Copyright Law and Translation - Access to Knowledge in Developing Economies (Paperback): Chamila Talagala Copyright Law and Translation - Access to Knowledge in Developing Economies (Paperback)
Chamila Talagala
R1,182 Discovery Miles 11 820 Ships in 12 - 17 working days

Arguing that the translation of scientific and technical learning materials, and the publication of these translations in a timely and affordable manner, is crucially important in promoting access to scientific and technical knowledge in the developing world, this book examines the relationship between copyright law, translation and access to knowledge. Taking Sri Lanka as a case study in comparison with India and Bangladesh, it identifies factors that have contributed to the unfavourable relationship between copyright law and the timely and affordable translation of scientific and technical learning materials, such as colonisation, international copyright law, the trade interests of the developing economies and a lack of expertise and general lack of awareness surrounding copyright law in the developing world. Highlighting the need to reform international copyright law to promote the needs and interests of developing countries such as Sri Lanka, the book points to a possible way forward for developing countries to achieve this and to address the problem of striking a proper and delicate balance in their copyright laws between the protection of translation rights and the ability of people to access translations of copyright protected scientific and technical learning materials.

Technology - New Trajectories in Law (Paperback): Penny Crofts, Honni Van Rijswijk Technology - New Trajectories in Law (Paperback)
Penny Crofts, Honni Van Rijswijk
R567 Discovery Miles 5 670 Ships in 12 - 17 working days

Placing contemporary technological developments in their historical context, this book argues for the importance of law in their regulation. Technological developments are focused upon overcoming physical and human constraints. There are no normative constraints inherent in the quest for ongoing and future technological development. In contrast, law proffers an essential normative constraint. Just because we can do something, does not mean that we should. Through the application of critical legal theory and jurisprudence to pro-actively engage with technology, this book demonstrates why legal thinking should be prioritised in emerging technological futures. This book articulates classic skills and values such as ethics and justice to ensure that future and ongoing legal engagements with socio-technological developments are tempered by legal normative constraints. Encouraging them to foreground questions of justice and critique when thinking about law and technology, the book addresses law students and teachers, lawyers and critical thinkers concerned with the proliferation of technology in our lives.

Sentencing - New Trajectories in Law (Paperback): Elaine A. O. Freer Sentencing - New Trajectories in Law (Paperback)
Elaine A. O. Freer
R572 Discovery Miles 5 720 Ships in 12 - 17 working days

This book examines the process and purpose of sentencing in the criminal justice system, beyond the confines of its legalistic aspects. Sentencing is the process that concludes any criminal trial that ends with the defendant being convicted, and any hearing in which a defendant pleads guilty. Those convicted of crime have been subject to sentencing as the method of imposing a punishment for their offences since the earliest existence of anything we would recognise as a criminal justice system. Yet the rationale behind sentencing, and the process by which it happens, has long been viewed through a traditional lens. In contrast, this book considers not just the process by which a Judge arrives at a numerical sentence of months in custody or the amount of a fine, but the wider meanings and effects of sentencing, as seen through the lens of various ideas of social justice. The book will appeal to students, academics, and legal practitioners who wish to consider a different perspective on the well-known and well-researched, but often shifting, area of sentencing.

Non-Governmental Organisations and the United Nations Human Rights System (Paperback): Fiona McGaughey Non-Governmental Organisations and the United Nations Human Rights System (Paperback)
Fiona McGaughey
R565 Discovery Miles 5 650 Ships in 12 - 17 working days

Non-governmental Organisations (NGOs) have become important, although sometimes overlooked, actors in international human rights law. Although NGOs are not generally provided for in the hard law of treaties, they use the UN human rights system to hold Governments to account. A key way in which they do so is using State reporting mechanisms, initially the UN treaty bodies, but more recently supplemented by the Human Rights Council's Universal Periodic Review. In doing so, NGOs provide information and contribute to developing recommendations. NGOs also lobby for new treaties, contribute to the drafting of these treaties, and bring individual's complaints to the UN human rights bodies. This book charts the historical development of the NGO role in the UN. It examines the UN regulation of NGOs but the largely informal nature of the role, and an exploration of the various types of NGOs, including some less benign actors such as GONGOs (Governmental NGOs). It also draws on empirical data to illustrate NGO influence on UN human rights bodies and gives voice to stakeholders both inside and outside the UN. The book concludes that the current UN human rights system is heavily reliant on NGOs and that they play an essential fact-finding role and contribute to global democratisation and governance.

