Through its focus on EU Association Agreement negotiations, this book goes beyond the study of traditional EU trade negotiations and puts the spotlight on the increasing number of negotiations where trade relations are discussed alongside political ones. This setting makes both the negotiations themselves and the definition of the EU's positions more complicated, raising the question as to what ultimately determines the EU's behaviour in such complex negotiations spanning multiple of the EU's policy areas. Offering a generalizable analytical model to study such complex EU international negotiations, the book illuminates the preferences and interactions between individual parts of the EU's foreign affairs bureaucracy, and those between the lead actors, the Directorate General for Trade, and the European External Action Service (EEAS), in particular. In doing so, it demonstrates the utility of adapting the concept of bureaucratic politics from Foreign Policy Analysis (FPA) to the EU's foreign policy decision-making apparatus across different stages of EU international negotiations. It also discusses how the institutional changes of the Treaty of Lisbon have altered the institutional set-up of the EU's foreign affairs bureaucracy and thereby changed the foundations of the EU's bureaucratic politics. Finally, the book finds that the EU's behaviour in these negotiations is ultimately shaped, on the one hand, by the presence of diverging positions between its institutional actors, and the difficulty to bridge them through policy coordination mechanisms, on the other. Empirically, it explores these dynamics by considering the EU's Association Agreement negotiations on the Latin American continent over the last twenty years before demonstrating the analytical model's utility in the context of the EU's negotiations with Ukraine and Japan. do our ideas on this question come from? In this award winning
book, Claudia Schrag Sternberg explores some of the most
significant questions surrounding the legitimacy of the European
Union. Specifically, The Struggle for EU Legitimacy traces the
history of constructions and contestations of the EU's legitimacy,
in discourses of the European institutions and in public debate.
Through an interpretive, non-quantitative textual analysis of an
eclectic range of sources, it examines both long-term patterns in
EU-official discourses and their reception in member-state public
spheres, specifically in the German and French debates on the
Maastricht and Constitutional Draft Treaties. The story told
portrays the history of legitimating the EU as a never-ending
contest over the ends and goals of integration, as well as a
balancing act - which was inescapable given the nature of the
integration project - between 'bringing the people in' and 'keeping
them out', and between actively politicising and deliberately
de-politicising the stakes of EU politics. Schrag Sternberg
suggests that continuous contestation is not only a defining
feature of this history, but a source of legitimacy in its own
right.
This book assesses the instruments and measures geared towards determining the EU's relations with it's neighbours. These are channelled on the one hand by the enlargement policy focusing on the Western Balkans and on the other hand by the neighbourhood policy which will enable the integration of Central and Eastern European neighbouring countries without offering membership. This book explores the emergence of an ius puniendi outside state criminal law and beyond international criminal law. The study connects with the reflections that have been made for some years in global law studies, showing how this trend also has a clear manifestation in the field of criminal law. The analysis begins by mapping out the different manifestations of this new global criminal regulation. How did France and Australia develop a deep strategic partnership, when only about two decades ago, a group of Australians bombed the French consulate in Perth to protest against French nuclear testing in the Pacific? Which interests, which personalities, which elements of the global context have led France and Australia to engage in a regional and global rapprochement, and what have been the human, economic and political prerequisites which enabled it? This book aims to investigate the dynamics behind this historically ambiguous relationship. More precisely, this study explains why and how France and Australia are currently engaged in a process of strategic and economic mutual empowerment and how this rapprochement has been possible, owing to thirty years of diplomatic efforts to overcome ongoing culturally and historically constructed misunderstandings and conflicts. This book demonstrates how French and Australian foreign policy-makers have understood that, in regard to their numerous common interests, both countries had to mutually empower each other in order to strengthen their own power, regionally and globally. This book argues that these inclusive dynamics of empowerment constitute the response of two diverse middle powers to current global threats and represent a tool suitable for modernising the strategies and practices of both countries' diplomacies. This book is an exploration of how the European Union (EU) and other regional actors construct, understand and use different forms of power in a political space that is increasingly referred to as "Greater Eurasia". The contributors examine the extent that the understanding of power shapes how states and the EU act on a range of questions from energy to the balance of power in Eurasia. They explore how the EU's and other regional actors', primarily Russia's, understanding of power determines whether the post-Soviet space is a neighbourhood, a battleground or an arena for geopolitical and geostrategic confrontation. The chapters deal with a range of issues from negotiations between the EU and Azerbaijan, to how the EU and Russia are trying to shape relations in Central Asia. The volume represents an innovative way of understanding the changing dynamics of the relationship between Russia and the EU, with some original empirical data, and presents these dynamics within a broader conceptual and geographic framework. It also contributes to emerging debates about how the ideational construction of political space may provide insight into how actors behave. Between 1989 and 2004, the EU's conditionality for membership transformed Central and East Europe. The EU had enormous potential power over the whole range of domestic politics in the candidate countries. However, the EU was able to use that power at a few key points in the process leading to their accession. The EU's long-term influence worked primarily through soft power and through voluntary rather than coercive means. During the membership preparations, the EU built many different routes of influence into the candidate countries' domestic policy-making through 'Europeanization'. The Central and East Europeans voluntarily took on the Union's norms and methods, guided by the European Commission, in a massive transfer of policies and institutions. However, the EU missed important opportunities to effect change as well. The EU's Transformative Power explores in detail how the EU used its influence to control the movement of people across Europe, through both coercive use of conditionality and voluntary methods of Europeanization.

