The last two decades have witnessed an ever growing partisan divide in US politics over climate change and global warming. Significant elements in the Republican Party became openly hostile to the scientific evidence and, following the election of George W. Bush, legislative action at the federal level effectively ground to a halt. This opened up space at the state and local level to develop climate change policies with cities such as Chicago, San Francisco and New York implementing a number of initiatives that brought real and substantive developments. The election of Barack Obama in 2008 seemed to open new possibilities for federal and global leadership once more and whilst the Obama administration has been criticised for a somewhat contradictory approach to the issue at times, there were nonetheless a number of substantive policy developments. Through a substantive and detailed analysis of the politics of climate change, this book places the evolution of US climate policy within broader debates on the nature of politics in the US and argues that there exists a latent potential, often obscured by the complexities of its political system, for America to act as a world leader on the issue. A combination of economic transformation, political transitions and changes in media have substantially, if incrementally, altered the terrain for political participation globally, particularly in Asia, home to several of the most dramatic such shifts over the past two decades. This book explores political participation in Asia and how democracy and authoritarianism function under neoliberal economic relations. Cosmopolitanism, as an intellectual and political project, has failed. The portrayal of human rights, especially European, as evidence of cosmopolitanism in practice is misguided. Cosmopolitan theorists point to the rise of claims-making to the European Court of Human Rights (ECtHR) among Europe's Muslims to protect their right to religious freedom, mainly concerning the hijab, as evidence of cosmopolitan justice. However, the outcomes of such claims-making show that far from signifying a cosmopolitan moment, European human rights law has failed Europe's Muslims. Human Rights, Islam and the Failure of Cosmopolitanism provides an empirical examination of claims-making and government policy in Western Europe focusing mainly on developments in the UK, Germany, France, Italy and the Netherlands. A consideration of public debates and European law of conduct in the public sphere shows that cosmopolitan optimism has misjudged the magnitude of the impact claims-making among Europe's Muslims. To overcome this cul-de-sac, European Muslims should turn to a new 'politics of rights' to pursue their right to religious expression. This book is a theoretically challenging re-evaluation of cosmopolitan arguments through a rigorous discussion of rights-making claims by Europe's Muslims to the European Court of Human Rights. It combines sociological and legal case analysis which advances understanding of one of the most pressing topical issues of the day.

In 1922 Winston Churchill prepared to defend his parliamentary seat of Dundee in the General Election. Providing a contemporary history of the Palestinian prisoners movement, this book illustrates the centrality of the movement in the broader Palestinian national struggle. Based on direct interviews with former prisoners and former security sector personnel, it offers new insights into the strategies that prisoners employed to gain rights over time, as well as the tactics used by prison authorities to maintain control. Prisons have functioned as microcosms of the broader Israeli-Palestinian conflict for decades, with the Israeli state aiming to use mass incarceration for security, and Palestinian prisoners seeking to take back the prison space for organizing and resistance. Prisoners' actions included but were not limited to hunger strikes, as prisoners often relied more on everyday acts of noncompliance and developing an internal "counterorder" to challenge authorities. The volume demonstrates how the Palestinian prisoners movement was intertwined with the Palestinian national movement, strongest in the popular mobilization era of the 1970s and 1980s, and significantly weaker and more fragmented after the Oslo Accords of the 1990s and the second intifada. Presenting a fresh analysis of a central, but often overlooked aspect of the Israeli-Palestinian conflict, the volume offers valuable reflections on prison-based resistance in protracted conflicts more broadly. It is a key resource to students and scholars interested in contemporary conversations on mass incarceration, criminal justice, Middle East politics and history.

This book examines the origins of Ireland in its first independent incarnation, the Irish Free State (1922-1937). It explores how contemporary public relations and propaganda techniques were used to construct an identity for this new state - a state which after enduring seven years of insurrection and civil war, became one of the most stable democracies in Europe. This stability, the book argues, was constructed not solely through policies enacted by governments, but through the construction of a Gaelic, Catholic and Celtic national identity. By shifting the perspective to how nation building was communicated, it weaves an interdisciplinary narrative that initiates a new understanding of nation building - providing insights of increasing relevance in current world events. Avoiding a simplistic cause and effect history of public relations, the book examines the uses and effects of early public relations from a political and societal perspective and suggests that while governments were only modestly successful in their varied propaganda efforts, cumulatively they facilitated a transition from violence to peace. This will be of interest to researchers and advanced students with an interest in public relations, propaganda studies, nation building and Irish studies.

