Mit Art. 102 Abs. 2 EGInsO ist ebenso wie mit Art. 4 Abs. 2 m in
Verbindung mit Art. 13 der Europaischen Insolvenzrechtsverordnung
fur Insolvenzanfechtungen bei grenzuberschreitenden Sachverhalten
eine sogenannte Kumulationsloesung normiert worden, wonach die
Insolvenzanfechtung des auslandischen Insolvenzverwalters sowohl
nach auslandischem als auch dem inlandischen Insolvenzrecht der
Anfechtung unterliegen muss. Die Kumulationsloesung, deren
Ausgestaltung in dem EGInsO gegenuber der entsprechenden Regelung
der EUInsVO unterschiedlich ausfallt und die bei deren Anwendung
sich stellenden Probleme, werden analysiert. Unter
Gegenuberstellung des deutschen und des englischen
Insolvenz(anfechtungs)rechts werden die Auswirkungen der
Kumulationsloesung am Beispiel England - Deutschland aufgezeigt.
