Now in its fourth edition, the Wieczorek/Schutze legal commentary
is a virtual institution in the field of civil procedure. This
fourteen-volume guide once again sets the standard for legal
reference works. Based on solid legal scholarship, it
comprehensively considers practical requirements and needs in
relation to civil procedure. The authorial team, which is composed
of 33 legal scholars and practitioners - including several new
younger members - ensures that the commentary remains true to its
rich traditions, but at the same time is up-to-date for current and
future needs. In addition to German civil procedure, the commentary
addresses relevant supplementary laws in Germany (e.g. EGZPO, GVG,
KapMuG, and MediationsG), as well as European and international
civil procedure. The commentary also takes into consideration
relevant legal changes as well as the newest developments in case
law and legal teaching. Here you find an overview of all fourteen
volumes. Take a closer look at the extract of volume 12 1067-1109;
Internationales Zivilprozessrecht; Rechtsquellen und Materialien.
The law of succession enjoys a growing practical meaning. The work
contains a description of the main elements as well as the focal
point of the law of succession. Reforms in relation to the first
edition are mainly brought about by numerous court decisions. Newly
incorporated was particularly the subject "patient wills", which at
the time was widely discussed in connection with euthanasia. The
main feature is divided by visual emphasis from the detailed
passages, which are directed at elective candidates. Every chapter
closes with a summary. Additionally, the most important information
is summarized in numerous overviews. For a better understanding of
the subject matter dealt with, many examples of topics are found
within the text. The combination of these pedagogical features
comprises the specific benefit of this work.
This third edition is aimed to serve as a reference work not only
for law students (from the start of law school up to final exams)
but also legal trainees as well as legal practitioners. It presents
the fundamentals as well as specialized topics of the law of
succession. Legislation enacted since the previous edition was
taken into consideration according to its educational relevance.
Based on its connection to the ongoing and heated debate on
euthanasia, the topic of "patient testaments" was thoroughly
revised. The planned legal amendments, which will especially affect
the law pertaining to compulsory portion, were also taken into
consideration. A new chapter presents the issues surrounding a
person's ability to inherit, whose birth is a result of artificial
insemination.
Already in its 4th edition, this textbook presents the fundamentals
as well as specific topics in inheritance law. The new edition
considers recent amendments to inheritance law, including the 2010
reform of the inheritance right to a compulsory portion
(Pflichtteilsrecht) as well as the German law on living wills.
