This book provides a practice-based analysis of European Union (EU) diplomacy and community-building. Unlike studies focusing on how EU community-building proceeds centrally in Brussels, this book turns to EU diplomacy in its bordering state of Ukraine. At a time when the EU's internal cohesion is being put to the test, this book provides novel insights into how feelings of belonging are produced amongst its members in the absence of a homogenous 'we'. Transcending the traditional dichotomy between macro-structures and micro-processes of interaction, the book demonstrates that the EU's large-scale community depends for its existence on practical instantiations of community-building in distinct 'communities of practice'. Using the case of an EU diplomatic 'community of practice' in Kyiv, Ukraine, takes these questions to the EU's margins, highlighting that the boundaries of community are key sites in which community materialises. The in-depth case study identifies diplomats' 'boundary work' as the constitutive rule that makes the local 'community of practice' cohere and create feelings of belonging to the large-scale polity of the EU. This book will be of interest to researchers of European studies, as well as to those working on global cooperation and international relations more broadly.

This book examines the role of the EU in ensuring privacy and data protection on the internet. It describes and demonstrates the importance of privacy and data protection for our democracies and how the enjoyment of these rights is challenged by, particularly, big data and mass surveillance. The book takes the perspective of the EU mandate under Article 16 TFEU. It analyses the contributions of the specific actors and roles within the EU framework: the judiciary, the EU legislator, the independent supervisory authorities, the cooperation mechanisms of these authorities, as well as the EU as actor in the external domain. Article 16 TFEU enables the Court of the Justice of the EU to play its role as constitutional court and to set high standards for fundamental rights protection. It obliges the European Parliament and the Council to lay down legislation that encompasses all processing of personal data. It confirms control by independent supervisory authorities as an essential element of data protection and it gives the EU a strong mandate to act in the global arena. The analysis shows that EU powers can be successfully used in a legitimate and effective manner and that this subject could be a success story for the EU, in times of widespread euroskepsis. It demonstrates that the Member States remain important players in ensuring privacy and data protection. In order to be a success story, the key stakeholders should be prepared to go the extra mile, so it is argued in the book. The book is based on academic research for which the author received a double doctorate at the University of Amsterdam and the Vrije Universiteit Brussels. It builds on a long inside experience within the European institutions, as well as within the community of data protection and data protection authorities. It is a must read in a time where the setting of EU privacy and data protection is changing dramatically, not only as a result of the rapidly evolving information society, but also because of important legal developments such as the entry into force of the General Data Protection Regulation. This book will appeal to all those who are in some way involved in making this regulation work. This book analyses why the Ukrainian state established asylum laws and policies in the thirty years since 1991, even though the number of asylum seekers was very low. International and non-governmental organisations transferred international asylum norms to Ukraine. Various state and non-state actors participated in this process, translating, spreading, and resisting those norms. In many cases, legislative adoption was driven by domestic politicians' pursuit of recognition by international organisations, such as the European Union and the Council of Europe, and by their desire to meet conditionality requirements. NGOs sought to influence administrative practices, alternating between confrontational and conciliatory, formal and informal approaches, and often relying on personal contacts. Actors used and shifted between scales in order to transfer norms or resist transfer. In the process, they produced, renegotiated, and confirmed those scales. For instance, NGOs resorting to the European Court of Human Rights to prevent refoulement placed the European scale above the national scale. This book offers a new multi-actor and multi-scalar analysis of policy transfer.
The face of international politics has changed significantly in the 21st century: it has become increasingly female. Whether that includes women in multilateral meetings, global conferences and embassies, or women at the UN and one of its many agencies in the field, it is apparent that women are accessing leadership positions in a variety of areas. This book investigates the development of gender equality at the United Nations by analyzing women in leadership roles. This introduction of empirical feminism to the study of international organizations applies what is known about women's participation and representation in comparative politics and gender studies to the United Nations System. It traces women's access to leadership roles, and explains where and why a range of hurdles prevent women from participating in the work of the UN. In doing so, it offers insights into recruitment and human resources practices and their politics, and into leadership by bureaucratic actors.
This book explores the everyday practices of border control and implementation of mobility policy in the European Schengen area by analyzing consular visas services on the edges of the territory. Using an original case study, private contractors that implement EU visa policy on governments' behalf, the author focuses on visa application centers located in Morocco and run by the two major contractors of European Member States, the transnational corporations VFSGlobal and TLSContact. The analysis builds on ethnographic research that encompasses the making of EU visa policy at the European, national and local levels. It aims at uncovering the reasons that have led to the adoption of outsourcing as a normal and legitimized mode to implement EU visa policy and the effects of that choice.

