We need a world trade organization. We just don't need the one that we have. By pitching unequally matched states together in chaotic bouts of negotiating the global trade governance of today offers - and has consistently offered - developed countries more of the economic opportunities they already have and developing countries very little of what they desperately need. This is an unsustainable state of affairs to which the blockages in the Doha round provide ample testimony. So far only piecemeal solutions have been offered to refine this flawed system. Radical proposals that seek to fundamentally alter trade governance or reorient its purposes around more socially progressive and egalitarian goals are thin on the ground. Yet we eschew deeper reform at our peril. In What's Wrong with the World Trade Organization and How to Fix It Rorden Wilkinson argues that without global institutions fit for purpose, we cannot hope for the kind of fine global economic management that can put an end to major crises or promote development-for-all. Charting a different path he shows how the WTO can be transformed into an institution and a form of trade governance that fulfils its real potential and serves the needs of all.
This is a book about the constitutionalization of the World Trade Organization, and the contemporary development of institutional forms and democratic ideas associated with constitutionalism within the world trading system. It is about constitutionalization enthusiasts who promote institutions, management techniques, rights discourse and quasi-judicial power to construct a constitution for the WTO. It is about constitutional skeptics who fear the effect the phenomenon of constitutionalization is having on the autonomy of states, the capacity of the WTO to consider non-economic and non-free-trade goals, and democratic processes at the WTO and within the nation-state. The aim of the study, then, is to disentangle debates about the various meanings of the term 'constitution' when it used to apply to the World Trade Organization, and to reflect upon the significance of those meanings for more general international law conceptions of constitutions. Cass argues that the WTO is not and should not be described as a constitution, either by the standards of any received account of that term, or by the lights of any of the current WTO models. Under these definitions serious issues of legitimacy, democracy and community are at stake. The WTO would lack a proper political structure to balance the work of its judicial bodies; it may curtail the ability of states to decide matters of national economic interest; it lacks authorization by a coherent political community; and, it risks an emphasis upon economic goals and pure free trade over other, equally important, social values. Instead, Cass argues that what is needed is a constitutionalized WTO which considers the economic development needs of states and takes account of the skewed playing field of international trade and its effect on the economic prospects of developing countries. In short, trading democracy, legitimacy and community and not trading constitutionalization, are the biggest challenges facing the WTO.
Can transnational corporations ignore human rights as long as
governments don't hold them accountable? If the UN is put in charge
of a territory, is it bound by human rights law? Under traditional
approaches to human rights, non-state actors cannot be parties to
the relevant treaties and so they are only bound to the extent that
obligations accepted by States can be applied to them by
governments. This situation threatens to make a mockery of much of
the international system of accountability for human rights
violations. The contributors to this volume examine the different
approaches that might be taken in order to ensure some degree of
accountability. Making space in the legal regime to take account of
the role of non-State actors is one of the biggest and most
critical challenges facing international law today.
This second edition of C. F. Amerasinghe's successful book, which covers the institutional aspects of the law of international organizations, has been revised to include a new chapter on judicial organs of international organizations, as well as a considerably developed chapter on dispute settlement. Amerasinghe examines the local remedies rule in terms of both historical and modern international law. He considers both the customary international law and the application of the rule to, among others, human rights protection and international organizations. New material includes bilateral investment treaties and estate contracts. The book adheres to the requirement of juristic exposition and analysis where the law has been determined but also offers criticisms and suggestions for improving the law in the light of modern policy considerations.
The study of global governance has often led separate lives within the respective camps of International Political Economy and Foucauldian Studies. The end of the Cold War demonstrated the historical possibility of peaceful change and seemingly showed the superiority of non-realist approaches in International Relations. Yet in the post-Cold War period many European countries have experienced a resurgence of a distinctively realist tradition: geopolitics. Geopolitics is an approach which emphasizes the relationship between politics and power on the one hand; and territory, location and environment on the other. This comparative study shows how the revival of geopolitics came not despite, but because of, the end of the Cold War. Disoriented in their self-understandings and conception of external roles by the events of 1989, many European foreign policy actors used the determinism of geopolitical thought to find their place in world politics quickly. The book develops a constructivist methodology to study causal mechanisms and its comparative approach allows for a broad assessment of some of the fundamental dynamics of European security.
This book focuses on the concept of state responsibility for international crimes which gained support following the First World War, but was pushed into the background by the development of the principle of individual criminal responsibility under international law after the Second World War. The concept became the topic of debate and controversy upon its inclusion in Part I of the United Nations International Law Commission's Draft Articles on State Responsibility adopted on first reading in 1980. The book considers the history and merits of a concept which, it is argued, is currently on the threshold between lex ferenda and lex lata and has a place and an existence in international law independent from the Draft Articles on State Responsibility.

