The Welfare State, Globalization, and International Law (Paperback, 2004 ed.): Eyal Benvenisti, Georg Nolte The Welfare State, Globalization, and International Law (Paperback, 2004 ed.)
Eyal Benvenisti, Georg Nolte
R3,171 Discovery Miles 31 710 Ships in 10 - 15 working days

Globalization imposes pressures on the traditional welfare state. This book examines these pressures, and responses to them, from the less familiar perspective of international law. The book deals with the role of the international level in securing or supplementing national welfare functions. Thus, the authors evaluate the role of international labour law, social rights as human rights, the World Trade Organisation, non-governmental organisations and international taxation law, in the effort to maintain and promote welfare rights and the welfare state. In addition, the functions of national migration law and of social security law are analysed in case studies.

Between Fragmentation and Democracy - The Role of National and International Courts (Hardcover): Eyal Benvenisti, George W.... Between Fragmentation and Democracy - The Role of National and International Courts (Hardcover)
Eyal Benvenisti, George W. Downs
R3,369 Discovery Miles 33 690 Ships in 10 - 15 working days

Between Fragmentation and Democracy explores the phenomenon of the fragmentation of international law and global governance following the proliferation of international institutions with overlapping jurisdictions and ambiguous boundaries. The authors argue that this problem has the potential to sabotage the evolution of a more democratic and egalitarian system and identify the structural reasons for the failure of global institutions to protect the interests of politically weaker constituencies. This book offers a comprehensive understanding of how new global sources of democratic deficits increasingly deprive individuals and collectives of the capacity to protect their interests and shape their opportunities. It also considers the role of the courts in mitigating the effects of globalization and the struggle to define and redefine institutions and entitlements. This book is an important resource for scholars of international law and international politics, as well as for public lawyers, political scientists, and those interested in judicial reform.

Criminal Jurisdiction over Armed Forces Abroad (Hardcover): Rain Liivoja Criminal Jurisdiction over Armed Forces Abroad (Hardcover)
Rain Liivoja; Foreword by Eyal Benvenisti
R3,568 Discovery Miles 35 680 Ships in 9 - 15 working days

Rain Liivoja explores why, and to what extent, armed forces personnel who commit offences abroad are prosecuted under their own country's laws. After clarifying several conceptual uncertainties in the doctrine of jurisdiction and immunities, he applies the doctrine to the extraterritorial deployment of service personnel. Comparing the law and practice of different states, the author shows the sheer breadth of criminal jurisdiction that countries claim over their service personnel. He argues that such claims disclose a discrete category of jurisdiction, with its own scope and rationale, which can be justified as a matter of international law. By distinguishing service jurisdiction as a distinct category, the analysis explains some of the peculiarities of military criminal law and also provides a basis for extending national criminal law to private military contractors serving the state. This book is essential for scholars and practitioners in international and criminal law, especially in military contexts.

The International Law of Occupation (Hardcover, 2nd Revised edition): Eyal Benvenisti The International Law of Occupation (Hardcover, 2nd Revised edition)
Eyal Benvenisti
R5,062 Discovery Miles 50 620 Ships in 10 - 15 working days

The law of occupation imposes two types of obligations on an army that seizes control of enemy land during armed conflict: obligations to respect and protect the inhabitants and their rights, and an obligation to respect the sovereign rights of the ousted government. In theory, the occupant is expected to establish an effective and impartial administration, to carefully balance its own interests against those of the inhabitants and their government, and to negotiate the occupation's early termination in a peace treaty. Although these expectations have been proven to be too high for most occupants, they nevertheless serve as yardsticks that measure the level of compliance of the occupants with international law.
This thoroughly revised edition of the 1993 book traces the evolution of the law of occupation from its inception during the 18th century until today. It offers an assessment of the law by focusing on state practice of the various occupants and reactions thereto, and on the governing legal texts and judicial decisions. The underlying thought that informs and structures the book suggests that this body of laws has been shaped by changing conceptions about war and sovereignty, by the growing attention to human rights and the right to self-determination, as well as by changes in the balance of power among states. Because the law of occupation indirectly protects the sovereign, occupation law can be seen as the mirror-image of the law on sovereignty. Shifting perceptions on sovereign authority are therefore bound to be reflected also in the law of occupation, and vice-versa.

Community Interests Across International Law (Hardcover): Eyal Benvenisti, Georg Nolte Community Interests Across International Law (Hardcover)
Eyal Benvenisti, Georg Nolte
R4,731 Discovery Miles 47 310 Ships in 10 - 15 working days

This book explores the extent to which contemporary international law expects states to take into account the interests of others - namely third states or their citizens - when they form and implement their policies, negotiate agreements, and generally conduct their relations with other states. It systematically considers the various manifestations of what has been described as 'community interests' in many areas regulated by international law and observes how the law has evolved from a legal system based on more or less specific consent and aimed at promoting particular interests of states, to one that is more generally oriented towards collectively protecting common interests and values. Through essays by experts in the field, this book explores topics such as the sources of international law and the institutional aspects of developing the law and covers a range of areas within the law.

The Impact of International Law on International Cooperation - Theoretical Perspectives (Paperback): Eyal Benvenisti, Moshe... The Impact of International Law on International Cooperation - Theoretical Perspectives (Paperback)
Eyal Benvenisti, Moshe Hirsch
R1,318 Discovery Miles 13 180 Ships in 10 - 15 working days

This 2004 book aims at advancing our understanding of the influences international norms and international institutions have over the incentives of states to cooperate on issues such as environment and trade. Contributors adopt two different approaches in examining this question. One approach focuses on the constitutive elements of the international legal order, including customary international law, soft law and framework conventions, and on the types of incentives states have, such as domestic incentives and reputation. The other approach examines specific issues in the areas of international environment protection and international trade. The combined outcome of these two approaches is an understanding of the forces that pull states toward closer cooperation or prevent them from doing so, and the impact of different types of international norms and diverse institutions on the motivation of states. The insights gained suggest ways for enhancing states' incentives to cooperate through the design of norms and institutions.

Sharing Transboundary Resources - International Law and Optimal Resource Use (Hardcover): Eyal Benvenisti Sharing Transboundary Resources - International Law and Optimal Resource Use (Hardcover)
Eyal Benvenisti
R3,307 Discovery Miles 33 070 Ships in 10 - 15 working days

Why do states often fail to cooperate, using transboundary natural resources inefficiently and unsustainably? Benvenisti examines the contemporary international norms and policy recommendations that could provide incentives for states to cooperate. His approach is multi-disciplinary, proposing transnational institutions for the management of transboundary resources. Although global water policy issues seem set to remain a cause for concern for the foreseeable future, this study provides a new approach to the problem of freshwater, and will interest international environmentalists and lawyers, international relations scholars and practitioners.
