Competition Policy in Global Trading System (Hardcover): Clifford Jones, Mitsuo Matsushita Competition Policy in Global Trading System (Hardcover)
Clifford Jones, Mitsuo Matsushita
R6,048 Discovery Miles 60 480 Ships in 10 - 15 working days

Based on a conference of national authorities and leading scholars in antitrust and competition law and policy, Competition Policy in the Global Trading System: Perspectives from the EU, Japan and the USA presents twenty insightful essays which together provide an in-depth assessment of current achievements and impasses, as well as a variety of possible ways forward. Among the relevant factors in this progression, the authors discuss such approaches as:
- bilateral and regional international cooperation agreements;
- WTO competition rules, enforceable through the dispute resolution procedure; and
- international development of US, EU, and Japanese antitrust laws.

Mitsuo Matsushita, Thomas J. Schoenbaum
R5,118 Discovery Miles 51 180 Ships in 12 - 17 working days

This book seeks to answer the questions: how do the rules of international treaties on trade and investment apply to the new laws and policies relating to energy-related trade, and do the rules of the multilateral system contribute to or detract from sustainable development? An emerging set of new problems in the law of international trade is how to reconcile the rules of the multilateral trading system with shortages of certain natural resources and the necessity to develop renewable energy resources. The chapters in this book provide a comprehensive analysis of the international trade issues presented by national trade laws and policies with regard to natural resources and energy. This book is about the extent to which we are interpreting existing rules to cover emerging problems and how the rules of the multilateral trading system can be adapted to achieve sustainable development in natural resources and energy. The book begins with a survey of selected national laws relating to recent restrictions on the export of natural resources, both resources used to produce energy as well as natural resources essential for industrial production. After examining the range of such laws in selected important countries, we turn to the application of the rules of the multilateral trading system to such export restrictions. We discuss the major rules of the World Trade Organization (WTO) as well as the natural resources rules in selected regional preferential free trade agreements. While there is not a comprehensive global legal regime on competition law, we believe it is also important to examine how selected national competition laws impact export restrictions on natural resources. This book will be a major contribution to the international dialogue on international economic law issues with respect to trade in natural resources and energy.

The World Trade Organization - Law, Practice, and Policy (Hardcover, 3rd Revised edition): Mitsuo Matsushita, Thomas J.... The World Trade Organization - Law, Practice, and Policy (Hardcover, 3rd Revised edition)
Mitsuo Matsushita, Thomas J. Schoenbaum, Petros C. Mavroidis, Michael Hahn
R5,102 Discovery Miles 51 020 Ships in 12 - 17 working days

The WTO is one of the most important intergovernmental organizations in the world, yet the way in which it functions as an organization and the scope of its authority and power are still poorly understood. This comprehensively revised new edition of the acclaimed work by an outstanding team of WTO law specialists provides a complete overview of the law and practice of the WTO.
The authors begin with the institutional law of the WTO (such as the sources of law and remedies of the dispute settlement system), then tackle the principal substantive obligations of the WTO regime (including tariffs, quotas, and MFN). They then move on to consider unfair trade, regional trading arrangements, and developing countries. In its final section the book deals with the consequences of globalization: firstly, where free trade is seen to be incompatible with environmental protection and, secondly, where WTO law confronts legal regimes governing issues of competition and intellectual property.

Modern Japanese Law Series This new series has been established to provide scholars and practitioners with a library of books which deal with contemporary issues in Japanese law, particularly in areas of law which are of importance to the international business community. It will include books on Japanese labour law, the Law of Civil Procedure, Securities Regulation, and environmental law. Two volumes containing accurate and up-to-date translations of all the major Japanese Codes (Civil and Criminal) are planned for 1994. This book analyses the means by which the Japanese government regulates business activity, principally through the use of competition or anti-monopoly laws. These laws operate both within Japan and, to a lesser extent, beyond. The book also looks at legal aspects of industrial policy as well as the legal framework of foreign trade and investment in Japan. As such it goes to the very heart of industrial and commercial life in Japan, and will be of interest to all those who are involved in doing business with Japan, as well as to their legal and financial advisers.
