Efforts to moderate conflict are as old as conflict itself. Throughout the ages, restraint in warfare has been informed by religious and ethical considerations, chivalry and class, and, increasingly since the mid-19th century, a body of customary and treaty law variously referred to as the laws of war, the law of armed conflict (LOAC) or international humanitarian law (IHL). As they evolved from the mid-19th century, these laws were increasingly underpinned by humanitarianism, then in the mid-20th century, were assumed to be universal. But violations of these restraints are also as old as conflict itself. The history of conflict is replete with examples of exclusions from protections designed to moderate warfare. This edited volume explores the degree to which protections in modern warfare might be informed by notions of 'civility' and 'barbarism', or, to put it another way, asks if only those deemed to be civilised are afforded protections prescribed by the laws of war?
As well as promoting debates about liberal democracy, the dramatic events of 1989 also bought forth a powerful revival in the interest of the notion of civil society. This revival was reflected mainly in two broad tracts of literature. The first focused primarily on events surrounding the Solidarity movement in Poland and the tumultuous events of 1980-81. The second was concerned with the Velvet Revolutions more broadly. Following the events of 1989, there appeared a number of works sharing the common central argument that civil society played a key role in the overthrow of these Communist regimes in 1989. Killingsworth's book presents three broad arguments, all of which reject the way civil society has been applied in the analysis of opposition and dissent in totalitarian Czechoslovakia, the GDR and Poland. First, it argues that the totalitarian nature of Soviet-type regimes means that it was not possible for a genuine civil society to exist. Second, the civil society paradigm, as it has been applied to opposition and dissent in Soviet-type regimes in Eastern Europe, lacks analytical rigour. Thirdly, the book argues that the dominant liberal interpretation of dissenting opposition in Soviet-type regimes is politically and morally flawed.
In providing a counterweight to the notion that political violence has irrevocably changed in a globalised world, Violence and the state offers an original and innovative way in which to understand political violence across a range of discipline areas. It explores the complex relationship between the state and its continued use of violence through a variety of historical and contemporary case studies, including the Napoleonic Wars, Nazi and Soviet 'eliticide', the consolidation of authority in modern China, post-Soviet Russia, and international criminal tribunals. It also looks at humanitarian intervention in cases of organised violence, and the willingness of elites to alter their attitude to violence if it is an instrument to achieve their own ends. The interdisciplinary approach, which spans history, sociology, international law and International Relations, ensures that this book will be invaluable to a broad cross-section of scholars and politically engaged readers alike. -- .