Law and Migration is an authoritative volume which draws on statutory and case law to expose the limitations of the law in protecting the individual caught in the complex web of national and regional constraints on migration. International law provides for the exercise of the sovereign power of states to control the entry of non-nationals. However, more recent international conventions have shown a growing awareness of the failure of the law to protect individuals and their families from violation of their human rights and civil liberties. Whilst avoiding open conflict with the principle of sovereignty, national courts have strived to comply with the spirit of human rights conventions and have often decided in favour of individuals. This book argues that early European Commission officials envisaged an integrated civil Europe from the outset. Largely overlooked is the fact that between 1951 and 1972 there was a group of European Commission (and before that the High Authority) officials who wished to build a Civil Europe to sit alongside an economic and political Europe. This Civil Europe was, it was hoped, to become home to a European citizenry equipped with a European civil consciousness that complemented their national and local loyalties. To this end these officials pioneered a series of civil initiatives designed to begin the process of building Civil Europe. This book analyses three such civil initiatives: the building of the first European School, the European Community's participation in Expo 58 and the production of the European Community's own documentaries. From the start Europe was designed and conceived of in terms of a European general civil public and not solely in terms dictated by economic and political interests.

With Economic and Monetary Union, the European Union has embarked on one of the biggest projects in its history. Previous literature has focused on how EMU came into being and on the policy issues that it raises. This text seeks to move the discussion forwards by offering a systematic evaluation of how it is affecting EU states, both members and non-members of the Euro-Zone. It explicitly situates EMU in the growing literature on Europeanization. It examines the effects on public policies, political structures, discourses, and identities. The book seeks to identify the scope of EMU's effects, the direction that it imparts to political and policy changes, the mechanisms by which it produces its effects, and the role of domestic institutions, political leadership and specific forms of discourse in shaping responses. This book explores the role of scientific evidence within United Nations (UN) deliberation by examining the negotiation of the Sustainable Development Goals (SDGs), endorsed by Member States in 2015. Using the SDGs as a case study, this book addresses a key gap in our understanding of the role of evidence in contemporary international policy-making. It is structured around three overarching questions: (1) how does scientific evidence influence multilateral policy development within the UN General Assembly? (2) how did evidence shape the goals and targets that constitute the SDGs?; and (3) how did institutional arrangements and non-state actor engagements mediate the evidence-to-policy process in the development of the SDGs? The ultimate intention is to tease out lessons on global policy-making and to understand the influence of different evidence inputs and institutional factors in shaping outcomes. To understand the value afforded to scientific evidence within multilateral deliberation, a conceptual framework is provided drawing upon literature from policy studies and political science, including recent theories of evidence-informed policy-making and new institutionalism. It posits that the success or failure of evidence informing global political processes rests upon the representation and access of scientific stakeholders, levels of community organisation, the framing and presentation of evidence, and time, including the duration over which evidence and key conceptual ideas are presented. Cutting across the discussion is the fundamental question of whose evidence counts and how expertise is defined? The framework is tested with specific reference to three themes that were prominent during the SDG negotiation process; public health (articulated in SDG 3), urban sustainability (articulated in SDG 11), and data and information systems (which were a cross-cutting theme of the dialogue). Within each, scientific communities had specific demands and through an exploration of key literature, including evidence inputs and UN documentation, as well as through key informant interviews, the translation of these scientific ideas into policy priorities is uncovered. The intended audiences of this book include academic practitioners studying evidence to policy processes, multilateral negotiation and/or UN policy planning. The book also intends to provide useful insights for policy makers, including UN diplomats, officials and staff working to improve the quality of evidence communication and uptake within multilateral institutions. Finally, it aims to support the whole global academic and scientific community, including students of public policy and political science, by providing insights on how to input into, influence, and even shape international evidence-informed policy-making.

This book is a researched study of land issues in American Samoa that analyzes the impact of U.S. colonialism and empire building in the nineteenth and twentieth centuries. Carefully tracing changes in land laws up to the present, this volume also draws on a careful examination of legal traditions, administrative decisions, court cases and rising tensions between indigenous customary land tenure practices in American Samoa and Western notions of individual private ownership. It also highlights how unusual the status of American Samoa is in its relationship with the U.S., namely as the only "unincorporated" and "unorganized" overseas territory, and aims to expand the U.S. empire-building scholarship to include and recognize American Samoa into the vernacular of Americanization projects.
European Regulatory Agencies (ERAs) have become increasingly important features in EU decision-making. They aim to provide expert advice independent of political or economic considerations. This book explains whether and under what conditions ERAs comply with this scientific mandate. Expanding on rational institutionalism, Ossege provides novel insights into the behaviour of ERAs, their autonomy from 'undue' external influence, and their impact on EU policy-making. The empirical comparison of three major ERAs - the European Medicines Agency, the European Food Safety Authority, and the European Chemicals Agency - not only shows that agencies capitalise on their expertise and rule-making competences to protect their autonomy. Rather, in making strategic use of their expertise, the ERAs also guard their autonomy in areas of high political salience, though their policy influence in these areas is partially circumscribed. Based on these insights, European Regulatory Agencies in EU Decision-Making locates its subject in the wider system of European Governance and considers the perennial question of how to reconcile the need for expert advice with democratic decision-making.
