Eigenkapitalvereinbarung (Basel II) des Baseler Ausschusses fur
Bankenaufsicht einschliesslich des dritten Konsultationspapiers von
Ende April 2003 ist der Ausgangspunkt der Diskussion um Ratings und
deren Auswirkungen auf das Kreditgewerbe und die
Projektentwicklungsunternehmen. In Zeiten zunehmender
Liberalisierung und Globalisierung der Markte sowie des technischen
Fortschritts hat sich an den Finanzmarkten in den letzten Jahren
ein Prozess tief greifender Veranderungen vollzogen, der sich auch
auf die traditionellen Bankgeschafte auswirkt. Angesichts der
gestiegenen Anzahl von Insolvenzen sowie der erhohten
Ausfallrisiken von Kreditengagements werden heute vermehrt
Anstrengungen unternommen um die Stabilitat der Finanzmarkte besser
abzusichern. Dabei steigen die Anforderungen an das Kredit- und
Risikomanagement von Banken und Unternehmen gleichermassen. Mit der
Weiterentwicklung des bankenaufsichtlichen Regelwerks (Basel I),
welches die Mindest-Eigenkapital-Unterlegung bei Banken bestimmt,
sollen nun die zunehmende Komplexitat und der steigende
Risikogehalt der Finanzgeschafte berucksichtigt werden. Dies hat
zur Folge, dass zukunftig die Hohe des erforderlichen
Eigenkapitals, welches Banken fur die von ihnen gewahrten Kredite
unterlegen mussen um den Verpflichtungen ihrer eigenen Glaubiger
nachkommen zu konnen, starker an den individuellen Risiken der
vergebenen Kredite orientiert sein wird. Als eine Konsequenz daraus
ruckt Basel II Ratings, die zukunftig die unterschiedliche Bonitat
der Kreditnehmer bestimmen sollen, in den Mittelpunkt der
Kreditvergabe. Kreditinstituten wird dabei die Wahl gestellt,
Agentur-Ratings zu verwenden oder bankinterne Ratings
