Freilich bedeutet das nicht viel mehr, als einen Anfang: denn auBerordentlich hoch gesteckt ist ihr letztes Ziel, das noch kurzlich ERNST HEYMANN scharf umrissen haP. Von diesem zu erstrebenden Endpunkt, dem Aufbau einer allgemeinen Rechtslehre und einer Universalrechtsgeschichte, sind wir noch weit entfernt. Auf dem Wege zu ihm ist noch viel muhselige Kleinarbeit zu verrichten. Unzahlige Einzelfragen mussen geklart werden. SoIl ihre Untersuchung rechtsvergleichend wahrhaft fruchtbar sein, so muB sie sich, so eng auch das jeweils zu behandelnde Problem begrenzt scheinen mag, auf den Gesamtzusammenhang, in den es geh6rt, mit erstrecken und aus ihm die Antwort zu geben suchen, warum in einer Rechtsordnung eine gegebene Frage so und nicht anders geregelt ist. Solche rechtsvergleichende Betrachtung aber bringt eine kaum uber sehbare Fulle des Stoffes mit sich, der gegenuber man im Interesse des Fortschritts dem einzelnen Arbeiter innerhalb der Gesamtheit der Rechtsordnungen eine Begrenzung auf einen bestimmten Kreis ver wandter Rechte nicht wird versagen k6nnen."
