This third edition of the modern classic Zweigert & Kötz's Introduction to Comparative Law is fully revised and updated, but its familiar structure and easy style remain the same. The book first discusses the nature of Comparative Law, its functions, aims, methods and history, then it surveys the main features of the major legal families of the world. In the second part it provides a model of comparative law in action, comparing, contrasting and evaluating the different approaches and solutions of the major legal systems. The second edition of An Introduction to Tort Law offers a clear
exposition to the rapidly developing law of tort in Britain. For
those coming to the subject for the first time it provides a
succinct and thoughtful overview; ideal as an introduction, it will
also be of use and interest to those engaged in the course or
completing it, for it pulls themes together, illustrates important
distinctions and provokes reflection on what has already been
learnt. Many of the areas subjected to analysis and discussion are
highly topical, such as the invasion of the privacy of celebrities,
and liability for medical mishaps and industrial diseases. On these
and many other subjects of relevance in modern society, Weir's
comments act as a springboard for further study and reflection, as
well as presenting an authoritative overview, enlivened by a
fascinating and critical commentary, of the present situation and
how we reached it. The second edition naturally includes recent
developments in tort law, the most significant of which is
doubtless the incorporation into English law of the European
Convention on Human Rights. This has not only affected the outcome
in a number of cases, but also brought about changes in our
vocabulary, interpretation of enactments, and treatment of
precedent, which are rather less easily documented.
This book is based closely on the lectures delivered by Tony Weir
in 1996 as part of the Clarendon Law lectures series sponsored by
Oxford University Press. It is an exciting and provocative book
which contains a number of controversial propositions, defended
with vigour by its author. The three lectures reproduced here deal
with liability in tort for intentionally inflicted economic loss.
They are characterized by a very unusual combination of bold
leading statements and multi-layered supporting analysis. There are
also useful Appendices containing full case transcripts of recent,
significant cases, including Millar v Bassey and de Voto v Pacific.
This book will be irresistible to all scholars of the law of tort,
and the author's reputation alone will ensure this book is
well-received.
In this book Franz Wieacker tells how legal thinking, writing and
teaching started in Europe and how it developed. He begins in the
High Middle Ages and describes how the Glossators laid down the
foundations by applying methodical criticism and exegesis to the
Digest of Justinian. As Reinhard Zimmermann's foreword shows,
Wieacker's way of telling the history of European legal thought
from its origins in medieval Bologna down to the present day and of
elucidating the intellectual conditions for its development is a
stunning achievement. One of the great strengths of the book lies
in its demonstration of the constant interaction between the
thinking of lawyers and the general philosophical ideas of their
time: between Scholasticism and medieval legal science, between the
enlightenment and the Law of Reason, between Classicism (and
Romanticism) and Savigny's Historical School of Law. It is hardly
surprising that so ambitious and erudite a work should have become
a classic since 1952, when it was first published in German. Now
Tony Weir's brilliant translation makes the seond and final edition
accessible to English-speaking scholars the world over.
