The criminal courts have the power to stop a prosecution from
proceeding altogether where it would be inappropriate for it to
continue. This power to stay proceedings which constitute an abuse
of the process of the court has assumed great practical
significance and is potentially applicable in many situations.
There is at least one consideration of the abuse of process
doctrine in virtually every major criminal trial today.
This timely book presents a critical look at the operation, theoretical basis, and possible reform of the rule against Hearsay in criminal trials. The main focus of the book is on English law, but references also are made to the legal position in a number of other jurisdictions. It is the first book to be published in England since 1950 on a very topical and controversial area of the law. It follows closely on the heels of the publication of the Law Commission's consultation paper on Criminal Hearsay.
Choo's Evidence provides students with a lucid account of the core principles of the law of evidence in England and Wales, whilst also exploring the fundamental rationales that underlie the law as a whole. This clear and engaging text explores current debates and draws on different jurisdictions to achieve a fascinating mix of critical and thought-provoking analysis for students and practitioners alike. Where appropriate, the author draws on comparative material and a variety of socio-legal, empirical, and non-legal material. Thorough footnoting and further reading lists provide valuable signposting to a wealth of additional sources. Digital formats The sixth edition is available for students and institutions to purchase in a variety of formats.
