This work addresses the cultural background of stewardship as a progression from individual personal aesthetics to a deeply informed environmental ethic that could become a national environmental policy. Howell begins by assessing our personal cultural background and our philosophical notions of our role in the natural world. She looks at the evolution of Western civilization and changing worldviews in relation to nature, examining especially early conceptions of a more appealing, simpler life closer to nature in contrast to the perceived civilized world that is portrayed as decadent. Howell examines archetypes from literature and the popular arts, finding examples in Jungian psychology and in contemporary film and television that support the Wild Man image and promote the Simple Life yearning. She then looks at the early 20th-century conservation and preservation writers as the most direct ancestors of today's environmental movement and an immediate source of inspiration.
If, as has been asserted, everything in nature is connected to everything else, it is a lesson yet to be reflected among environmental professions, especially those serving law and policy. Nowhere is the lack of integration more apparent than in the incorporation of sound ecological principles. Yet, comprehension of these principles is a prerequisite to establishing effective environmental programs, whether local or global. Ecology and environmental sciences range from cosmology to determining toxic effects in a biological system. In short, ecology is served by, and is itself a manifestation of, all the natural sciences. Ecology is further manifested in the social sciences, directly and indirectly. In this book, ecology and environmental sciences are presented to environmental professionals in terms relevant to all their endeavors. Today's ecologies emerge from the venerable scientific endeavor. Upon placing ecology in the hierarchy of natural sciences, this volume centers on the wealth of dimensions in which ecology is expressed. Extending beyond the three spatial dimensions and that of time, ecology enters those of holistic and reductionist vantages, the last reflected in abiotic and biotic detail. Dimensions serving environmental professions include the experimental, those arising from interrelationships with adaptation and evolution, and that of human ecology. Finally, there is the intellectual dimension: Ecology as one thread in the contemporary cultural tapestry into which environmental policy and law are being woven. Scrupulously avoiding superimposition of political stance, this unique volume serves anyone lacking scientific preparation who would take a stance, professional or personal.
National institutions involved in environmental policy planning respond more to the accommodation of special interests, whether vested, parochial, or societal, than to the realities of technological advances. Through a judicious selection of cases chosen for their bearing on the popular arts, the author reviews the basic legal principles involved--copyright, trademark, unfair competition, and contract law--and analyzes their applications to fictional characters. In addition to tracing the evolution of the law relating to the protection of fictional characters, Howell explores the feasibility of isolating characters and protecting them via stringent copyright and/or trademark laws, addresses character merchandising and the associated legal issues, and suggests legal reforms aimed at protecting the creator. Detailed case information serves both to illustrate the legal principles and actions discussed and to stand as a model for the proprietors of future characters. Divided into two major sections, the volume begins by offering a comprehensive introduction to intellectual property law.
