given and "never ask why." In Never Ask "Why," journalist Chuck Cascio presents the late Garvey's rich account of the early years of the NFLPA, taking readers among the players as they held the league accountable to play fair. Learning from their mistakes, the NFLPA would succeed in curbing commissioner Pete Rozelle's disciplinary power and striking down the Rozelle Rule's absolute control over free agency. Garvey tells the intimate stories of how pro football players, rivals on the field, rallied together to stand up for themselves. He worked tirelessly to change a system that exploited players and even controlled the media. In the end, Garvey shows how the NFLPA transformed the state of pro sports leagues today and how, even still, they work to keep down the players on whose backs they profit.

Aileen McHarg, Tom Mullen, Alan Page, Neil Walker
R3,062 Discovery Miles 30 620 Ships in 12 - 17 working days

The September 2014 Scottish independence referendum was an event of profound constitutional and political significance, not only for Scotland, but for the UK as a whole. Although Scottish voters chose to remain in the UK, the experience of the referendum and the subsequent political reaction to the 'No' vote that triggered significant reforms to the devolution settlement have fundamentally altered Scotland's position within the Union. The extraordinary success of the Scottish National Party at the 2015 General Election also indicates that the territorial dimension to UK constitutional politics is more prominent than ever, destabilising key assumptions about the location and exercise of constitutional authority within the UK. The political and constitutional implications of the referendum are still unfolding, and it is by no means certain that the Union will survive. Providing a systematic and academic analysis of the referendum and its aftermath, this interdisciplinary edited collection brings together public lawyers, political scientists, economists, and historians in an effort to look both backwards to, and forwards from, the referendum. The chapters evaluate the historical events leading up to the referendum, the referendum process, and the key issues arising from the referendum debate. They also explore the implications of the referendum both for the future governance of Scotland and for the UK's territorial constitution, drawing on comparative experience in order to understand how the constitution may evolve, and how the independence debate may play out in future.
