At a time when Asia represents the fastest growing economic region,
there is no better moment to consider what trusts law can
contribute to societal stability and economic prosperity. This book
does this by offering the first work that systematically explores
trusts law across the region. Many Asian-Pacific jurisdictions have
integrated and developed trusts law in their legal systems; either
through colonial heritage or statutory activism. But the diversity
of legal traditions and local contexts has resulted in trusts laws
having a significantly varied impact across the region. In the
modern globalised world there is growing need to adopt an outward
looking approach in dealing with matters of common interest. This
book answers this need by bringing together leading legal scholars
and practitioners in the region to explore the theory and practice
of trusts law, contextualised to specific jurisdictions in the
Asia-Pacific. Exploring 17 jurisdictions in Asia, it bring both an
academic and practitioner perspective to trusts law in the region.
Recent trends in the social, economic and political lives of many
communities have created new challenges for the not-for-profit
sector, which, in turn, have demanded new legal and regulatory
responses. This Research Handbook takes account of these
developments, providing a thorough insight to current scholarship
in the field of not-for-profit law. Contributions from both
established and emerging scholars reflect a variety of disciplinary
and jurisdictional perspectives. A range of topics relating to the
not-for-profit sector are explored, including: the sector?s
composition and scope, the legal conception of charity, the tax
treatment of not-for-profits and their supporters, and the
regulation of not-for-profits. The Research Handbook also examines
the often-neglected topic of not-for-profits and the constitution.
This interdisciplinary Research Handbook makes a seminal
contribution to defining not-for-profit law as a distinctive field
of study, and in doing so, lays a strong foundation for future
research. Scholars working on not-for-profit studies, whether in
law, economics, sociology, philosophy, political science or
business management, will find this a compelling body of work as it
covers all aspects of not-for-profit law. Those working within the
sector, or providing legal advice to the sector, will also find
this Research Handbook to be an indispensable source of
information. Contributors: R. Atkinson, J. Beard, O.B. Breen, E.

This book investigates and critically evaluates the concept of
public benefit within charity law in the common law world. In the
course of the study the book: provides a rich account of how the
concept of public benefit has developed over time in charity law
jurisprudence; deepens understanding of the aspects of public
benefit that remain poorly understood even today; and suggests ways
in which public benefit jurisprudence might develop in an orderly
and principled way so as to better address some of the core
concerns of charity law and the public policy objectives that lie
behind it. The book includes contributions from world leading
charity law experts and jurists. Each chapter reflects on a key
aspect of public benefit jurisprudence in charity law. The topics
have been chosen carefully to ensure coverage of most if not all of
the large unresolved questions relating to public benefit in the
common law world. Each chapter is accompanied by a comment, written
by an academic expert or leading practitioner. The comments
complement the chapters by critically engaging with those chapters
and by offering different and thought-provoking perspectives on the
subject matter of the chapters. The book will be of interest to
academics working in law, philosophy, economics, sociology and
political science. It will also provide a valuable resource for
legal practitioners and judges, government officials, especially
charity regulators, and in the not-for-profit sector itself.
Systematic analysis of fiduciaries and trust is rare. The aim of
this volume is to help fill this gap. The chapters explore the
interactions of fiduciary law and trust, drawing on literatures on
trust that have been generated in a variety of disciplines. They do
so with an eye to the full scope of extension claimed for the
fiduciary principle, from its heartland in private law, to its
frontiers in public law and government more broadly. Overall, the
volume advances an integrated and wide-ranging understanding of the
relation of fiduciaries and trust that illuminates key legal and
political problems, and challenges and deepens our understanding of
fiduciaries and trust themselves.
Exploring Private Law presents a collection of essays, by leading
scholars from across the world, on private law doctrines, remedies,
and methods. The overarching purpose of the collection, inspired by
recent debate, is to celebrate and illustrate the contribution that
both top-down' and bottom-up' methods of reasoning make to the
development of private law. With that purpose in mind, the
contributors to the collection explore a range of topics of current
interest: judicial approaches to top-down' and bottom-up' methods;
teaching trusts law; the protection of privacy in private law; the
development of the law of unjust enrichment; the private law
consequences of theft; equity's jurisdiction to relieve against
forfeiture; the nature of fiduciary relationships and obligations;
the duties of trustees; compensation and disgorgement remedies;
partial rescission; the role of unconscionability in proprietary
estoppel; and the nature of registered title to land.

The law and policy applicable to the not-for-profit sector is of
growing importance around the world. In this book, legal experts
address fundamental questions about not-for-profit law from a range
of theoretical and comparative perspectives. The essays provide
scholarly analysis of not-for-profit law, organised around four
themes: (1) Politics, in the broader sense of living as a
community, and the narrower sense of political power; (2) Charity,
how it is defined and changes in its meaning over time; (3)
Taxation, including the rationale for government support of the
sector through the tax system; (4) Regulation, which is of
increasing significance as governments establish increasingly
complex forms of regulation of not-for-profit activity. The
fundamental aim of the book is to deepen our understanding of
not-for-profit law and of the rationales and modes of government
support for the not-for-profit sector.
Charity Law and the Liberal State considers questions relating to
state action and public discourse that are raised by the law of
charity. Informed by liberal philosophical commitments and of
interest to both charity lawyers and political philosophers, it
addresses themes and topics such as: the justifiability of the
state's non-neutral promotion of charitable purposes; the role of
altruism in charity law; charity law, the tax system and the
demands of distributive justice; the proper treatment of religious
and political purposes in charity law; and the appropriate response
of the liberal state to discrimination in the pursuit of charitable
purposes.
