The World Court Digest, formerly "Fontes Iuris Gentium," continues
the series that has presented the decisions of the Permanent Court
of International Justice and its successor, the International Court
of Justice. The new volume includes the decisions up to 1990
presented in a slightly changed system to facilitate use by the
reader. The pronouncements which are of importance for
international law in the judgments and advisory opinions of the
Court, including separate and dissenting opinions, have been
systematically arranged and reproduced in English. The World Court
Digest provides the reader with a reliable means of access to the
decisions of the most important international judicial organ. The
volume includes a subject index as well as lists of the decisions
and judges.

1995. The pronouncements of the Court which are of importance for
international law in the judgments including separate and
dissenting opinions have been systematically arranged under
specific topics concerning substantive international law as well as
procedural international law. The World Court Digest provides the
reader with a reliable means of access to the decisions of the most
important international judicial organ concerning cases as
important as the Lockerbie-case; the question of the violation of
the genocide convention, of the nuclear test problem, to mention
only some of the most important issues.
33 Antragsgegner, eine miindliche oder schriftliche Stellungnahme
abzugeben, die innerhalb einer kurzen Frist vorzunehmen ist. Die
anderen Gerichte - Rustungskontrollgericht, MRK -Gerichtshof,
Zentralamerikanischer Gerichts- hof z. B. - sehen eine Zustellung
des Antrags nicht vor. Das aber nicht nur aus verfahrensfordernden
Gesichtspunkten, wie z. B. urn den bei der- artigen Verfahren im
innerstaatlichen Recht oft hervorgehobenen Ober- raschungseffekt zu
wahren 113, sondern aus anderen, sich aus der Sache er- gebenden
Grunden. Dag beim Zentralamerikanischen Gerichtshof eine der-
artige Magnahme nicht vorgesehen ist, mug, wie schon ofters
hervorgehoben, nicht auf einer Sachentscheidung beruhen, da dieses
Verfahren iiberhaupt keine nahere, positive Regelung erfahren hat.
Beim Rustungskontrollge- richt ergibt sich das Fehlen einer
Zustellung aus sachlichen Erwagungen, die allerdings dem sog.
Oberraschungseffekt nahestehen. Zusammenfassung Zusammenfassend
lagt sich sagen, dag die hier betrachteten internationalen Gerichte
und Schiedsgerichte in der Regel iibereinstimmende Vorschriften
beziiglich der Einleitung des Verfahrens vorsehen. Abweichungen
ergeben sich aus materiellen Grunden sowie bisweilen aus der
mangelnden Ausge- staltung des Verfahrens iiberhaupt 114.
