At a time where multilateralism is coming under increasing pressure, a new reflection on the foundations of international law is warranted. Democracy and Sovereignty: Rethinking the Legitimacy of Public International Law addresses urgent new and intrinsically international subject areas, such as digitalization, climate change and transborder investments. This volume looks at the changing role of state sovereignty and explores more democratic modes of legitimation in order to supplement the traditional concept of state consent, and sharpen the notion of democracy itself.
The right to life stands at the heart of human rights protection. Individuals cannot enjoy any of the rights guaranteed to them unless their physical existence is ensured. All human rights instrument list the right to life as the first one of their safeguards. Nonetheless, in many situations human life finds itself under structural threat. Although obligated by law to protect the right to life, State authorities time and again engage in deliberate acts of killing. Fortunately, international review bodies have devised many imaginative counter-strategies. Another one of those structural threats is global warming. Obviously, armed conflict puts human life inevitably at risk; the limits of the license to kill given by the laws of war must be scrupulously observed.
This book explores the objects, means and ends of international cultural heritage protection. It starts from a broad conception of cultural heritage that encompasses both tangible property, such as museum objects or buildings, and intangible heritage, such as languages and traditions. Cultural heritage thus defined is protected by various legal regimes, including the law of armed conflicts, UNESCO Conventions and international criminal law. With a view to strengthening international protection, the authors analyze existing regimes and elaborate innovative concepts, such as blue helmets of culture and safe havens for endangered cultural heritage. Finally, the ends of international protection come to the fore, and the authors address possible conflicts between protecting cultural diversity and wishes to strengthen cultural identity.
