American Legal Thought from Premodernism to Postmodernism - An Intellectual Voyage (Hardcover): Stephen M. Feldman American Legal Thought from Premodernism to Postmodernism - An Intellectual Voyage (Hardcover)
Stephen M. Feldman
R4,292 Discovery Miles 42 920 Ships in 10 - 15 working days

American legal thought has progressed remarkably quickly from premodernism to modernism and into postmodernism in little over two hundred years, running from the nation's founding through today. This book tells the story of this mercurial journey through jurisprudence by showing the development of legal thought through these three intellectual periods. Feldman's narrative revolves around two broad interrelated themes: jurisprudential foundations and the idea of progress. Comprehensive and accessible, the book draws on significant cases from Supreme Court history to provide a handy one-volume overview for law students, practitioners, and legal scholars.

The XYZ of Psychoanalysis - Epilogue to a Great Beginning (Hardcover, New edition): Irma M. Feldman The XYZ of Psychoanalysis - Epilogue to a Great Beginning (Hardcover, New edition)
Irma M. Feldman
R2,047 Discovery Miles 20 470 Ships in 18 - 22 working days

The century during which psychoanalysis developed was a creative interval of transition, when hysterical and ritualistic object relations permitted the great Freudian truths to be articulated. For about thirty years, from the theory of dreams and sexuality to the discovery of narcissistic transference, psychoanalysts enjoyed a realistic experience of synthesis. But, according to Harold Feldman, the science of personality, given such a profound impetus by Freud and his colleagues almost a hundred years ago, has receded and faded. "The XYZ of PsychoanalysiS" is a unique examination of the future of psychoanalysis, based on its Freudian past. Although the author was a passionate Freudian, he writes simply and without relying on ideology. He proposes that we understand psychoanalysis as an organic link in the history of Freudian thought. His view of the historical context of psychoanalysis, his examination of the dominant occupational hazard (psychopathy of the practitioner), and his understanding of and ability to articulate the fundamentals of the science of the mind move his work beyond the scope of any other treatise on the subject.

"The XYZ of PsychoanalysiS" is particularly relevant to the psychotherapeutic practitioner who would otherwise be forced to sift through the literature to gain such a broad understanding of the great century of psychoanalysis. It also addresses fundamental issues of interest to a wide-ranging audience of historians, sociologists, students of literature, and political philosophers.

This book is a result of teaching stochastic processes to junior and senior undergr- uates and beginning graduate students over many years. In teaching such a course, we have realized a need to furnish students with material that gives a mathematical presentation while at the same time providing proper foundations to allow students to build an intuitive feel for probabilistic reasoning. We have tried to maintain a b- ance in presenting advanced but understandable material that sparks an interest and challenges students, without the discouragement that often comes as a consequence of not understanding the material. Our intent in this text is to develop stochastic p- cesses in an elementary but mathematically precise style and to provide suf?cient examples and homework exercises that will permit students to understand the range of application areas for stochastic processes. We also practice active learning in the classroom. In other words, we believe that the traditional practice of lecturing continuously for 50 to 75 minutes is not a very effective method for teaching. Students should somehow engage in the subject m- ter during the teaching session. One effective method for active learning is, after at most 20 minutes of lecture, to assign a small example problem for the students to work and one important tool that the instructor can utilize is the computer. So- times we are fortunate to lecture students in a classroom containing computers with a spreadsheet program, usually Microsoft's Excel.

Please Don't Wish Me a Merry Christmas - A Critical History of the Separation of Church and State (Hardcover): Stephen M.... Please Don't Wish Me a Merry Christmas - A Critical History of the Separation of Church and State (Hardcover)
Stephen M. Feldman
R2,895 Discovery Miles 28 950 Ships in 18 - 22 working days

Whether in the form of Christmas trees in town squares or prayer in school, fierce disputes over the separation of church and state have long bedeviled this country. Both decried and celebrated, this principle is considered by many, for right or wrong, a defining aspect of American national identity.

Nearly all discussions regarding the role of religion in American life build on two dominant assumptions: first, the separation of church and state is a constitutional principle that promotes democracy and equally protects the religious freedom of all Americans, especially religious outgroups; and second, this principle emerges as a uniquely American contribution to political theory.

In Please Don't Wish Me a Merry Christmas, Stephen M. Feldman challenges both these assumptions. He argues that the separation of church and state primarily manifests and reinforces Christian domination in American society. Furthermore, Feldman reveals that the separation of church and state did not first arise in the United States. Rather, it has slowly evolved as a political and religious development through western history, beginning with the initial appearance of Christianity as it contentiously separated from Judaism.