Children, Human Rights and Temporary Labour Migration - Protecting the Child-Parent Relationship (Paperback): Rasika Jayasuriya Children, Human Rights and Temporary Labour Migration - Protecting the Child-Parent Relationship (Paperback)
Rasika Jayasuriya
R1,192 Discovery Miles 11 920 Ships in 12 - 17 working days

This book focuses on the neglected yet critical issue of how the global migration of millions of parents as low-waged migrant workers impacts the rights of their children under international human rights law. The work provides a systematic analysis and critique of how the restrictive features of policies governing temporary labour migration interfere with provisions of the Convention on the Rights of the Child that protect the child-parent relationship and parental role in children's lives. Combining social and legal research, it identifies both potential harms to children's well-being caused by prolonged child-parent separation and State duties to protect this relationship, which is deliberately disrupted by temporary labour migration policies. The book boldly argues that States benefitting from the labour of migrant workers share responsibility under international human rights law to mitigate harms to the children of these workers, including by supporting effective measures to maintain transnational child-parent relationships. It identifies measures to incorporate children's best interests into temporary labour migration policies, offering ways to reduce interferences with children's family rights. This book fills a gap that emerges at the intersection of child rights studies, migration research and existing literature on the purported nexus between labour migration and international development. It will be a valuable resource for academics, researchers and policymakers working in these areas. Wrongful Convictions and Forensic Science Errors - Case Studies and Root Causes (Paperback): John Morgan Wrongful Convictions and Forensic Science Errors - Case Studies and Root Causes (Paperback)
John Morgan
R1,836 Discovery Miles 18 360 Ships in 12 - 17 working days

Forensic Science Errors and Wrongful Convictions: Case Studies and Root Causes provides a rigorous and detailed examination of two key issues: the continuing problem of wrongful convictions and the role of forensic science in these miscarriages of justice. This comprehensive textbook covers the full breadth of the topic. It looks at each type of evidence, historical factors, system issues, organizational factors, and individual examiners. Forensic science errors may arise at any time from crime scene to courtroom. Probative evidence may be overlooked at the scene of a crime, or the chain of custody may be compromised. Police investigators may misuse or ignore forensic evidence. A poorly-trained examiner may not apply the accepted standards of the discipline or may make unsound interpretations that exceed the limits of generally accepted scientific knowledge. In the courtroom, the forensic scientist may testify outside the standards of the discipline or fail to present exculpatory results. Prosecutors may suppress or mischaracterize evidence, and judges may admit testimony that does not conform to rules of evidence. All too often, the accused will not be afforded an adequate defense-especially given the technical complexities of forensic evidence. These issues do not arise in a vacuum; they result from system issues that are discernable and can be ameliorated. Author John Morgan provides a thorough discussion of the policy, practice, and technical aspects of forensic science errors from a root-cause, scientific analysis perspective. Readers will learn to analyze common issues across cases and jurisdictions, perform basic root cause analysis, and develop systemic reforms. The reader is encouraged to assess cases and issues without regard to preconceived views or prejudicial language. As such, the book reinforces the need to obtain a clear understanding of errors to properly develop a set of effective scientific, procedural, and policy reforms to reduce wrongful convictions and improve forensic integrity and reliability. Written in a format and style accessible to a broad audience, Forensic Science Errors and Wrongful Convictions presents a root-cause analysis across all of these issues, supported by detailed case studies and a clear understanding of the scientific basis of the forensic disciplines.

Ethics and the Contemporary World (Paperback): David Edmonds Ethics and the Contemporary World (Paperback)
David Edmonds
R634 Discovery Miles 6 340 Ships in 9 - 15 working days

Arguments about ethics often centre on traditional questions of, for instance, euthanasia and abortion. Whilst these questions are still in the foreground, recent years have seen an explosion of new moral problems. Moral and political clashes are now as likely to be about sexuality and gender and the status of refugees, immigrants and borders, or the ethics of social media, safe spaces, disability and robo-ethics. How should we approach these debates? What are the issues at stake? What are the most persuasive arguments? Edited by best-selling philosophy author David Edmonds, Ethics and the Contemporary World assembles a star-studded line-up of philosophers to explore twenty-five of the most important ethical problems confronting us today. They engage with moral problems in race and gender, the environment, war and international relations, global poverty, ethics and social media, democracy, rights and moral status, and science and technology. Whether you want to learn more about the ethics of poverty, food, extremism, or artificial intelligence and enhancement, this book will help you understand the issues, sharpen your perspective and, hopefully, make up your own mind.

