This book offers comprehensive coverage of the various aspects of personalized medicine as an original approach to classifying, understanding, treating and preventing disease based on individual biological differences. In the introductory section, it defines personalized medicine as a way toward new medical practices and addresses the question: What can personalized medicine offer citizens, medical professionals, reimbursement bodies and stakeholders? Subsequent chapters discuss the technological aspects of personalized medicine: data collection, comprehensive integration and handling of data, together with key enabling factors in developing the requisite technological support for personalized medicine. Lastly, the book explores the main issues shaping the implementation and development of personalized medicine - education, stakeholder participation, infrastructure, a new approach to the classification of disease and medical tests, regulatory frameworks, and new reimbursement models - together with ethical, legal and social issues. Ultimately, the book calls for interdisciplinarity and a radical change in the way we approach the health and wellbeing of individuals. Target groups are medical doctors and researchers in the field of biomedicine, as well as experts from the social sciences dealing with legal, economic and social aspects of health system issues in general. Though the book will primarily benefit these groups of professional experts, its content will also appeal to a far wider readership, as it deals with a paradigm shift in one of society's main pillars - the health system.
This book employs an innovative approach to explore the topic of flexicurity and related changes in the working world, the importance of which for the overall economic and social development is gradually being recognised. It focuses on the changing nature of work and its impact on EU law and national labour and social security laws. Though the transformation of regulatory and institutional frameworks of labour relations follows different patterns in different EU Member States, it is nevertheless a common phenomenon that offers an excellent opportunity for mutual learning experiences and comparing notes on best practices. Taking these ideas as a starting point, the book presents a collection of research on various aspects and implications of changing labour relations in the EU Member States. The opening chapters address the internal market dimension of the transformation of employment relations by investigating how social dumping, integration of migrant workers, and cross-border mergers influence national labour policies and laws. The book further analyses linguistic and terminological challenges in the field of labour law in the EU's multi-lingual legal environment. Subsequent chapters cover various theoretical and practical issues, such as the impact of chain-liability regulatory models on the legal situation of workers in subcontracting networks, and modern work arrangements in the collaborative or 'gig' economy. Other chapters are dedicated to issues of jurisdiction and law applicable to individual employment contracts, as well as alternative resolution mechanisms in labour disputes. The next section offers fresh insights on and a critical overview of the well-known Danish and Dutch models of flexicurity, often cited as role models for reforms of labour markets in other EU Member States. Three individual chapters investigate specific aspects of flexicurity in Croatia, in terms of individual dismissals, life-long learning and the impact of non-standard employment on future pension entitlements. One paper explores temporary agency work in Germany as an important instrument of flexicurity, while another discusses various forms of work used in Slovenia in the context of flexibilization of work relations. Many challenges still lie ahead, and the primary aim of this book is to provide a solid basis for informed future discussions.

Ziel dieser Aktion ist die Sensibilisierung der Unionsburger fur die Rechte und Moglichkeiten zur Ausubung einer Berufstatigkeit in einem anderen EU-Mitgliedstaat. Der Europaische Kommissar fur Beschaftigung, Soziales und Chancengleichheit, Vladimir pidla, wies in diesem Zusammenhang aber darauf hin, dass gegenwartig nur ca. 2 % der Unionsburger in einem anderen Mitgliedstaat als ihrem Herkunftsland leben. Damit handelt es sich in etwa um den gleichen Anteil wie vor 30 Jahren. Die Arbeitnehmerfreizugigkeit in Art. 39 ff. EGV stellt eine der zentralen Grundfreiheiten des EG-Binnenmarktes dar. Das Ziel der Europaischen Gemeinschaft, einen Gemeinsamen Markt zu schaffen (vgl. Art. 14 Abs. 1 EGV), kann ohne eine weitgehende Mobilitat auch des Produktionsfaktors Arbeit nicht verwirklicht werden. Allerdings werfen Wanderungsbewegungen von Arbeitnehmern innerhalb der EU erhebliche soziale und arbeitsmarktpolitische Fragen mit teilweise hohem Konfliktpotenzial auf, die zu einer progressiven Anpassung der nationalen Rechtsordnungen gefuhrt haben. Insbesondere die langfristige soziale und gesellschaftliche Eingliederung der Arbeitnehmer und ihrer Familienangehorigen gewann an Bedeutung, weil viele Wanderarbeitnehmer nicht mehr in ihre Heimat zuruckkehrten."
Studienarbeit aus dem Jahr 1990 im Fachbereich Jura - Steuerrecht, Note: 16 von 18 Punkten, Eberhard-Karls-Universitat Tubingen (Juristische Fakultat), 28 Quellen im Literaturverzeichnis, Sprache: Deutsch, Abstract: Die Ausgangsfrage der vorliegenden Untersuchung lautet, ob ein sittenwidriges Geschaft eines Unternehmers besteuert werden darf, und wenn man dieses bejaht, ob Aufwendungen, die dafur getatigt wurden, abzugsfahig und Vergunstigungen zu gewahren sind. Aufschlussreich fur die Beantwortung der Fragestellung ist die historische Entwicklung der Rechtsprechung und der Literatur zu einer Zeit, in der man noch auf keine gesetzliche Regelung zuruckgreifen konnte, bis hin zur Normierung des 5 II StAnpG und des 40 in der Abgabenordnung von 1977. Es sind auch die Tatbestandsmerkmale des 40 AO zu untersuchen, wobei zu klaren ist, ob ein strafbares oder sittenwidriges Verhalten uberhaupt eine unternehmerische Betatigung im engeren Sinne sein kann. Sind zum Beispiel die Einkunfte einer Prostituierten sonstige Einkunfte oder solche aus Gewerbebetrieb? Desweiteren ist zu fragen, ob auch die Abzugstatbestande und Steuervergunstigungen der Anwendung der Vorschrift unterfallen. Falls eine Anwendbarkeit angenommen wird, ist zu prufen, inwieweit eine Einschrankung, durch eine restriktive Auslegung der Vorschriften uber die Steuerbefreiungen und -abzuge, wegen einer Verletzung der Einheit der Rechtsordnung geboten ist. Stellt man auf einen Gesetzespositivismus ab, so wird man den 40 AO zweifelsfrei als rechtsverbindlich und durch die Finanzverwaltung und -gerichte als anwendbar bezeichnen mussen1. Trotzdem bleibt zu prufen, inwieweit es uberpositves Recht gibt, das eventuell die Vorschrift des 40 AO zuruckdrangt. Gedacht werden kann hier an eine ethische Betrachtungsweise, die fragt, ob 40 AO den Anforderungen an Gerechtigkeit und Sittlichkeit und an die "Einheit der Rechtsordnung" genugt."

