Euthanasia, Death with Dignity and the Law (Hardcover): Hazel Biggs Euthanasia, Death with Dignity and the Law (Hardcover)
Hazel Biggs
R3,017 Discovery Miles 30 170 Ships in 10 - 15 working days

Many advocates of euthanasia consider the criminal law to be an inappropriate medium to adjudicate the profound ethical and humanitarian dilemmas associated with end of life decisions. Euthanasia, Death with Dignity and the Law examines the legal response to euthanasia and end of life decisions and considers whether legal reform is an appropriate response to calls for euthanasia to be more readily available as a mechanism for providing death with dignity. Through an analysis of consent to treatment, living wills and autonomous medical decision making, euthanasia is carefully located within its legal, medical, and social contexts. This book focuses on the impact of euthanasia on the dignity of both the recipient and the practitioner while emphasizing the legal, professional, and ethical implications of euthanasia and its significance for the exercise of clinical discretion. It will provide a valuable addition to the euthanasia debate.

"Partly Laws Common to All Mankind" - Foreign Law in American Courts (Hardcover, New): Jeremy Waldron "Partly Laws Common to All Mankind" - Foreign Law in American Courts (Hardcover, New)
Jeremy Waldron
R2,192 Discovery Miles 21 920 Ships in 10 - 15 working days

Should judges in United States courts be permitted to cite foreign laws in their rulings? In this book Jeremy Waldron explores some ideas in jurisprudence and legal theory that could underlie the Supreme Court's occasional recourse to foreign law, especially in constitutional cases. He argues that every society is governed not only by its own laws but partly also by laws common to all mankind (ius gentium). But he takes the unique step of arguing that this common law is not natural law but a grounded consensus among all nations. The idea of such a consensus will become increasingly important in jurisprudence and public affairs as the world becomes more globalized.

Chris Wickham uncovers the interrelationships and collisions between different legal systems, and in doing so provides a new understanding of mentalities and power in the Italian city-state.

Private Property and Abuse of Rights in Victorian England - The Story of Edward Pickles and the Bradford Water Supply... Private Property and Abuse of Rights in Victorian England - The Story of Edward Pickles and the Bradford Water Supply (Hardcover)
Michael Taggart
R3,710 Discovery Miles 37 100 Ships in 10 - 15 working days

The leading case of The Mayor, Alderman and Burgesses of the Borough of Bradford v Pickles was the first to establish that it is not unlawful for a property owner to exercise his or her property rights maliciously and to the detriment of others, or the public interest. Though controversial at the time, today it is often invisible and taken for granted. This book explores why the common law, in contrast to civil law systems, developed in this way.

The Relationship between Roman and Local Law in the Babatha and Salome Komaise Archives - General Analysis and Three Case Studies on Law of Succession, Guardianship and Marriage (Hardcover)
Carolien Oudshoorn
R7,291 Discovery Miles 72 910 Ships in 18 - 22 working days

The discovery of the Babatha archive provided scholars with unique opportunities for reconstructing the life of Jews in second-century Arabia. Although legal issues and especially the question of the relationship between Roman and local law have received attention in a number of publications, this study presents the first complete overview of the legal situation as presented in the Babatha as well as the Salome Komaise archive, using references to law in the documents' texts as the key element for understanding what law is applicable to these documents. By distinguishing between two levels in the papyri, of substantive and of formal law, a new understanding is reached of the part both Roman and local law played in legal reality.

The Plural Practice of Adoption in Pacific Island States (Hardcover, 1st ed. 2019): Jennifer Corrin, Sue Farran The Plural Practice of Adoption in Pacific Island States (Hardcover, 1st ed. 2019)
Jennifer Corrin, Sue Farran
R3,661 Discovery Miles 36 610 Ships in 10 - 15 working days

This book deals with adoption laws and practices in small island developing states in the Pacific. It commences with an introductory chapter giving an overview of relevant laws and practices and pulling together the common themes and issues raised in the book. Each of the following chapters deals with adoption law and practice in a small South Pacific country. The countries in question all have plural legal systems, with systems of adoption and its closest customary law equivalent operating side by side. In most cases, there is an insufficiently developed relationship between the two systems, which has resulted in a number of problems. Additionally, international law adds another layer of complexity. Size and remoteness in the small states under discussion have a profound impact on local practices.

