BigLaw - Money and Meaning in the Modern Law Firm (Paperback): Mitt Regan, Lisa H Rohrer BigLaw - Money and Meaning in the Modern Law Firm (Paperback)
Mitt Regan, Lisa H Rohrer
R992 Discovery Miles 9 920 Ships in 12 - 17 working days

The Great Recession intensified large law firms' emphasis on financial performance, leading to claims that lawyers in these firms were now guided by business rather than professional values. Based on interviews with more than 250 partners in large firms, Mitt Regan and Lisa H. Rohrer suggest that the reality is much more complex. It is true that large firm hiring, promotion, compensation, and termination policies are more influenced by business considerations than ever before and that firms actively recruit profitable partners from other firms to replace those they regard as unproductive. At the same time, law firm partners continue to seek the non-financial rewards of being members of a distinct profession and are sensitive to whether their firms are committed to providing them. Regan and Rohrer argue that modern firms responding effectively to business demands while credibly affirming the importance of non-financial professional values can create strong cultures that enhance their ability to weather the storms of the modern legal market.

National Security Intelligence and Ethics (Hardcover): Seumas Miller, Mitt Regan, Patrick F. Walsh National Security Intelligence and Ethics (Hardcover)
Seumas Miller, Mitt Regan, Patrick F. Walsh
R4,156 Discovery Miles 41 560 Ships in 12 - 17 working days

This volume examines the ethical issues that arise as a result of national security intelligence collection and analysis. Powerful new technologies enable the collection, communication and analysis of national security data on an unprecedented scale. Data collection now plays a central role in intelligence practice, yet this development raises a host of ethical and national security problems, such as privacy; autonomy; threats to national security and democracy by foreign states; and accountability for liberal democracies. This volume provides a comprehensive set of in-depth ethical analyses of these problems by combining contributions from both ethics scholars and intelligence practitioners. It provides the reader with a practical understanding of relevant operations, the issues that they raise and analysis of how responses to these issues can be informed by a commitment to liberal democratic values. This combination of perspectives is crucial in providing an informed appreciation of ethical challenges that is also grounded in the realities of the practice of intelligence. This book will be of great interest to all students of intelligence studies, ethics, security studies, foreign policy and international relations. Drone Strike-Analyzing the Impacts of Targeted Killing (Hardcover, 1st ed. 2022): Mitt Regan Drone Strike-Analyzing the Impacts of Targeted Killing (Hardcover, 1st ed. 2022)
Mitt Regan
R1,229 R1,069 Discovery Miles 10 690 Save R160 (13%) Ships in 9 - 15 working days

The intense debate over US targeted drone strikes outside war zones has been limited by the failure to review and assess a considerable body of quantitative research and qualitative material on the impacts of such strikes on terrorist groups and civilians. This book fills an important gap in the literature by conducting a careful and rigorous review of such evidence. It argues that decisions about the use of targeted strikes as a counterterrorism instrument, as well as legal and ethical evaluations of such use, must be informed by our best understanding of the insights that empirical evidence can provide on the effectiveness of strikes and the costs they impose on populations where they occur.

Between Crime and War - Hybrid Legal Frameworks for Asymmetric Conflict (Hardcover): Jens David Ohlin, Claire Finkelstein,... Between Crime and War - Hybrid Legal Frameworks for Asymmetric Conflict (Hardcover)

R3,185 Discovery Miles 31 850 Ships in 10 - 15 working days

The threat posed by the recent rise of transnational non-state armed groups does not fit easily within either of the two basic paradigms for state responses to violence. The civilian paradigm focuses on the interception of demonstrable immediate threats to the safety of others. The military paradigm focuses on threats posed by collective actors who pose a danger to the state's ability to maintain basic social order and, at times, the very existence of the state. While the United States has responded to the threat posed by non-state armed groups by using tools from both paradigms, it has placed substantially more emphasis on the military paradigm than have other states. While several reasons may contribute to this approach, one may be the assumption that a state must use each set of tools strictly according in accordance with the principles that underlie each paradigm. Implicit in this assumption may be the sense that the only alternative to the civilian paradigm is the unqualified military one. The chapters in this book suggest, however that we need not see the options as confined to this binary choice. It may be profitable to consider borrowing elements from each paradigm on some occasions to act more expansively than the conventional civilian paradigm allows, but less expansively than the conventional military paradigm would permit. At the same time, the mixing of the categories comes with its own ethical and legal risks that should be scrutinized.

Professional Responsibility - Problems and Materials (Hardcover, 14th Revised edition): Thomas D Morgan, John S. Dzienkowski,... Professional Responsibility - Problems and Materials (Hardcover, 14th Revised edition)
Thomas D Morgan, John S. Dzienkowski, Mitt Regan
R8,464 Discovery Miles 84 640 Ships in 12 - 17 working days

The 14th Edition of Professional Responsibility: Problems & Materials continues the traditions that have made this book a leader in its field for over 45 years. Built around problems, the book asks students to think about how they should behave in challenging, concrete settings. The 14th Edition remains flexible enough to use in an overview course and challenging enough to use in ethics courses focused on particular areas of practice. It comprehensively addresses the ABA Model Rules of Professional Conduct, but also deals with additional issues raised in the Restatement (Third): The Law Governing Lawyers and in state rules that illustrate different ways to regulate lawyer conduct. Perhaps most important, the 14th Edition keeps up with a rapidly-changing legal profession and with changes in lawyer regulation that respond to new developments. The book considers how the Covid-19 pandemic has changed the potential for virtual lawyer practice and increased tolerance of practice from outside a lawyer's licensing jurisdiction. It examines the protection of confidential client information in a world where potential hackers threaten lawyer data and it introduces forms of litigation finance that may revolutionize how firms handle cases. It expands coverage of lawyer counseling and responds to issues of diversity, and it deals with Utah's Regulatory Sandbox and Arizona's rule changes that, even now, let regulators see new forms of practice take shape and assess the risks and benefits of the possible new future. Since 1976, the authors of Professional Responsibility: Problems & Materials have helped students prepare to respond to professional challenges they will meet upon graduation, but also to understand how their profession and its challenges are changing. The new 14th Edition continues to meet those objectives.
