Durch Vornahme einer Rechtsprechungsanalyse der aktuellen Entscheidungen der Obergerichte ermittelt sie die Bedeutung der Abgrenzung von Tat- und Rechtsfrage in der modernen Revisionsrealitat fur die Frage des revisibelen Bereichs im Sinne von 337 StPO und die Zulassigkeit des Divergenzvorlageverfahrens gemass 121 Abs. 2, 132 Abs. 2 GVG und wirft die Abgrenzungsfrage neu auf. Durch Entwicklung eines eigenen methodischen Ansatzes unterbreitet dieses Buch einen aktuellen Vorschlag zur Problemloesung.