This book explores situations in which public opinion presents itself as an obstacle to the protection and promotion of human rights. Taking an international law perspective, it primarily deals with two questions: first, whether international law requires States to take an independent stance on human rights issues; second, whether international law encourages States to inform and mobilise public opinion with regard to core human rights standards. The discussion is mainly organised within the framework of the UN system. The work is particularly relevant to situations in which public opinion appears as discriminatory attitudes based on race, gender, age, health, sexual orientation and other factors. It is also pertinent to circumstances in which public opinion is responsible for the existence of certain harmful customs and practices such as female genital mutilation and capital punishment. Noting that the death penalty is increasingly recognised as an infringement of human rights, this study further challenges States' argument that capital punishment cannot be abolished because of public opinion. The book also discusses the role that education bears under international law in moulding favourable attitudes towards human rights. Finally, the book challenges States' acceptance that public opinion cannot be confronted in this respect.

Although human rights belong to all persons on the basis of their humanity, this book demonstrates that in the practice of international human rights law, the freedom to be non-religious or atheist does not receive the same protection as the freedom to be religious. Despite the claimed universality of freedom of religion and belief contained in article 18 of the International Covenant on Civil and Political Rights, the key assertion made is that there is a hierarchy of religion and belief, with followers of major established religions enjoying high protection and low regulation at the top, and atheists and non-believers enduring high persecution and weaker protection at the bottom. The existence of this hierarchy is proven and critiqued through three case study chapters that respectively explore the extent to which non-religious and atheist rights-holders enjoy freedom from proselytism, freedom from hate and freedom from the religions of their parents.

This book offers a unique Australian perspective on the global crisis in refugee protection. Using performance as both an object and a lens, this volume explores the politics and aesthetics of migration control, border security and refugee resistance. The first half of the book, titled On Stage, examines performance objects such as verbatim and documentary plays, children's theatre, immersive performance, slam poetry, video art and feature films. Specifically, it considers how refugees, and their artistic collaborators, assert their individuality, agency and authority as well as their resistance to cruel policies like offshore processing through performance. The capacity to abuse, or in general affect the enjoyment of human, labour and environmental rights has risen with the increased social and economic power that multinational companies wield in the global economy. At the same time, it appears that it is difficult to regulate the activities of multinational companies in such a way that they conform to international human, labour and environmental rights standards. This has partially to do with the organization of companies into groups of separate legal persons, incorporated in different states, as well as with the complexity of the corporate supply chain. Absent a business and human rights treaty, a more coherent legal and policy approach is required. Faced with the challenge of how to effectively access the right to remedy in the European Union for human rights abuses committed by EU companies in non-EU states, a diverse research consortium of academic and legal institutions was formed. The consortium, coordinated by the Globernance Institute for Democratic Governance, became the recipient of a 2013 Civil Justice Action Grant from the European Commission Directorate General for Justice. A mandate was thus issued for research, training and dissemination so as to bring visibility to the challenge posed and moreover, to provide some solutions for the removal of barriers to judicial and non-judicial remedy for victims of business-related human rights abuses in non-EU states. The project commenced in September 2014 and over the course of two years the consortium conducted research along four specific lines in parallel with various training sessions across EU Member States. The research conducted focused primarily on judicial remedies, both jurisdictional barriers and applicable law barriers; non-judicial remedies, both to company-based grievance. The results of this research endeavour make up the content of this report whose aim is to provide a scholarly foundation for policy proposals by identifying specific challenges relevant to access to justice in the European Union and to provide recommendations on how to remove legal and practical barriers so as to provide access to remedy for victims of business-related human rights abuses in non-EU states.
