Volume 12 of the EYIEL focuses on "The Future of Dispute Settlement in International Economic Law". While new forms of dispute settlement are emerging, others are in deep crisis. The volume starts off with reflections on Dispute Settlement and the World Trade Organisation, most prominently the crisis of the Appellate Body, but also addressing international intellectual property law and the African Continental Free Trade Area. This is followed by a section on Dispute Settlement and Investment Protection/International Investment Law, which includes articles on the summary dismissal of claims, the margin of appreciation doctrine, the use of conciliation to settle sovereign debt disputes, and contract-based arbitration in light of Achmea and Hagia Sophia at ICSID. Further contributions consider the emerging role of commercial courts, the dejudicialization of international economic law, dispute settlement in the UK-EU Withdrawal Agreement, reference mechanisms in dispute resolution clauses, and UNCLOS.

Die Arbeit untersucht das Spannungsverhaltnis zwischen Vertragstreue und Umstandsanderung im aktuellen Voelkerrecht. Hierzu werden zunachst die Rechtsinstitute des allgemeinen Voelkervertragsrechts, grundlegende Umstandsanderung, nachtragliche Unmoeglichkeit der Erfullung und Obsoleszenz dargestellt, die ein Abrucken von Vertragspflichten durch eine Vertragspartei unter dem Eindruck der nachtraglichen AEnderung der Umstande ermoeglichen. Im Folgenden wird eroertert, inwiefern die Rechtswidrigkeitsausschlussgrunde des Rechts der Staatenverantwortlichkeit - Notstand und hoehere Gewalt - das Instrumentarium des allgemeinen Voelkerrechts als Grenzen der Vertragstreue erweitern. Schliesslich wird der Umgang mit Umstandsanderungen in ausgewahlten Vertragsregimen - Menschenrechten, Seerecht, GATT/WTO-Regime und Investitionsrecht - analysiert und gefragt, inwiefern die Grenzen der Vertragstreue in den spezifischen Regimen differenzierter gezogen werden und wie das Verhaltnis zwischen den Vertragsbestimmungen und den Rechtsinstituten des allgemeinen Voelkerrechts zu loesen ist.
International investment law has become increasingly prominent in
the international legal order, spurred on by the explosion of
Bilateral Investment Treaties between States and a sharp rise in
international investment disputes. This rise to prominence has
however not always been matched by academic reflection on the
content of procedure of international investment law and its role
within general international law. This volume seeks to remedy this
situation by providing careful analysis of every area of
international investment law and its relationship with other legal
fields.
The European Society of International Law (ESIL) is known for its particularly dynamic character. After 10 years of existence it has proved that it is one of the most cutting-edge scholarly associations in the field of public international law. At its 10th Anniversary Conference in September 2014, which was held in Vienna, participants assembled in order to discuss 'International law and...', the proceedings of which are published here. Going beyond the usual related disciplines of political science, international relations, economics and history, this conference ventured into less well-trodden paths, exploring the links between international law and cinema, philosophy, sports, the arts and other areas of human endeavour. As the proceedings show, it is clear that international law has long been influenced by other fields of law and other disciplines. They also explore whether the boundaries of international law have been crossed and, if so, in what ways.