In tracing the historical roots of the separation of church and state within the Western world, Feldman begins with the Roman Empire and names Augustine as the first political theorist to suggest the idea. Feldman next examines how the roles of church and state variously merged and divided throughout history, during the Crusades, the Italian Renaissance, the Protestant Reformation, the British Civil War and Restoration, the early North American colonies, nineteenth-century America, and up to the present day. In challenging the dominant story of the separation of church and state, Feldman interprets the development of Christian social power vis--vis the state and religious minorities, particularly the prototypical religious outgroup, Jews.

Pack the Court! - A Defense of Supreme Court Expansion (Hardcover): Stephen M. Feldman Pack the Court! - A Defense of Supreme Court Expansion (Hardcover)
Stephen M. Feldman
R2,216 Discovery Miles 22 160 Ships in 10 - 15 working days

The United States Supreme Court has numbered nine justices for the past 150 years. But that number is not fixed. With the Democrats controlling the House and Senate during the Biden presidency, they could add justices to the Supreme Court. But would court packing destroy the Court as an apolitical judicial institution? This is the crucial question Stephen Feldman addresses in his provocative book, Pack the Court! He uses a historical, analytical, and political argument to justify court-packing in general and Democratic court-packing more specifically. Republicans and Democrats alike profess to worry that court-packing will destroy the legitimacy of the Supreme Court as a judicial institution by injecting politics into a purely legal adjudicative process. But as Feldman's insightful book shows, law and politics are forever connected in judicial interpretation and decision making. Pack the Court! insists that court packing is not the threat to the Supreme Court's institutional legitimacy that many fear. Given this, Feldman argues that Democrats should pack the Court while they have the opportunity. Doing so might even strengthen the American people's faith in the Court.

R1,787 Discovery Miles 17 870 Ships in 10 - 15 working days

Often dismissed as simply 'bad' or 'mad', the nature of Ezra Pound's fascist propaganda has been much discussed, but far less well understood to date. In consequence, the extent of Pound's activism has been wildly underestimated; there are, for example, thousands of pro-Axis radio items during WWII. These manuscripts, extending to extensive propaganda strategies and a dozen pseudonymous names, collectively reveal a modernist author far more engaged with the Axis war effort than has been previously acknowledged. Feldman's 'new historicist' approach argues that Pound was a committed, influential and significant Anglophone propagandist for Mosley's BUF, Mussolini's Italy and finally, Hitler's Germany. Through close analysis of historical context and an approach to Pound's fascist activism through the lens of 'political religions' theory, Ezra Pound' Fascist Propaganda, 1935-1945 challenges conventional wisdom on this canonical modernist by finding Pound to be a leading propagator of the 'fascist faith'.

Welfare Economics and Social Choice Theory (Hardcover, 2nd ed. 2006): Allan M. Feldman, Roberto Serrano Welfare Economics and Social Choice Theory (Hardcover, 2nd ed. 2006)
Allan M. Feldman, Roberto Serrano
R4,914 Discovery Miles 49 140 Ships in 18 - 22 working days

This book covers the main topics of welfare economics - general equilibrium models of exchange and production, Pareto optimality, un certainty, externalities and public goods - and some of the major topics of social choice theory - compensation criteria, fairness, voting. Arrow's Theorem, and the theory of implementation. The underlying question is this: "Is a particular economic or voting mechanism good or bad for society?" Welfare economics is mainly about whether the market mechanism is good or bad; social choice is largely about whether voting mechanisms, or other more abstract mechanisms, can improve upon the results of the market. This second edition updates the material of the first, written by Allan Feldman. It incorporates new sections to existing first-edition chapters, and it includes several new ones. Chapters 4, 6, 11, 15 and 16 are new, added in this edition. The first edition of the book grew out of an undergraduate welfare economics course at Brown University. The book is intended for the undergraduate student who has some prior familiarity with microeconomics. However, the book is also useful for graduate students and professionals, economists and non-economists, who want an overview of welfare and social choice results unburdened by detail and mathematical complexity. Welfare economics and social choice both probably suffer from ex cessively technical treatments in professional journals and monographs."

Law and Religion - A Critical Anthology (Paperback): Stephen M. Feldman Law and Religion - A Critical Anthology (Paperback)
Stephen M. Feldman
R975 Discovery Miles 9 750 Ships in 10 - 15 working days

Read the Introduction.

