Reforming the Common Fisheries Policy (Hardcover): Jill Wakefield Reforming the Common Fisheries Policy (Hardcover)
Jill Wakefield
R3,542 Discovery Miles 35 420 Ships in 12 - 17 working days

This timely book provides a critical examination of the policies and laws governing EU marine fisheries and the shortcomings of the 2013 Common Fisheries Policy (CFP) reform. In particular it considers how reform is impeded by Treaty-guaranteed concessions, exemptions from general environmental legislation and the Court of the Justice's interpretation of principles unique to the sector. The author discusses how the damaging effects of fishing could be ameliorated if the Court were to align fishery values with general principles of the law, and considers the institutional and regulatory frameworks needed to encourage prudent resource use.The limited development of the CFP beyond the minimal requirements of international law is considered together with the role of the Court in sidelining scientific advice. The book provides a unique exploration of how these barriers to sustainability are compounded by regulatory capture and the public interest in fish resources being unrecognized. Ultimately, the author proposes that the incoherence of the management regime be redressed through market-based reforms and the application of the user-pays principle. This book will be of keen interest to lawyers, environmentalists, policy-makers and marine scientists who are interested in marine fishery management, marine environmental protection, and marine sector economic sustainability. It will also appeal to those involved in developing trans-disciplinary platforms to promote marine resource sustainability.

The Right to Good Administration (Hardcover): Jill Wakefield The Right to Good Administration (Hardcover)
Jill Wakefield
R5,740 Discovery Miles 57 400 Ships in 10 - 15 working days

Among the rights conferred on the citizens of Europe by the Charter of Fundamental Rights and Freedoms is the right to good administration. It is anticipated that the new Reform Constitutional Treaty will operate to make the Charter and its rights legally binding. This is the first time that any legal system has proclaimed such a right and then sought to constitutionalise it. Whether the right to good administration under the Charter represents a new right, and, if such a right exists, whether it varies according to whether the executive is mandated to control or steward, is the subject matter of this thoughtful, unblinkered book.Grounding her exposition in a deeply-informed engagement with relevant primary and secondary sources, the author exposes the serious difficulties and contradictions in the concept of the right to good administration. She demonstrates that the features of good administration cannot be fixed or fully enunciated, but are identified only when the conduct of the administration fails to reach an acceptable standard, a standard that varies over time and context. And in the modes of the concept most often embraced, such as the notion of citizen as consumer with marketplace choice, and the notion of consultation, a form of participatory democracy which privileges those individuals and communities who have the political sophistication to organize themselves and further marginalize large sectors of unorganized society; she finds a virtual denial of the democratic concept of citizen as sovereign, the creator of state power who can dictate the exact limits to be placed on personal autonomy. The extraordinary clarity and conviction of the author's approach is apparent in the details of her presentation, which include analysis of the following factors among others: the enforceable content of the right, including the role of the European Ombudsman; the relationship between good governance and good administration; the duties of the Commission as administrator; the uncertain reach of the concept of maladministration; damages in compensation actions as remedy for breach of good administration; pre-Charter principles of good administration as agreed in the Council of Europe and developed by the Courts; and the right of access to documentation, especially as it relates to the policy of language diversity. The final chapters examine the role of the right to good administration in the fraught contexts of competition law, Community finances, and the European environmental framework. This far-seeing study breaks new ground in the ever more politicized debate over the future of the European Union. As good administration is the mechanism by which the principles of good governance are to be delivered, the detailed attention given to this subject here is more than warranted. It is sure to be of exceptional value to all concerned with the development of an administrative institution of integrity and accountability in EU governance.

Judicial Protection through the Use of Article 288(2)EC (Hardcover): Jill Wakefield Judicial Protection through the Use of Article 288(2)EC (Hardcover)
Jill Wakefield
R6,407 Discovery Miles 64 070 Ships in 10 - 15 working days

The last decade has seen an evisceration of the once-dominant democratic legal concept of "public interest." Its place is being steadily usurped by a problematic "compensation culture" which, in an ostensible effort to protect the individual, is wreaking havoc with the principles of responsibility and liability that underlie the rule of law, especially in the commercial context. Nowhere is this troubling development more evident than in the jurisprudence surrounding Article 288(2)EC, which has grown from a measure of sanction against the Community Institutions for maladministration into a remedy for infraction or injury through the fault of those Institutions or, by extension, as a result of Member State breach of Community law. Judicial Protection in the EC is the first in-depth analysis of this "hot spot" in EC law. With prodigious scholarship and persuasiveness, the author investigates the relevant case law of the Court of Justice from the standpoint of the fundamental legal principles involved. She finds that the distinct problem of the accountability of the Community Institutions, so important where democratic controls are weak, has been subsumed to the responsibility to compensate. In her penetrating commentary she identifies an erosion of basic democratic principles and points the way to ensuring that policies claimed to be in the public interest actually serve that public interest. Cases examined in detail include the "Isoglucose" cases, Brasserie, Factortame, Schoppenstedt, Bergaderm, Loticke, and Eurocoton. The author refers extensively to the ECSC Treaty which, although it expires in July 2002, continues to provide significant authority for the interpretation of Article288(2)EC. This is an important book for all legal professionals interested not only in the development and future of European law, but in the currently prevailing global view of the principle of accountability from which the very use and practice of law derives.
