This festschrift, dedicated to Judge Bruno Simma, traces the development of international law from regulating bilateral state-to-state relationships towards strengthening the entire international community by protecting human security, the global environment, and human rights. It provides both theoretical and practical insights into these sometimes conflicting goals, their basis in international law, and the role played by international institutions charged with upholding these values and interests.
The work thus examines the mechanism by which international law contributes to the realization not only of individual State interests, but the interests of the international community as a whole. Dieses Buch betrachtet die Sanktionierungsmassnahmen der Weltbank gegen Korruption und Betrug bei von ihr finanzierten Projekten. Die Weltbank sanktioniert Projektteilnehmer oeffentlich, indem sie diese fur eine bestimmte Zeit von der Beteiligung an Bankprojekten ausschliesst. Dies kann ein Unternehmen empfindlich treffen. Die Weltbank selbst kann dafur vor nationalen Gerichten nicht belangt werden, muss aber fur effektive alternative Rechtsschutzmoeglichkeiten sorgen. Der Autor untersucht dieses Rechtsschutzsystem hinsichtlich Effektivitat und Fairness und im Vergleich zu den Anforderungen von Art. 6 EMRK.

Dieses Buch schliesst eine Forschungslucke, indem es sich mit der "ratio" der Immunitat des Souverans in ihrem jeweiligen zeithistorischen Zusammenhang auseinandersetzt. Auf dieser Grundlage erfolgt die Einbettung der dem Souveran weitestgehend gleichgestellten Immunitat amtierender Staatsoberhaupter im modernen Voelkerrecht. So wird das Spannungsverhaltnis zwischen dem Anspruch des Voelkerstrafrechts und der Aufrechterhaltung der souveranen Staatengleichheit aufgeloest. Die Neuordnung der modernen Immunitatssystematik fuhrt zu dem Ergebnis, dass die Immunitat "ratione personae" amtierender Staatsoberhaupter vor einem echten internationalen Straftribunal a priori keine Wirkung entfaltet - und steht damit im Widerspruch zur herrschenden Meinung in Literatur und Rechtsprechung.

Die Anzahl stressinduzierter Erkrankungen wie Burn-out nimmt immer weiter zu. Bislang ist in Deutschland hoechstrichterlich noch ungeklart, wie Burn-out haftungsrechtlich zu bewerten ist. Der Autor untersucht dieses Problem aus multidisziplinarer Perspektive, indem er Burn-out zunachst aus arbeitspsychologischer Sicht beschreibt und sodann sozial- und zivilrechtlich einordnet. Dies geschieht insbesondere unter dem Aspekt, ob Burn-out als Arbeitsunfall oder Berufskrankheit zu qualifizieren ist. Dabei erarbeitet er mit Ruckgriff auf die japanische Rechtslage zu Karoshi/Karo-jisatsu (Tod durch bzw. Selbstmord wegen UEberarbeitung) verschiedene Loesungsansatze fur den deutschen Rechtskreis sowohl in dogmatischer als auch praxisnaher Hinsicht.

The provisions of the Agreement on the European Economic Area (EEA) determine the relations of the EFTA countries Norway, Iceland and Liechtenstein with the EU and its Member States. On its basis, these three countries participate extensively in the internal market. The EEA is also discussed as a possible model for relations between the EU and the United Kingdom after Brexit.
