African Asylum at a Crossroads: Activism, Expert Testimony, and Refugee Rights examines the emerging trend of requests for expert opinions in asylum hearings or refugee status determinations. Since the beginning of the conflict in 2003, more than 300,000 lives have been lost in Darfur. Players of the video game Darfur Is Dying learn this sobering fact and more as they work to ensure the survival of a virtual refugee camp. The video game not only puts players in the position of a struggling refugee, it shows them how they can take action in the real world. Creating the Witness examines the role of film and the Internet in creating virtual witnesses to genocide over the last one hundred years. The book asks, how do visual media work to produce witnesses-audiences who are drawn into action? The argument is a detailed critique of the notion that there is a seamless trajectory from observing an atrocity to acting in order to intervene. According to Leshu Torchin, it is not enough to have a camera; images of genocide require an ideological framework to reinforce the messages the images are meant to convey. Torchin presents wide-ranging examples of witnessing and genocide, including the Armenian genocide, the Holocaust (engaging film as witness in the context of the Nuremburg trials), and the international human rights organization WITNESS and its sustained efforts to use video to publicize human rights advocacy and compel action. From a historical and comparative approach, Torchin's broad survey of media and the social practices around it investigates the development of popular understandings of genocide to achieve recognition and response-both political and judicial-ultimately calling on viewers to act on behalf of human rights.
During the late 1960s and early 1970s, Brazil's dictatorship arrested, tortured, and interrogated many people it suspected of subversion; hundreds of those arrested were killed in prison. In May 1970, Marcos P. S. Arruda, a young political activist, was seized in Sao Paulo, imprisoned, and tortured. "A Mother's Cry" is the harrowing story of Marcos's incarceration and his family's efforts to locate him and obtain his release. Marcos's mother, Lina Penna Sattamini, was living in the United States and working for the U.S. State Department when her son was captured. After learning of his arrest, she and her family mobilized every resource and contact to discover where he was being held, and then they launched an equally intense effort to have him released. Marcos was freed from prison in 1971. Fearing that he would be arrested and tortured again, he left the country, beginning eight years of exile. Lina Penna Sattamini describes her son's tribulations through letters exchanged among family members, including Marcos, during the year that he was imprisoned. Her narrative is enhanced by Marcos's account of his arrest, imprisonment, and torture. James N. Green's introduction provides an overview of the political situation in Brazil, and Latin America more broadly, during that tumultuous era. In the 1990s, some Brazilians began to suggest that it would be best to forget the trauma of that era and move on. Lina Penna Sattamini wrote her memoir as a protest against historical amnesia. First published in Brazil in 2000, "A Mother's Cry" is testimonial literature at its best. It conveys the experiences of a family united by love and determination during years of political repression.
The legal texts and aspirational ideals of human rights are usually understood and applied in a global context with little bearing on the legal discourse, domestic political struggles, or social justice concerns within the United States. In Writing Human Rights, Crystal Parikh uses the international human rights regime to read works by contemporary American writers of color—Toni Morrison, Chang-rae Lee, Ana Castillo, Aimee Phan, and others—to explore the conditions under which new norms, more capacious formulations of rights, and alternative kinds of political communities emerge. Parikh contends that unlike humanitarianism, which views its objects as victims, human rights provide avenues for the creation of political subjects. Pairing the ethical deliberations in such works as Beloved and A Gesture Life with human rights texts like the United Nations Convention Against Torture, she considers why principles articulated as rights in international conventions and treaties—such as the right to self-determination or the right to family—are too often disregarded at home. Human rights concepts instead provide writers of color with a deeply meaningful method for political and moral imagining in their literature. Affiliating transnational works of American literature with decolonization, socialist, and other political struggles in the global south, this book illuminates a human rights critique of idealized American rights and freedoms that have been globalized in the twenty-first century. In the absence of domestic human rights enforcement, these literatures provide a considerable repository for those ways of life and subjects of rights made otherwise impossible in the present antidemocratic moment.