Peter Alldridge, Chrisje Brants
R3,674 Discovery Miles 36 740 Ships in 10 - 15 working days

This book contains original essays by a distinguished group of jurists from six different European countries confronting the increasing range of legal and philosophical issues arising from the relationship between privacy and the criminal law. The collection is particularly timely in light of the incorporation into English law of the European Convention on Human Rights. It compares legal cultures and underlying assumptions with regard to the private sphere, personal autonomy and the supposed justifications for State interference through criminalization and the implementation of substantive criminal law. The book moves from treatment of general ideas like the relationship between sovereignty, the nation-state and substantive criminal law in the new European context, (with its concomitant aspiration towards the establishment of transnational morality) to more detailed consideration of specific areas of substantive law and procedure, viewed from a range of perspectives. Areas considered include euthanasia, surrogacy, female genital mutilation and sado-masochism.

Courting Peril - The Political Transformation of the American Judiciary (Hardcover): Charles Gardner Geyh Courting Peril - The Political Transformation of the American Judiciary (Hardcover)
Charles Gardner Geyh
R1,745 Discovery Miles 17 450 Ships in 10 - 15 working days

The rule of law paradigm has long operated on the premise that independent judges disregard extralegal influences and impartially uphold the law. A political transformation several generations in the making, however, has imperiled this premise. Social science learning, the lessons of which have been widely internalized by court critics and the general public, has shown that judicial decision-making is subject to ideological and other extralegal influences. In recent decades, challenges to the assumptions underlying the rule of law paradigm have proliferated across a growing array of venues, as critics agitate for greater political control of judges and courts. With the future of the rule of law paradigm in jeopardy, this book proposes a new way of looking at how the role of the American judiciary should be conceptualized and regulated. This new, "legal culture paradigm" defends the need for an independent judiciary that is acculturated to take law seriously but is subject to political and other extralegal influences. The book argues that these extralegal influences cannot be eliminated but can be managed, by balancing the needs for judicial independence and accountability across competing perspectives, to the end of enabling judges to follow the "law" (less rigidly conceived), respect established legal process, and administer justice.

Judicial Decision-Making in a Globalised World - A Comparative Analysis of the Changing Practices of Western Highest Courts... Judicial Decision-Making in a Globalised World - A Comparative Analysis of the Changing Practices of Western Highest Courts (Hardcover, New)
Elaine Mak
R2,864 Discovery Miles 28 640 Ships in 10 - 15 working days

Why do judges study legal sources which originated outside their own national legal system, and how do they use arguments from these sources in deciding domestic cases? Based on interviews with judges, this book presents the inside story of how judges engage with international and comparative law in the highest courts of the United Kingdom, Canada, the United States, France and the Netherlands. A comparative analysis of the views and experiences of the judges clarifies how the decision-making of these Western courts has developed in light of the internationalisation of law and the increased opportunities for transnational judicial communication. While the qualitative analysis reveals the motives which judges claim for using foreign law and the influence of 'globalist' and 'localist' approaches to judging, the author also finds suggestions of a convergence of practices between the courts which are the subject of this study. This empirical analysis is complemented by a constitutional-theoretical inquiry into the procedural and substantive factors of legal evolution, which enable or constrain the development and possible convergence of highest courts' practices. The two strands of the analysis are connected in a final contextual reflection on the future development of the role of Western highest courts.

