While nominally protected across Europe, the human rights of vulnerable migrants often fail to deliver their promised benefits in practice. This socio-legal study explores both the concrete expressions and possible causes of this persistent deficit. For this purpose, it presents an innovative multifaceted evaluation of selected judgments of the European Court of Human Rights and the Court of Justice of the EU pertaining to such complex questions as the protection of persons fleeing from indiscriminate violence, homosexual asylum seekers, the Dublin Regulation, and the externalisation of border control. Highlighting the demanding character of migrant rights, the book also discusses some steps that could be taken to improve the effectiveness of Europe's supranational human rights system including changes in judicial and litigation practice as well as a reconceptualization of human rights as existential commitments.

Wie wird sie dem Zuschauer vermittelt? und Wie behandelt Memento inhaltlich und formal das Thema Realitat und kunstliche Identitat?, Abstract: Christopher Nolans Film Memento ist einer der Filme, die das in den letzten Jahren offenbar wieder sehr aktuell gewordene Thema der Gedachtnisstorung aufgreifen. Vergleichbar mit Tom Tykwers "Winterschlafer," determiniert diese Krankheit das Leben der Hauptfigur, deren Hauptproblem darin besteht, die Realitat ausserhalb des eigenen Kopfes zu meistern. Memento unterscheidet sich dennoch in wesentlichen Aspekten vom klassischen Spielfilm, da er durch eine extravagante Narration den Zuschauer gleich mit zum pathologisch Kranken macht. Der scheinbar chaotische Aufbau dieses Puzzle-Thrillers besteht tatsachlich aus einem genau durchstrukturierten, systematischen Plot und einer sehr ungewohnlichen Erzahlform. Die Thematik wird wie in zentrischen Kreisen durch die formale Struktur des Films bis hinein ins kleinste Detail getragen. Etwa wie "The Sixth Sense" oder "The Usual Suspects" tragt nahezu jede Szene eine besondere Bedeutung und treibt die Handlung in immer neue Richtungen weiter, ohne aber zu verraten, wo eigentlich alles hinfuhren soll.