Regulating the Use of Force by United Nations Peace Support Operations - Balancing Promises and Outcomes (Paperback): Charuka... Regulating the Use of Force by United Nations Peace Support Operations - Balancing Promises and Outcomes (Paperback)
Charuka Ekanayake
R1,136 Discovery Miles 11 360 Ships in 9 - 15 working days

This Book attempts to deduce regulatory standards that can close the gaps between the Promises made and the Outcomes secured by the United Nations in relation to its use of force. It explores two broad questions in this regard: why the contemporary legal framework relevant to the regulation of force during Armed Conflict cannot close the gaps between the said Promises and Outcomes and how the 'Unified Use of Force Rule' formulated herein, achieves this. This is the first book to coherently analyse the moral as well as legal aspects relevant to UN use of force. UN peace operations are rapidly changing. Deployed peacekeepers are now required to use force in pursuance of numerous objectives such as self-defence, protecting civilians, and carrying out targeted offensive operations. As a result, questions about when, where, and how to use force have now become central to peacekeeping. While UN peace operations have managed to avoid catastrophes of the magnitude of Rwanda and Srebrenica for over two decades, crucial gaps still exist between what the UN promises on the use of force front, and what it achieves. Current conflict zones such as the Central African Republic, Eastern Congo, and Mali stand testament to this. This book searches for answers to these issues and identifies how an innovative mix of the relevant legal and moral rules can produce regulatory standards that can allow the UN to keep their promises. The discussion covers analytical ground that must be traversed 'behind the scenes' of UN deployment, well before the first troops set foot on a battlefield. The analysis ultimately produces a 'Unified Use of Force Rule', that can either be completely or partially used as a model set of Rules of Engagement by UN forces. This book will be immensely beneficial to law students, researchers, academics and practitioners in the fields of international relations, international law, peacekeeping, and human rights.

Linda Nielsen
R3,743 Discovery Miles 37 430 Ships in 12 - 17 working days

Myths and Lies About Dads: How They Hurt Us All is a groundbreaking book that destroys more than 100 of the most damaging beliefs about fathers. The Calling of Global Responsibility - New Initiatives in Justice, Dialogues and Planetary Realizations (Hardcover): Ananta... The Calling of Global Responsibility - New Initiatives in Justice, Dialogues and Planetary Realizations (Hardcover)
Ananta Kumar Giri
R3,759 Discovery Miles 37 590 Ships in 12 - 17 working days

This book rethinks and transforms the current discourse on globalization and global justice. It expands the idea of globalization from an economic or corporate context to mean humanization and planetary realizations - moving beyond the boundaries of nation-states and other human-made demarcations. The author challenges the notion of human primacy and makes a fervent call to reconfigure the paradigm of anthropocentrism. Through a careful study of movements for justice and inter-faith dialogue from across the world, the book makes a unique contribution to the emerging study of global responsibility. It also helps us overcome our current civilizational crises and cultivate a new civilization of planetary care and co-responsibility. Part of the Ethics, Human Rights and Global Political Thought series, the volume will be of great interest to scholars and researchers of law and society, especially social movements, political theory and philosophy.

The Business School Curriculum Debate - Scientific Legitimacy versus Practical Relevance (Hardcover): Alexander Styhre The Business School Curriculum Debate - Scientific Legitimacy versus Practical Relevance (Hardcover)
Alexander Styhre
R3,746 Discovery Miles 37 460 Ships in 12 - 17 working days