Imaginary Boundaries of Justice - Social and Legal Justice across Disciplines (Hardcover, New): Ronnie Lippens Imaginary Boundaries of Justice - Social and Legal Justice across Disciplines (Hardcover, New)
Ronnie Lippens
R3,341 Discovery Miles 33 410 Ships in 10 - 15 working days

It has become increasingly difficult to speak or even think social or legal justice in an age when words have left their moorings. Perhaps images are more stable than words; maybe images and imagery possess a certain viscosity, even a sensory quality, which prevents them from evaporating. This 'maybe' is what this book is about. The contributors to this collection explore the issue of how the Imaginary (images, imagery, imagination) has a role in the production and reproduction of 'visions' of legal and social justice. It argues that 'visions' of justice are inevitably bounded. Boundaries of 'visions' of justice, however, are also 'imaginary'. They emerge within imaginary spaces, and, as they are 'imaginary', they are inherently unstable. The book captures an emerging interest (in the humanities and social sciences) in images and the visual, or the Imaginary more broadly. This collection will appeal to scholars and students of social and legal theory, visual culture, justice and governance studies, media studies, and criminology.

Celebrating the Law - Rethinking Old Testament Ethics (Paperback, 2nd ed.): Hetty Lalleman Celebrating the Law - Rethinking Old Testament Ethics (Paperback, 2nd ed.)
Hetty Lalleman
R497 Discovery Miles 4 970 Ships in 18 - 22 working days

Christians often see the Old Testament law as out of date and irrelevant now that Christ has come. Lalleman rejects this view and makes the case for the ongoing importance of the Law in the Christian life something to celebrate. Most helpfully, Lalleman sets out a model for interpretating Old Testament laws in the context of the whole of the Bible. She interacts with the scholarly literature on the subject in a very readable way and provides some basic biblical principles for integrating the whole of God's word in our lives. Lalleman then fleshes out these principles by applying them to three difficult topics in Old Testament law food laws, the cancellation of debts, and warfare. At the heart of this celebration of the law, she contends, is the wholeness, holiness, and integrity of God himself.

The Common Law and English Jurisprudence, 1760-1850 (Hardcover): Michael Lobban The Common Law and English Jurisprudence, 1760-1850 (Hardcover)
Michael Lobban
R3,746 Discovery Miles 37 460 Ships in 10 - 15 working days

In this book, Michael Lobban argues that a proper understanding of English law and jurisprudence in the period is needed to clarify the nature of common-law practice and the way in which it was envisaged by its practitioners. He questions some commonly-accepted views of the nature of the common law itself and argues that attempts - notably those by Blackstone and Bentham - to expound or to criticize common law in essentially theoretical terms were mistaken. His approach is not a philosophically-based one, but he is concerned with the evolution and spread of judicial ideas which were grounded upon the work of moral and political philosophers, and makes a valuable corrective contribution to our historical understanding of a critically important period in legal history.

Thinking Like a Lawyer - Essays on Legal History and General History for John Crook on his Eightieth Birthday (Hardcover):... Thinking Like a Lawyer - Essays on Legal History and General History for John Crook on his Eightieth Birthday (Hardcover)
Barnes, Duncan Cloud, Hansen, John Henderson, Keith Hopwood, …
R4,721 Discovery Miles 47 210 Ships in 18 - 22 working days

This is a book about the law and life of Rome-in which contributors respond to John Crook's injunction to 'think like lawyers' by ranging as far as ancient Greece, ancient Persia and modern Denmark to expound their themes and draw comparisons. An opening section focuses on Civil Law, more or less as conventionally conceived, with chapters on the peculium, on municipal law at Irni in Roman Spain, on advisers of Roman provincial governors, and on violent crime. Roman perceptions of the physical and human worlds are the focus of a second section, and comparisons between Greek, Roman and modern ways of thinking about law and government come into the third section. In the final section, contributors argue the history of law and life from refractions of real and imagined Rome.