This book is an examination and critique of the methods employed by the United Nations in adopting human rights instruments. Three of the major instruments - the International Convention on the Elimination of All Forms of Racial Discrimination, the Convention on the Elimination of All Forms of Discrimination Against Women, and the International Convention on Civil and Political Rights - are selected for detailed study. The author concludes that the present system of law-making is inadequate and points to many examples of unclear provisions and of overlap and conflict within a single instrument or between instruments. In order that this important function of the organized international community, that of protecting human rights, can work effectively, improvements in law-making techniques are necessary, and Professor Meron concludes with some suggestions for reforms both of the institutions and of the process itself.

This book examines how international order at sea is challenged, changed and maintained. The book surveys challenges to the international order at sea in the Asia-Pacific, the Indian Ocean Region, the Atlantic Ocean and the Arctic Ocean. It explores the interaction between and cooperation among leading, emerging and smaller naval powers, both naval and coastguard responses, required for the maintenance of good order at sea. Six broad and interlinked issues are identified that will influence the future international order at sea: the balance between the maritime and the continental domains; the balance between great power rivalry and cooperation; the contest between access and denial; the operational balance between preparing; building and training for warfighting as opposed to operations other than war; how to manage 'disorder' security challenges that very often transcends territorial waters and national boundaries, and finally, the balance between safeguarding national interests and contributing to collective efforts preserving the international order at sea.

This second volume investigates the structures, institutions and processes put in place by national governments in Brussels. From a comparative perspective, the book assesses the responses of governments to the demands of EU membership. We need a world trade organization. We just don't need the one that we have. By pitching unequally matched states together in chaotic bouts of negotiating the global trade governance of today offers - and has consistently offered - developed countries more of the economic opportunities they already have and developing countries very little of what they desperately need. Endogenous growth theory has significantly impacted most of the developing and developed countries, shifting priorities of industrial policies towards innovation. In line with this trend, the European Union significantly increased its budgetary allocation for R&D. However, statistical data show a weak correlation between R&D expenditure and the acceleration of economic growth. Regional innovation policies display divergent returns according to different institutional conditions and policy choices. Grillo and Nanetti attempt to understand the reasons that lie behind differences in performance. Their results show that better performing innovation strategies require the following factors: clear choices of locally congruent smart specialization; strong capacity of public investment to stimulate additional private investment; clear distribution of responsibilities for decision-making and independence of policy implementation from political interference; and problem solving partnerships amongst innovators, universities, and governments that pre-exist the programmes. These factors point to a relationship between democracy (defined as openness of policy-making) and innovation (as technology-enabled growth) which is explored throughout this book.
Through detailed comparative case studies of civil society engagement with two major regional international organizations in Southeast Asia this book demonstrates the potentials and limitations of civil society actors as democratizing agents in governance beyond the nation-state. Drawing on previous research on civil society, social movements, transnational activism, and democratization, Uhlin develops an analytical framework focusing on a) how national and international political opportunities shape-and are shaped by-civil society advocacy; b) how civil society activists frequently combine inside and outside strategies when targeting international organizations; and c) how civil society advocacy can have a liberalizing impact on the targeted international organizations. Drawing on rich empirical data, including more than 100 qualitative interviews with civil society activists and representatives of the Asian Development Bank (ADB) and the Association of Southeast Asian Nations (ASEAN), the study demonstrates how civil society actors have contributed to pushing ADB-and to a much lesser extent ASEAN-in a political liberal direction, improving transparency, strengthening accountability, and introducing mechanisms protecting people from the abuse of power. With its innovative analytical framework, broad scope covering civil society activism across Southeast Asia, and in-depth analysis of civil society attempts to influence ADB and ASEAN the book makes important contributions to research on civil society activism in Southeast Asia as well as the more general field of civil society and governance beyond the nation-state. |