With more than 14,000 business schools worldwide, what is included in their curricula matters for how the economy and the corporate system are managed. Business schools should be subject to scholarly inquiries and critical reflection. While many studies of business schools examine its general role in the tertiary education system and in society more broadly, this volume examines how one specific theoretical perspective and a normative model derived therefrom were developed and gradually appropriated within the business school setting. This volume demonstrates that agency theory, based on a daring conjecture that firms can be construed as bundles of contacts, rose to prominence in the business school context. It examines how the elementary proposition of agency theory, that the firm is to be considered theoretically and practically as a "nexus of contracts," was never consistent with corporate law and contract law, and it was empirically unsubstantiated. Business schools are under pressure to teach not only practically useful theories and models, but also theories that are also scientifically qualified. Despite having this ambition, certain theories are widely taught despite failing to live up to such declared ambitions, which means that business schools may be criticized for including theories on ambiguous grounds in the curricula. This book examines how business schools seek to honour the ambition to teach both scientifically verified theories and practically useful concepts and models, and how the tensions derived from this duality may be problematic to handle. It will be of interest to researchers, academics, and advanced students in the fields of management education, organizational studies, and legal theory.

Can War Be Justified? - A Debate (Hardcover): Jennifer Kling, Andrew Fiala Can War Be Justified? - A Debate (Hardcover)
Jennifer Kling, Andrew Fiala
R3,761 Discovery Miles 37 610 Ships in 12 - 17 working days

Can war be justified? Pacifists answer that it cannot; they oppose war and advocate for nonviolent alternatives to war. But defenders of just war theory argue that in some circumstances, when the effectiveness of nonviolence is limited, wars can be justified. In this book, two philosophers debate this question, drawing on contemporary scholarship and new developments in thinking about pacifism and just war theory. Andrew Fiala defends the pacifist position, while Jennifer Kling defends just war traditions. Fiala argues that pacifism follows from the awful reality of war and the nonviolent goal of building a more just and peaceful world. Kling argues that war is sometimes justified when it is a last-ditch, necessary effort to defend people and their communities from utter destruction and death. Pulling from global traditions and histories, their debate will captivate anyone who has wondered or worried about the morality of political violence and military force. Topics discussed include ethical questions of self-defense and other-defense, the great analogy between individuals and states, evolving technologies and methods of warfighting, moral injury and post-traumatic stress disorder, broader political and communal issues, and the problem of regional security in a globalizing world. The authors consider cultural and religious issues as well as the fundamental question of moral obligation in a world saturated in military conflict. The book was written in the aftermath of the war on terrorism and includes reflection on lessons learned from the past decades of war, as well as hopes for the future in light of emerging threats in Europe and elsewhere. The book is organized in a user-friendly fashion. Each author presents a self-contained argument, which is followed by a series of responses, replies, and counter-arguments. Throughout, the authors model civil discourse by emphasizing points of agreement and remaining areas of disagreement. The book includes reader-friendly summaries, a glossary of key concepts, and suggestions for further study. All of this will help students and scholars follow the authors' dialogue so they may develop their own answer to the question of whether war can be justified. Key Features Summarizes the debate between pacifism and just war theory Considers historical and traditional sources as well as contemporary scholarship and applications Models philosophical dialogue and civil discourse, while seeking common ground Discusses issues of concern in contemporary warfighting and peacemaking, while offering an analysis of the war on terrorism

The Sex Offender Register - Politics, Policy and Public Opinion (Paperback): Terry Thomas, Daniel Marshall The Sex Offender Register - Politics, Policy and Public Opinion (Paperback)
Terry Thomas, Daniel Marshall
R1,334 Discovery Miles 13 340 Ships in 9 - 15 working days

The Sex Offender Register examines the origins, history, structure and legalities of the UK sex offender register, and explores how political and public opinion has influenced the direction the policy of registration has taken. Delving into the origins of the UK sex offender register and how the registration policy has evolved, this book provides an understanding of the register and its contribution to public protection while attempting to see the register as a policy that has grown and developed and as having an organic life of its own. The sex offender register is designed as a form of public protection rather than a punishment, requiring offenders to notify the police of their circumstances and to accept a degree of offender management from the police. The book: * puts the development of the register in its political, social and ethical context * considers the position of children and young people as offenders * outlines the movement of registered offenders across international borders * analyses how offenders can be removed from the register * explores how other countries in the UK manage sex offenders through registers * asks questions about the efficacy of the register and what contribution it makes to public protection * looks at specific aspects of registration including the management of information * delves into the experience of life on the register * examines the influence of public opinion * discusses the role of the police as custodians of the register and as offender managers. Exploring the different pressures brought to bear on the register, this book provides an authoritative starting point for police officers, social workers, probation officers, magistrates, students of Criminology, Criminal Justice and Policing, and the general reader wanting to understand where the UK sex offender register originated from and how it operates today.