Nicht nur die zunehmende internationale Wirtschaftsverflechtung, sondern die umfassende Denationalisierung gesellschaftlicher Bereiche stellt die Staaten in den nachsten Jahren vor gewaltige Herausforderungen politischer, sozialer und wirtschaftlicher Art. Die hiervon ebenso betroffenen Lander Mittel- und Osteuropas (MOE) befinden sich zusatzlich in einer schwierigen Phase der Systemtransformation. Zurzeit wird die Diskussion von zwei Richtungen dominiert, welche die kunftige weltpolitische Entwicklung entweder als Kampf der Kulturen"1 oder als Globalisierung"2 begreifen. Nach erstgenannter Ansicht zerfallen die beiden Blocke in verschiedene Staatengruppen, die miteinander konkurrieren und globale Auseinandersetzungen fuhren werden. Ausschlaggebend fur die Zusammensetzung der Bundnisse ist die Zugehorigkeit zum jeweiligen Kulturkreis. Die zweite Stromung prognostiziert die Entstehung einer homogenen Weltgesellschaft als Endstadium. Zunachst verlauft die Konfliktlinie jedoch zwischen den gesellschaftlichen Gewinnern und Verlierern des globalisierten Handelns. Beiden Zukunftsprognosen ist gemeinsam, dass nach einer Steuerungsgewalt zur Regulierung der Wirtschafts- und Finanzstrome gesucht wird, entweder als Fuhrer einer Staatengruppe oder zur Verminderung der sozialen Kosten, die durch die Globalisierung entstehen. Die gesellschaftlichen Handlungszusammenhange uberschreiten zunehmend nationale Grenzen, so dass wirksames staatliches Regieren oft nicht mehr moglich ist. E-Health-Business. Uber 10 Mio. Websites befassen sich derzeit mit Gesundheitsfragen, die ihren Anbietern mehr als 17,5 Mrd. Euro Jahresumsatz bescheren. Medizinische Arztdiagnosen per Email oder der Versand von elektronisch bestellten Medikamenten stellen die nationalen Rechtsordnungen damit vor neue Herausforderungen. Staatliche Regelungen, die aus besonderen Schutzmotivationen heraus Handel und Dienstleistungen beschranken, konnen im Wege elektronischer Geschaftsbeziehungen ausgehebelt werden. In Deutschland finden vor allem die Streitfalle um die Internet-Apotheke DocMorris mit Sitz in den Niederlanden offentliche Aufmerksamkeit. Diese Form des Arzneimittelvertriebs kann mit nationalen Vorschriften kollidieren, die aus Grunden des Verbraucher- und Gesundheitsschutzes besondere Anforderungen an den Handel mit diesen sensiblen Produkten stellen. Deswegen wurden mehrere Gerichtsverfahren gegen die niederlandische Internet-Apotheke angestrengt. In den meisten Entscheidungen wurde ihr im Wege einstweiliger Verfugungen der Arzneimittelversand nach Deutschland untersagt. Das LG Frankfurt setzte nun ein Verfahren in der Hauptsache aus und legte dem Europaischen Gerichtshof im Wege der Vorabentscheidung nach Art. 234 EGV verschiedene Fragen zur Anwendbarkeit europaischen Rechts beim Online-Handel mit Medikamenten vor. Bei Sport und Recht handelt es sich um zwei Themenkomplexe, deren Beruhrungspunkte mit der wachsenden okonomischen Bedeutung des Profi-Sports in den letzten Jahren spurbar zugenommen haben. Dadurch wird der Sport - und zwar auf nahezu allen Rechtsgebieten - immer mehr in die rechtliche Betrachtung einbezogen. Die Konsequenz ist eine Fulle an Rechtsstreitigkeiten, die manch einen Sportwettkampf an Spannung und Bedeutung weit ubertreffen. Auch der Europaische Gerichtshof (EuGH) hatte zwischenzeitlich mehrfach die Gelegenheit, zu den Grenzen der Sportverbandsautonomie Stellung zu nehmen, meist mit grosser Wahrnehmung in der breiten Offentlichkeit. Selten hat der EuGH eine derartige Aufmerksamkeit fur sich verbuchen konnen wie in den Entscheidungen "Bosman" und "Meca-Medina und Majcen," die von nahezu jedem Fussballverbandsprasidenten kommentiert wurden. Ziel dieses Sammelbandes ist es, dem Sportrechtler oder Sportrechtsinteressierten eine Orientierungshilfe zu geben, um sich in der Fulle an Sportrechts- und Sportwirtschaftsliteratur zurechtzufinden. Ferner versteht sich dieses Sammelwerk als Aufforderung, sich an dem themenubergreifenden, wissenschaftlichen Diskurs des Sportrechts zu beteiligen.
