Sofern die Anderung der Verhaltnisse im Zeitpunkt des Vertragsschlusses objektiv nicht vorhersehbar war und die Anderung nicht auf das Verschulden der kundigenden Partei zuruckzufuhren ist, gibt das Gesetz und die Rechtsprechung aus diesem Grund die Moglichkeit zur Vertragsauflosung. Das Ziel dieser Arbeit ist es, diese Thematik anhand der Kundigung von Dauerschuldverhaltnissen genauer zu behandeln. Im ersten Teil der Arbeit wird der Begriff Dauerschuldverhaltnis" erlautert. Danach werden die einzelnen Dauerschuldvertrage vorgestellt und beschrieben was sie zu dauernden Vertragen macht. Im zweiten Teil der Arbeit wird die Kundigung von Dauerschuldverhaltnissen, im Besonderen die Kundigung aus wichtigem Grund, thematisiert. Zuerst wird der wichtige Grund allgemein vorgestellt. Im Weiteren wird der Frage nachgegangen welche Umstande als wichtige Grunde zu qualifizieren sind und allenfalls eine vorzeitige Kundigung rechtfertigen.