Few issues arouse as much passionate debate as the relationship between church and state. Political parties and coalitions have long jockeyed for position in the battle to either keep the two separate, or to unify them in one nation indivisible from God. While the battle has been raging in the political arena, figures from academia, the media, and myriad other vantage points, have commented on the context and constitutionality of laws governing religious expression.

In Law and Religion, Stephen M. Feldman brings together the many perspectives that have shaped policy on this important national issue. In giving voice to the political left and right, as well as to cultural, philosophical, sociological and historical perspectives, the book serves as an even-handed treatment of an issue all too often clouded by biases. Contributors ranging from Stanley Fish to Richard John Neuhaus explore issues extending from religious morality and religious freedom, to fundamentalism, the separation of church and state, religion and public schooling, and liberal political theory. Comprehensive in scope, Law and Religion will stand as an important reference for anyone seeking to further understand this complex and highly emotional topic.

Pursuing Excellence in Healthcare - Preserving America's Academic Medical Centers (Hardcover): Arthur M Feldman Pursuing Excellence in Healthcare - Preserving America's Academic Medical Centers (Hardcover)
Arthur M Feldman
R1,549 Discovery Miles 15 490 Ships in 10 - 15 working days

Much as it is with the nation's overall healthcare system, the survival of academic medical centers (AMC's) is threatened by a combination of economic, cultural, and demographic factors. If AMC's are to survive to fill their societal responsibilities, they must adopt a new philosophy. Challenging assumptions and providing the shift in perspective that a resolution of this crisis requires, Arthur Feldman PhD, MD provides us with a thoroughly researched and forward-thinking volume that all those concerned with healthcare must read. This brilliant manifesto will help physicians, policymakers, analysts, and regulators understand the challenges faced by today's AMCs. But more importantly, Pursuing Excellence in Healthcare: Preserving America's Academic Medical Centers offers a cogent, viable plan that will reestablish the leadership role that AMCs need to play in providing Americans with the best possible care.

Complications of Glaucoma Surgery (Hardcover): Robert M. Feldman, Nicholas P. Bell Complications of Glaucoma Surgery (Hardcover)
Robert M. Feldman, Nicholas P. Bell
R5,341 Discovery Miles 53 410 Ships in 10 - 15 working days

Glaucoma surgery is difficult and fraught with complications. Some complications are common and mild, while others are rare and/or vision threatening. However, good outcomes are still likely if those complications encountered are managed properly. This book is intended for those surgeons wishing to improve their skills and abilities to manage difficult problems that will come up during the care of glaucoma patients. Comprising seven comprehensive sections, chapters in this volume address outflow mechanisms after glaucoma surgery, wound healing processes and modulators, complications in filtering surgery, tube shunt implantation, and angle procedures, among other topics. The authors of each chapter provide surgical and clinical pearls not only for managing difficulties but in preventing them as well. Additionally, because each surgeon has their own way of addressing a particular situation, there is commentary at the end of each chapter to provide another opinion or strategy for dealing with a particular surgical scenario. Cross-referencing is provided throughout this book to direct the reader to as many helpful sections as possible. Both thorough and highly-illustrative, this book will help both new and experienced glaucoma surgeons deal with complications and provide successful results for their patients.

Guy L. Curry, Richard M. Feldman
R3,293 Discovery Miles 32 930 Ships in 18 - 22 working days

This text presents the practical application of queueing theory results for the design and analysis of manufacturing and production systems. This textbook makes accessible to undergraduates and beginning graduates many of the seemingly esoteric results of queueing theory. In an effort to apply queueing theory to practical problems, there has been considerable research over the previous few decades in developing reasonable approximations of queueing results. This text takes full advantage of these results and indicates how to apply queueing approximations for the analysis of manufacturing systems. Support is provided through the web site http://msma.tamu.edu. Students will have access to the answers of odd numbered problems and instructors will be provided with a full solutions manual, Excel files when needed for homework, and computer programs using Mathematica that can be used to solve homework and develop additional problems or term projects. In this second edition a separate appendix dealing with some of the basic event-driven simulation concepts has been added.