Music in Crime, Resistance, and Identity (Hardcover): Eleanor Peters Music in Crime, Resistance, and Identity (Hardcover)
Eleanor Peters
R3,757 Discovery Miles 37 570 Ships in 12 - 17 working days

This book considers the intersection of music, politics and identity, focusing on music (genres) across the world as a form of political expression and protest, positive identity formations, but also how the criminalisation, censuring, policing and prosecution of musicians and fans can occur. All-encompassing in this book is analyses of the unique contribution of music to various aspects of human activity through an international, multi-disciplinary approach. The book will serve as a starting point for scholars in those areas where there has been an uncertain approach to this subject, while those from disciplines with a more established canon of music analysis will be informed about what each perspective can offer. The approach is international and multi-disciplinary, with the contributing authors focusing on a range of countries and the differing social and cultural impact of music for both musicians and fans. Academic disciplines can provide some explanations, but the importance of the contribution of practitioners is vital for a fully rounded understanding of the impact of music. Therefore, this book takes the reader on a journey, beginning with theoretical and philosophical perspectives on music and society, proceeding to an analysis of laws and policies, and concluding with the use of music by educational practitioners and the people with whom they work. This book will appeal to students and scholars in subjects such as sociology, criminology, cultural studies, and across the wider social sciences. It will also be of interest to practitioners in youth justice or those with other involvement in the criminal justice system.

Transitional Justice in Aparadigmatic Contexts - Accountability, Recognition and Disruption (Hardcover): Tine Destrooper,... Transitional Justice in Aparadigmatic Contexts - Accountability, Recognition and Disruption (Hardcover)
Tine Destrooper, Kerstin Bree Carlson, Line Engbo Gissel
R3,758 Discovery Miles 37 580 Ships in 12 - 17 working days

This book explores the practical and theoretical opportunities as well as the challenges raised by the expansion of transitional justice into new and 'aparadigmatic' cases. The book defines transitional justice as the pursuit of accountability, recognition and/or disruption and applies an actor-centric analysis focusing on justice actors' intentions of and responses to transitional justice. It offers a typology of different transitional justice contexts ranging from societies experiencing ongoing conflict to consolidated democracies, and includes chapters from all types of aparadigmatic contexts. This covers transitional justice in states with contested political authority, shared political authority, and consolidated political authority. The transitional justice initiatives explored by the wide range of contributors are those of Afghanistan, Belgium, France, Greenland/Denmark, Libya, Syria, Turkey/Kurdistan, UK/Iraq, US, and Yemen. Through these aparadigmatic case studies, the book develops a new framework that, appropriate to its expanding reach, allows us to understand the practice of transitional justice in a more context-sensitive, bottom-up, and actor-oriented way, which leaves room for the complexity and messiness of interventions on the ground. The book will appeal to scholars and practitioners in the broad field of transitional justice, as represented in law, criminology, politics, conflict studies and human rights.

Access and Control in Digital Humanities (Paperback): Shane Hawkins Access and Control in Digital Humanities (Paperback)
Shane Hawkins
R1,138 Discovery Miles 11 380 Ships in 9 - 15 working days

Access and Control in Digital Humanities explores a range of important questions about who controls data, who is permitted to reproduce or manipulate data, and what sorts of challenges digital humanists face in making their work accessible and useful. Contributors to this volume present case studies and theoretical approaches from their experience with applications for digital technology in classrooms, museums, archives, in the field and with the general public. Offering potential answers to the issues of access and control from a variety of perspectives, the volume acknowledges that access is subject to competing interests of a variety of stakeholders. Museums, universities, archives, and some communities all place claims on how data can or cannot be shared through digital initiatives and, given the collaborative nature of most digital humanities projects, those in the field need to be cognizant of the various and often competing interests and rights that shape the nature of access and how it is controlled. Access and Control in Digital Humanities will be of interest to researchers, academics and graduate students working in a variety of fields, including digital humanities, library and information science, history, museum and heritage studies, conservation, English literature, geography and legal studies.