Gender relations in Muslim-majority countries have been subject to intense debate in recent decades. In some cases, Muslim women have fought for and won new rights to political participation, reproductive health, and education. In others, their agendas have been stymied. Yet missing from this discussion, until now, has been a systematic examination of how civil society groups mobilize to promote women's rights and how multiple components of the state negotiate such legislation. In Bargaining for Women's Rights, Alice J. Kang argues that reform is more likely to happen when the struggle arises from within. Focusing on how a law on gender quotas and a United Nations treaty on ending discrimination against women passed in Niger while family law reform and an African Union protocol on women's rights did not, Kang shows how local women's associations are uniquely positioned to translate global concepts of democracy and human rights into concrete policy proposals. And yet, drawing on numerous interviews with women's rights activists as well as Islamists and politicians, she reveals that the former are not the only ones who care about the regulation of gender relations. This book attempts to analyse the concept of religious expression vis-a-vis freedom of speech in Malaysia from the philosophical, political and theoretical perspectives. It begins by discussing the major sources of religious expression that are firmly rooted in the societal and religious beliefs, constitution and legislation of the country. It also examines multiple facets of the Islamization policy in the country and to what extent such policy affects the exercise of domestic religious expression. The problems and challenges of domestic religious expression, theoretically and practically, will also be examined including the issues of radicalization and terrorism. After a change of power from the Barisan Nasional (BN) to Pakatan Harapan (PH) in 2018, this book attempts to explain PH's approach in dealing with the issue of Islam and religious expression in Malaysia. Lastly, this book intends to identify and observe how Malaysian society and the state react to the issue of religious expression.
Asia as a continent accounts for half the world's population. Within its boundaries, there is an incomparable diversity of cultures, socio-economic standards and political structures. And all the world's major religions-Hinduism, Islam, Judaism, Buddhism and Christianity-have their origins in Asia. Little wonder that religion is always involved in the flash points that occur across the region. Religious freedom and religious persecution knows no boundaries and are alive and well in all their complexions from Korea in the north to Indonesia in the south, from the Philippines in the east to Pakistan in the west. And UCAN has reporters and analysts across Asia's full extent. We have brought our unique network to the task of examining and the evaluating the prospects for religious freedom and the causes of religious persecution in Asia. As rational beings, we humans actualize our highest capacity when we make choices. For that exercise we need freedom. At the heart of all freedoms-political, economic and cultural especially-is the freedom to believe. Religious freedom is the fundamental freedom. Belief and its restriction attack the heart of freedom. But the circumstances and conditions of religious freedom and the persecution of believers vary greatly across the continent. The range and reach of those circumstances and conditions across Asia are what this volume offers.
Freedom of religion or belief implies that people have the right to embrace a full range of thoughts and beliefs, including those that others might deem blasphemous; freedom of expression implies that they have the right to speak or write about them publicly. These rights are guaranteed in international documents to which most countries have agreed. Chapter 1 examines and compares the content of laws prohibiting blasphemy ("blasphemy laws") worldwide through the lens of international and human rights law principles. The right to practice your religion freely is one of the cornerstone freedoms we have in the United States. Freedom of religion is in the very first amendment of the Bill of Rights in the Constitution. Other countries take a narrower view of freedom of religion. Some impose an official religion, while others actively persecute those practicing a disfavored religion. Chapter 2 reports on the levels of religious freedom in different countries. The International Religious Freedom Act of 1998, requires the president to issue annually an International Religious Freedom Report and designate the worst violators as Countries of Particular ConcernaCPCsaa country so designated when its government has engaged in or tolerated particularly severe violations of religious freedom. Chapter 3 discusses the efforts of the United States to combat religious freedom violations in Eurasia. The gravity of the situation facing religious freedom in Central Asia is of particular concern. Despite the professed desire to enact more permissive regulations on religious life, the arguments opposing far-reaching reforms are cast in terms of national security and regime stability. The terms of this argument are familiar in Central Asia, not to mention in other parts of the Muslim world, where Islam simultaneously occupied a revered position in national, social, and private life, while also preoccupying national security agencies and regime loyalists who fear its potential to catalyze political opposition and terrorism as reported in chapter 4.