Intersections of the Legal System and the Deaf Community - From Law Enforcement to Incarceration (1st ed. 2023): David M.... Intersections of the Legal System and the Deaf Community - From Law Enforcement to Incarceration (1st ed. 2023)
David M. Feldman, Paul M. Silvasi, Dayna Rotshtyn, Caleigh Covell
R1,399 Discovery Miles 13 990 Ships in 10 - 15 working days

This book examines how those with disabilities, and in particular, the Deaf and hard-of-hearing, are impacted by the influence language and culture in policing, criminal law, and corrections. Frequently left out of policy making and research, almost no resources exist that can inform and aid law enforcement, legal, and correctional officials on culturally competent interactions with the Deaf and hard-of-hearing. As a result, this group is at a distinct disadvantage when dealing with law enforcement or the courts as well as being vastly underserved, which often lead to negative outcomes for the Deaf suspect/defendant/inmate as they attempt to interact with law enforcement and navigate the legal system. In a step-by-step presentation from arrest to incarceration each chapter will discuss a specific part of the legal system. As well as providing information on the topic, this book can serve as an important resource to the myriad of issues and difficulties that may be experiences by the Deaf suspect, defendant, or inmate, as well as by law enforcement officers, attorneys, and correctional officers.  To illustrate these issues, previous cases of Deaf suspects, defendants, and inmates will be presented and discussed to clarify key issues and to provide a perspective of the problem. Each chapter dealing with these issues will also provide suggestions for more culturally competent interactions between the Deaf community and the legal system.

Neoconservative Politics and the Supreme Court - Law, Power, and Democracy (Hardcover): Stephen M. Feldman Neoconservative Politics and the Supreme Court - Law, Power, and Democracy (Hardcover)
Stephen M. Feldman
R1,259 Discovery Miles 12 590 Ships in 10 - 15 working days

In this concise, timely book, constitutional law expert Stephen M. Feldman draws on neoconservative writings to explore the rise of the neocons and their influence on the Supreme Court. Neocons burst onto the political scene in the early 1980s via their assault on pluralist democracy's ethical relativism, where no pre-existing or higher principles limit the agendas of interest groups. Instead, they advocated for a resurrection of republican democracy, which declares that virtuous citizens and officials pursue the common good. Yet despite their original goals, neocons quickly became an interest group themselves, competing successfully within the pluralist democratic arena. When the political winds shifted in 2008, however, neocons found themselves shorn of power in Congress and the executive branch. But portentously, they still controlled the Supreme Court. Neoconservative Politics and the Supreme Court explains how and why the neoconservatives criticized but operated within pluralist democracy, and, most important, what the entrenchment of neocons on the Supreme Court means for present and future politics and law.

Free Expression and Democracy in America - A History (Paperback): Stephen M. Feldman Free Expression and Democracy in America - A History (Paperback)
Stephen M. Feldman
R1,204 Discovery Miles 12 040 Ships in 10 - 15 working days

From the 1798 Sedition Act to the war on terror, numerous presidents, members of Congress, Supreme Court justices, and local officials have endorsed the silencing of free expression. If the connection between democracy and the freedom of speech is such a vital one, why would so many governmental leaders seek to quiet their citizens? Free Expression and Democracy in America traces two rival traditions in American culture-suppression of speech and dissent as a form of speech-to provide an unparalleled overview of the law, history, and politics of individual rights in the United States. Charting the course of free expression alongside the nation's political evolution, from the birth of the Constitution to the quagmire of the Vietnam War, Stephen M. Feldman argues that our level of freedom is determined not only by the Supreme Court, but also by cultural, social, and economic forces. Along the way, he pinpoints the struggles of excluded groups-women, African Americans, and laborers-to participate in democratic government as pivotal to the development of free expression. In an age when our freedom of speech is once again at risk, this momentous book will be essential reading for legal historians, political scientists, and history buffs alike.

The Monotheisation of Pontic-Caspian Eurasia - From the Eighth to the Thirteenth Century (Hardcover): Alex M. Feldman The Monotheisation of Pontic-Caspian Eurasia - From the Eighth to the Thirteenth Century (Hardcover)
Alex M. Feldman
R3,299 Discovery Miles 32 990 Ships in 18 - 22 working days

What is the line between the ancient and medieval worlds? 330? 476? 800? Most historians acknowledge that these are arbitrary distinctions, but they remain nevertheless, taking on lives of their own. Alex Feldman challenging us to see them as the same world, except for the imposition of a given monotheism. In this process, he studies top-down, monotheistic conversions in Western Eurasia and their respective mythologisations, preserved both textually and archaeologically, serving as the foundation of recognisable state-formation. Applying this idea to Byzantium's policies around the Black and Caspian Seas, he reveals how what we today call the 'Migration-Age' continued perpetually up to the Mongolian invasions and perhaps later. This book enhances our understanding, not only of Western history, but presents it in the context of global monotheisation.
