Arbeiten an und mit dem Baugrund (als einem von der "Natur vorgegebenen Werkstoff") unterliegen besonderen, technisch nicht voll beherrschbaren Risiken. Realisieren sich diese technischen Risiken, was in der taglichen Baupraxis zumeist sehr kostenintensiv ist, stellt sich die Frage der rechtsgeschaftlichen bzw. gesetzlichen Gefahrtragung unter den Bauvertragsparteien. Das privatbaurechtliche Schrifttum fasst diese Konstellation mit dem Begriff "Systemrisiko" zusammen. Generell werden unter dem Begriff "Systemrisiko" weitreichende Ausnahmen vom Grundsatz der werkvertraglichen Erfolgshaftung des Unternehmers befurwortet.Mit der vorliegenden Arbeit werden die im genannten Kontext relevanten Sachverhalte gegliedert, auf die dogmatischen Grundlagen zuruckgefuhrt und so zu einer Losung gebracht.
