In this essay, we will see that the situation in Germany, the Netherlands, Belgium, the United Kingdom and Turkey differs significantly from the situation in the other states which are parties to the European Convention on Human Rights (ECHR). It is the aim of this text to provide lawyers in those countries with a short guidance as to how to approach both the European Court of Human Rights but also - and even more importantly - domestic courts with regard to this issue. In particular the high caseload of immigation law courts as well as a lack of knowledge about the Convention make it necessary for practising lawyers to be informed about the rights of their clients. This article is designed as a practical guide and first reference paper for lawyers to assess the prospect of cases dealing with rights of migrants. The first part of this article will deal with ratione loci of the ECHR and its fundamental jurisprudence focusing on the special issues appearing in the context of migration law. In the second part the right to a fair trial under Art. 6 ECHR will be addressed including recent rulings of the Court and fundamental questions regarding the administrative procedure of granting asylum. The final part will be dealing with the rights of asylum seekers in countries which did not ratify Protocol 7 and the consequences this fact entails.

The boolk is based on a presentation given by the author at Sorbonne University, Paris, and includes a large collection of background materials., abstract: About 5.4 million people have been killed in the wars in the Democratic Republic of Congo (D.R.C.), the former Zaire. 45,000 die every month and hundreds of thousands of women have been raped here in recent years. Wartime rapes are anything but new and have been employed not only to terrorize the population but also as weapon of genocide in Rwanda, Bosnia and Darfur. The Eastern Congolese provinces of North and South Kivu have been affected by particular gruesome acts of violence and thousands of victims suffer from rape-induced fistulae, ruptures of the walls which separate the victim's vagina from her rectum. According to UN staff and doctors in the region, all armed groups in the region are involved in rapes and despite the 2002 Pretoria Accord which put an official end to the war, attacks and rapes continue to this very day. Many survivors are forced out of their homes and their families abandoned and left to fend for themselves. Therefore, apart from medical treatment and psychological counseling, there is a strong demand for justice. But due to the weak position of women in Congolese society, justice is much harder to get by than medical treatment. Although the Congolese Penal Code and Military Penal Code penalize these crimes, the reaction by the Congolese government to the atrocities remains insufficient, making a solution based on Congolese criminal law unlikely. The practical application of the D.R.C.'s domestic laws is found wanting and the law does not have the deterrent effect which is required

While at first sight a change of paradigm in international law, or in any legal system, is not negative per se, the rules which collide with a truly effective and universal protection of HR through international law are the very rules which form the foundation for international peace and security, the primary reason for the existence of international law. While international peace and security require the stability provided by the Westphalian system, they can at the same time be endangered by massive violations of human rights. On the other hand can Human Rights only be enjoyed in times of peace while the Westphalian system can limit the effective and universal enforcement of Human Rights in cases in which the UN Security Council has failed to take action under Chapter VII. This short book is an attempt at reconciling these needs which are at times direct against each other, at times interlinked ones with a special focus on massive violations of human rights which are not being addressed effectively by the UN Security Council. Dieser Ausgleich darf sich nicht nur in zwischenstaatlichen Ausgleichsleistungen erschopfen sondern muss den einzelnen Men-schen, also auch die einzelnen Opfer von Kriegsverbrechen und gegebenenfalls auch deren Nachkommen, berucksichti-gen. Seit dem Ende des Kalten Krieges haben das humanitare Volkerrecht und das Volkerstrafrecht, hervorgerufen durch den Schock des Jugoslawienkrieges, zu einem Zeitpunkt an dem der grosse Ost-West-Konflikt beigelegt war, und der damit verbundenen Grausamkeiten, erneute Aufmerksamkeit erfahren. Der Schutz von Zivilpersonen ist eine der Hauptanliegen des modernen humanitaren Volkerrechts. Dieses ius in bello ist in seiner Anwendbarkeit unabhangig vom ius ad bellum, wel-ches die Frage nach der Rechtmassigkeit der Gewaltanwen-dung in zwischenstaatlichen Beziehungen im allgemeinen re-gelt, also das Ob" militarischer Gewaltanwendung, wahrend das ius in bello das Wie" der Gewaltanwendung limitiert. Die wesentliche Frage, die sich uns stellt ist aber nicht nur die Frage nach dem Schutz durch das Recht sondern nach der Entschadigung fur die Falle, in denen der rechtlich geforderte Schutz nicht gegeben war. Aufgrund der mit der Globalisierung einhergehenden Fragmentierung des Volkerrechts erscheint es durchaus moglich, dass spezielle haftungsrechtliche Regelungssysteme entstanden sind, welche sich bereits vom Korpus der allgemeinen volkerrechtlichen Haftungsregeln herausgelost haben. Wir werden zun chst die beiden PPP-Projekte betrachten, die bislang in der Bundesrepublik in Form von Konzessionen durchgef hrt worden sind bzw. aktuell laufen2 und sodann das Konzessionsmodell n her betrachten.
