Moderne Strafrechtsgeschichte als Teil der juristischen Zeitgeschichte befasst sich mit der Rechtsentwicklung in unserer Rechtsepoche, d.h. im 19. bis 21. Jahrhundert. Aus einer Vorlesung hervorgegangen, bietet es eine anschauliche Darstellung des allmahlichen Vordringens inquisitorischer Strukturen vor allem in Italien, Frankreich und Deutschland im Zusammenspiel der Wissenschaft mit Gerichtspraxis und Gesetzgebung der erstarkenden absolutistischen Territorialstaaten. Die Textsammlung enthalt 18 strafrechtstheoretische Texte vom ausgehenden 18. Jahrhundert bis zur Gegenwart. Die italienische Strafrechtswissenschaft rezipiert schon seit einigen Jahrzehnten intensiv die deutsche Strafrechtswissenschaft; abgesehen von einer kurzen Phase zu Beginn des 20. Jahrhunderts handelt es sich hierbei jedoch uberwiegend um eine Einbahnstrasse. Die Textsammlung soll dazu beitragen, diesen Zustand zu andern, denn die italienische Strafrechtswissenschaft verdient auch die Beachtung der deutschen Seite. Da die Wahrnehmung haufig an Sprachbarrieren scheitert, werden die Texte in deutscher UEbersetzung prasentiert. Die Herausgeber hoffen daher ein in Deutschland noch wenig erschlossenes Feld aufzuhellen und einen ersten strafrechtshistorischen und -dogmatischen Vergleich der Entwicklungen zu ermoeglichen.