Foundations of Private Law - Property, Tort, Contract, Unjust Enrichment (Hardcover): James Gordley Foundations of Private Law - Property, Tort, Contract, Unjust Enrichment (Hardcover)
James Gordley
R3,738 Discovery Miles 37 380 Ships in 10 - 15 working days

Foundations of Private Law is a treatise on the Western law of property, contract, tort and unjust enrichment in both common law systems and civil law systems. The thesis of the book is that underlying these fields of law are common principles, and that these principles can be used to explain the history and development of these areas. These underlying common principles are matters of common sense, which were given their archetypal expression by older jurists who wrote in the Aristotelian tradition. These principles shaped the development of Western law but can resolve legal problems which these older writers did not confront.

A Law of Her Own - The Reasonable Woman as a Measure of Man (Hardcover): Caroline Forell, Donna Matthews A Law of Her Own - The Reasonable Woman as a Measure of Man (Hardcover)
Caroline Forell, Donna Matthews
R2,870 Discovery Miles 28 700 Ships in 18 - 22 working days

"Works such as A Law of Her Own expose the injustices in our society, provide different perspectives, and stimulate discussion. . . . Forell and Matthews' contribution to the debate should not be overlooked."
--"Law & Life"

Despite the apparent progress in women's legal status, the law retains a profoundly male bias, and as such contributes to the pervasive violence and injustice against women.

In A Law of Her Own, the authors propose to radically change law's fundamental paradigm by introducing a "reasonable woman standard" for measuring men's behavior. Advocating that courts apply this standard to the conduct of men-and women-in legal settings where women are overwhelmingly the injured parties, the authors seek to eliminate the victimization and objectification of women by dismantling part of the legal structure that supports their subordination.

A woman-based legal standard-focusing on respect for bodily integrity, agency, and autonomy-would help rectify the imbalance in how society and its legal system view sexual and gender-based harassment, rape, stalking, battery, domestic imprisonment, violence, and death.

Examining the bias of the existing "reasonable person" standard through analysis of various court cases and judicial decisions, A Law of Her Own aims to balance the law to incorporate women's values surrounding sex and violence.

Studies in Biblical Law - From the Hebrew Bible to the Dead Sea Scrolls (Hardcover): Gershon Brin Studies in Biblical Law - From the Hebrew Bible to the Dead Sea Scrolls (Hardcover)
Gershon Brin
R5,585 Discovery Miles 55 850 Ships in 10 - 15 working days

Gershon Brin examines the development of biblical law, suggesting that it may be due to different authors with different legal outlooks, or that the differing policies were required in response to different social needs, etc. Biblical laws appearing in the Dead Sea Scrolls literature are treated in a separate unit. Study of this subject can shed light both on the biblical laws as such, as well as on the manner of their reworking by the Judaean Desert sect. Brin also discusses here questions of the style, the idea, and the historical and ideological background underlying the reworking of these laws in Qumran. The second part of the book presents a comprehensive picture of the issues involved in the laws of the first-born, a subject that has legal, social and religious implications.

Studies in the Aramaic Legal Papyri from Elephantine (Hardcover): Yochanan Muffs Studies in the Aramaic Legal Papyri from Elephantine (Hardcover)
Yochanan Muffs; Contributions by Baruch A Levine
R4,260 Discovery Miles 42 600 Ships in 18 - 22 working days

Long recognized as a brilliant cross-cultural study, Yochanan Muffs' work analyzes the legal formulary of the Aramaic papyri from Elephantine, at the first cataract of the Nile, where a Persian garrison comprised of Jewish soldiers and their families lived throughout most of the 5th century B.C.E. These documents are of exceptional importance for the study of ancient Near Eastern law, and Muffs has investigated their formative background through extensive references to cuneiform law, by a method he calls "the Assyriological approach." Virtually every aspect of law-sale of land, marriage and family law, loans and credit, the taking of oaths, and the granting of bequests is studied in great depth and with unusual clarity. Muffs' work has enjoyed renewed interest in the light of more recent discoveries of Aramaic legal documents from later periods, as in the Judean Desert.