The Politics of the Headscarf in the United States investigates the social and political effects of the practice of Muslim-American women wearing the headscarf (hijab) in a non-Muslim state. The authors find the act of head covering is not politically motivated in the US setting, but rather it accentuates and engages Muslim identity in uniquely American ways. Transcending contemporary political debates on the issue of Islamic head covering, The Politics of the Headscarf in the United States addresses concerns beyond the simple, particular phenomenon of wearing the headscarf itself, with the authors confronting broader issues of lasting import. These issues include the questions of safeguarding individual and collective identity in a diverse democracy, exploring the ways in which identities inform and shape political practices, and sourcing the meaning of citizenship and belonging in the United States through the voices of Muslim-American women themselves. The Politics of the Headscarf in the United States superbly melds quantitative data with qualitative assessment, and the authors smoothly integrate the results of nearly two thousand survey responses from Muslim-American women across forty-nine states. Seventy-two in-depth interviews with Muslim women living in the United States bolster the arguments put forward by the authors to provide an incredibly well-rounded approach to this fascinating topic. Since 9/11 and the onset of the "war on terror," the principal challenge confronting liberal democracies has been to balance freedom with security and individual with collective rights. Erik Kennes and Miles Larmer provide a history of the Katangese gendarmes and their largely undocumented role in many of the most important political and military conflicts in Central Africa. Katanga, located in today's Democratic Republic of Congo, seceded in 1960 as Congo achieved independence and the gendarmes fought as the unrecognized state's army during the Congo crisis. Kennes and Larmer explain how the ex-gendarmes, then exiled in Angola, struggled to maintain their national identity and return "home." They take readers through the complex history of the Katangese and their engagement in regional conflicts and Africa's Cold War. Kennes and Larmer show how the paths not taken at Africa's independence persist in contemporary political and military movements and bring new understandings to the challenges that personal and collective identities pose to the relationship between African nation-states and their citizens and subjects.
Survivors of terrible events are often portrayed as unsung heroes or tragic victims but rarely as complex human beings whose lives extend beyond the stories they have told. The contributors to Beyond Testimony and Trauma consider other ways to engage with survivors and their accounts based on valuable insights gained from their work on long-term oral history projects. Despite President George W. Bush's assurances that Islam is a peaceful religion and that all good Muslims hunger for democracy, confusion persists and far too many Westerners remain convinced that Muslims and terrorists are synonymous. In the aftermath of the attacks of 9/11, the subsequent wars in Afghanistan and Iraq, and the recent bombings in London, an unprecedented amount of attention has been directed toward Islam and the Muslim world. Yet, even with this increased scrutiny, most of the public discourse regarding Islam revolves around the actions of extremist factions such as the Wahhabis and al-Qa'ida. Contemporary slavery has emerged as a source of fascination and a spur to political mobilization. This volume brings together experts to carefully explore how the language of slavery has been invoked to support a series of government interventions, activist projects, legal instruments, and rhetorical and visual performances. However well-intentioned these interventions might be, they remain subject to a host of limitations and complications. Recent efforts to combat slavery are too often sensationalist, self-serving, and superficial and end up failing the test of speaking truth to power. Bringing about lasting change will require direct challenges to dominant political and economic interests.
Beginning in the 1880s, the economic realities and class dynamics of popular northern resort towns unsettled prevailing assumptions about political economy and threatened segregationist practices. The Canadian principle of reasonable accommodation demands that the cultural majority make certain concessions to the needs of minority groups if these concessions will not cause 'undue hardship.' This principle has caused much debate in Quebec, particularly over issues of language, Muslim head coverings, and religious symbols such as the kirpan (traditional Sikh dagger).