Preventing Torture comprises a documentary and empirical study - of a kind rare in the field of international human rights law - of the European Convention for the Prevention of Torture and the work of the Committee (the CPT) established under it. The authors chart the international human rights background to the Convention (including the historical and contemporary use of torture), describe the travaux préparatoires, analyse the composition and modus operandi of the Committee and set the standards formulated and applied by the CPT against those developed by other human rights bodies. They also assess, on the basis of visits throughout Europe, the reactions to the Committee's work in member states and consider the implications of an enlarged Council of Europe for the CPT in the future.
There has been considerable interest in recent years in the ability of non-governmental organisations to work with the rural poor in developing countries in order to improve their quality of life and economic status through the provision of credit, skills training, and other inputs for income-generation programmes. This book brings together the results of 16 evaluations in 4 countries (Bangladesh, India, Uganda, and Zimbabwe) to provide a detailed assessment of the contribution that NGOs make to rural poverty alleviation. The results indicate that NGO projects are successful when they build in a high degree of participation, when the staff are committed to the goals of the project, and when they are managed by strong and competent leaders. Many of the projects studied contributed to increases in income and welfare. However, not all projects were successful, contrary to received wisdom about the efficacy of NGO interventions. many failed to reach the very poorest, most were costly to implement, and few of the projects demostrated an ability to continue once external funding was withdrawn. These findingd provide string support for viewing NGOs as a mechanism for helping to reduce rural poverty, but also demonstrate that many of the interventions are isolated or one-off. The impact of NGOs could be heightened by increasing the size of the intervention, encouraging greater cooperation among NGOs, and by fostering closer cooperation with governments. This study will make an impact in the development community, and its conclusions will help shape NGO and poverty agendas in the coming years. The book will appeal to all those concerned with rural development, NGOs, and development programmes.
The Human Rights Committee is charged with the task of monitoring the implementation of the International Covenant on Civil and Political Rights. Since its inception it has arguably become the most important independent international human rights body in the world. Through the consideration of State Reports, from over half of the world community, and the examination of communications submitted by individuals (under the Optional Protocol to the Covenant), the Human Rights Committee seeks to establish a universal human rights jurisprudence. This book analyses the institutional characteristics of the Human Rights Committee, how it has developed its practices and procedures under the Covenant and the Optional Protocol, and analyses the jurisprudence of the Committee under selected key articles of the Covenant.
Why do international organizations (IOs) look so different, yet so similar? The possibilities are diverse. Some international organizations have just a few member states, while others span the globe. Some are targeted at a specific problem, while others have policy portfolios as broad as national states. Some are run almost entirely by their member states, while others have independent courts, secretariats, and parliaments. Variation among international organizations appears as wide as that among states. This book explains the design and development of international organization in the postwar period. It theorizes that the basic set up of an IO responds to two forces: the functional impetus to tackle problems that spill beyond national borders and a desire for self-rule that can dampen cooperation where transnational community is thin. The book reveals both the causal power of functionalist pressures and the extent to which nationalism constrains the willingness of member states to engage in incomplete contracting. The implications of postfunctionalist theory for an IO's membership, policy portfolio, contractual specificity, and authoritative competences are tested using annual data for 76 IOs for 1950-2010. The failure of the Seattle trade ministerial in December 1999 to launch a new round of multilateral trade negotiations dealt a major blow to the World Trade Organization (WTO). Do governments seeking to collaborate in such international organizations as the United Nations and the World Bank ever learn to improve the performance of those organizations? Can international organizations be improved by a deliberate institutional design that reflects lessons learned in peacekeeping, the protection of human rights, and environmentally sound economic development? In this work, Amrita Narlikar argues that, contrary to common assumption, modern-day politics displays a surprising paradox: poverty - and the powerlessness with which it is associated - has emerged as a political tool and a formidable weapon in international negotiation. The success of poverty narratives, however, means that their use has not been limited to the neediest. Focusing on behaviours and outcomes in a particularly polarising area of bargaining - international trade - and illustrating wider applications of the argument, Narlikar shows how these narratives have been effectively used. Yet, she also sheds light on how indiscriminate overuse and misuse increasingly run the risk of adverse consequences for the system at large, and devastating repercussions for the weakest members of society. Narlikar advances a theory of agency and empowerment by focusing on the life-cycles of narratives, and concludes by offering policy-relevant insights on how to construct winning and sustainable narratives.
