The Formation of Islamic Law (Hardcover, New Ed): Wael B. Hallaq The Formation of Islamic Law (Hardcover, New Ed)
Wael B. Hallaq
R6,886 Discovery Miles 68 860 Ships in 9 - 15 working days

The fourteen studies included in this volume have been chosen to serve several purposes simultaneously. At a basic level, they aim to provide a general - if not wholly systematic - coverage of the emergence and evolution of law during the first three and a half centuries of Islam. On another level, they reflect the different and, at times, widely divergent scholarly approaches to this subject matter. These two levels combined will offer a useful account of the rise of Islamic law not only for students in this field but also for Islamicists who are not specialists in matters of law, comparative legal historians, and others. At the same time, however, and as the Introduction to the work argues, this collection of distinguished contributions illustrates both the achievements and the shortcomings of paradigmatic scholarship on the formative period of Islamic law.

An Introduction to Islamic Law (Paperback): Wael B. Hallaq An Introduction to Islamic Law (Paperback)
Wael B. Hallaq
R908 Discovery Miles 9 080 Ships in 9 - 15 working days

The study of Islamic law can be a forbidding prospect for those entering the field for the first time. Wael Hallaq, a leading scholar and practitioner of Islamic law, guides students through the intricacies of the subject in this absorbing introduction. The first half of the book is devoted to a discussion of Islamic law in its pre-modern natural habitat. The second part explains how the law was transformed and ultimately dismantled during the colonial period. In the final chapters, the author charts recent developments and the struggles of the Islamists to negotiate changes which have seen the law emerge as a primarily textual entity focused on fixed punishments and ritual requirements. The book, which includes a chronology, a glossary of key terms, and lists of further reading, will be the first stop for those who wish to understand the fundamentals of Islamic law, its practices and history.

Law and Legal Theory in Classical and Medieval Islam (Hardcover, New Ed): Wael B. Hallaq Law and Legal Theory in Classical and Medieval Islam (Hardcover, New Ed)
Wael B. Hallaq
R5,327 Discovery Miles 53 270 Ships in 12 - 17 working days

These studies by Wael Hallaq represent an important contribution to our understanding of the neglected field of medieval Islamic law and legal thought. Spanning the period from the 8th to the 16th centuries, they draw upon a wide range of original sources to offer both fresh interpretations of those sources and a careful evaluation of contemporary scholarship. The first articles expound the interrelated issues of legal reasoning, legal logic and the epistemology of the law. There follows a set of primarily historical studies, which question a series of widely held assumptions, while the last items explore issues of legal theory and methodology. One particular topic concerns the role of Shafi'i as the 'master architect' of Islamic legal theory, and Professor Hallaq would finally argue that this image is in fact false and a creation of later centuries.

The Origins and Evolution of Islamic Law (Hardcover, New): Wael B. Hallaq The Origins and Evolution of Islamic Law (Hardcover, New)
Wael B. Hallaq
R1,905 Discovery Miles 19 050 Ships in 12 - 17 working days

Long before the rise of Islam in the early seventh century, Arabia had come to form an integral part of the Near East. This book, covering more than three centuries of legal history, presents an important account of how Islam developed its own law while drawing on ancient Near Eastern legal cultures, Arabian customary law and Quranic reforms. The development of the judiciary, legal reasoning and legal authority during the first century is discussed in detail as is the dramatic rise of prophetic authority, the crystallization of legal theory and the formation of the all-important legal schools. Finally the book explores the interplay between law and politics, explaining how the jurists and the ruling elite led a symbiotic existence that - seemingly paradoxically - allowed Islamic law and its application to be uniquely independent of the 'state'.

Shari'a - Theory, Practice, Transformations (Hardcover): Wael B. Hallaq Shari'a - Theory, Practice, Transformations (Hardcover)
Wael B. Hallaq
R3,783 Discovery Miles 37 830 Ships in 12 - 17 working days

In recent years, Islamic law, or Shari'a, has been appropriated as a tool of modernity in the Muslim world and in the West and has become highly politicised in consequence. Wael Hallaq's magisterial overview of Shari'a sets the record straight by examining the doctrines and practices of Islamic law within the context of its history, and by showing how it functioned within pre-modern Islamic societies as a moral imperative. In so doing, Hallaq takes the reader on an epic journey tracing the history of Islamic law from its beginnings in seventh-century Arabia, through its development and transformation under the Ottomans, and across lands as diverse as India, Africa and South-East Asia, to the present. In a remarkably fluent narrative, the author unravels the complexities of his subject to reveal a love and deep knowledge of the law which will inform, engage and challenge the reader.

Wael B. Hallaq is regarded as one of the leading scholars in the field of Islamic law. In a path-breaking new book, the author shows how authority guaranteed both continuity and change in Islamic law. While the role of the law schools in augmenting these processes was of the essence, the author demonstrates that it was the construction of the absolutist authority of the school founder, an image which he suggests was actually developed later in history, that maintained the foundations of school methodology and hermeneutics. The defence of that methodology gave rise to an infinite variety of individual legal opinions, ultimately accommodating changes in the law. Thus the author concludes that the mechanisms of change were embedded in the very structure of Islamic law, despite its essentially conservative nature. This book will be welcomed by specialists and scholars in Islamic law for its rigour and innovation.

Islamic Law and the Challenges of Modernity (Hardcover): Yvonne Yazbeck Haddad, Barbara Freyer Stowasser Islamic Law and the Challenges of Modernity (Hardcover)
Yvonne Yazbeck Haddad, Barbara Freyer Stowasser; Contributions by Wael B. Hallaq, Nathan J Brown, Adel Omar Sherif, …
R3,742 Discovery Miles 37 420 Ships in 10 - 15 working days

Since Europeans first colonized Arab lands in the 19th century, they have been pressing to have the area's indigenous laws and legal systems accord with Western models. Although most Arab states now have national codes of law that reflect Western influence, fierce internal struggles continue over how to interpret Islamic law, particularly in the areas of gender and family. From different geographical and ideological points across the contemporary Arab world, Haddad and Stowasser demonstrate the range of views on just what Islam's legal heritage in the region should be. For either law or religion classes, Islamic Law and the Challenges of Modernity provides the broad historical overview and particular cases needed to understand this contentious issue.

Ibn Taymiyya Against the Greek Logicians (Hardcover): Wael B. Hallaq Ibn Taymiyya Against the Greek Logicians (Hardcover)
Wael B. Hallaq
R5,403 Discovery Miles 54 030 Ships in 10 - 15 working days

The introduction of Greek philosophy into the Muslim world left an indelible mark on Islamic intellectual history. Philosophical discourse became a constant element in even traditionalist Islamic sciences. However, Aristotelian metaphysics gave rise to doctrines about God and the universe that were found highly objectionable by a number of Muslim theologians, among whom the fourteenth-century scholar Ibn Taymiyya stood foremost.

Ibn Taymiyya, one of the greatest and most prolific thinkers in medieval Islam, held Greek logic responsible for the `heretical' metaphysical conclusions reached by Islamic philosophers, theologians, mystics, and others. He therefore set out to refute philosophical logic, a task which culminated in one of the most devastating attacks ever levelled against the logical system upheld by the early Greeks, the later commentators, and their Muslim followers. His argument is grounded in an empirical approach that in many respects prefigures the philosophies of the British empiricists.

Professor Hallaq's translation, with a substantial introduction and extensive notes, makes this important work available to a wider audience for the first time.
